Commencing February 1, 1982, and every month thereafter until the deadline for submission of franchise applications, all filings, with the exception of lobbyist registration, shall be ma.de with the City Clerk. 2. All filings shall cover the time period extending from seven days prior to the last reporting date to seven days prior to the current reporting date. 3. For the purposes of this resolution, the following defi- nitions shall apply: a. "Contacts" shall mean any substantive discussions with respect to the cable communications franchis- ing process. b. "Potential applicants" shall mean those groups or entities, including but not limited to, corpora- tions, associations, partnerships, and cooperatives which file with the City Clerk a letter of intent through which they express their interest in the cable communications franchising process for the City of Saint Paul. Any group or entity which has such an interest shall file the aforementioned letter of intent. 4. All informa.tion requests from and contacts with the Cable Communications Staff Task Force and other City staff by potential applicants and their lobbyists shall be subject to the following procedures : a. Potential applicants and their lobbyists may direct inquiries relative to City uses of a cable communications system to designated representatives of City staff, a list of whom is attached hereto and incorporated herein by reference; b. Contacts with City staff, except Council members and their aides and the Cable Communications Officer, are prohibited unless arranged through one of the named designated representatives in accordance with the procedures attached hereto and incorporated herein by reference; 2. - ti . �� � " � 2796�9 c. Commencing February 1, 1983, and every month thereafter through the final date for filing franchise applications, potential applicants, their lobbyists, and designated representatives except Council members, their aides, and the Cable Communications Officer, shall file with the Cable Communications Officer a report detailing the dates, places, and topics of any and all contacts; d. Designated representatives and other City staff shall ma.ke themselves equally available to all potential applicants and their lobbyists. 5. Council members and their aides and the Cable Communica- tions Officer shall file the following disclosures: a. A statement of financial interest in a potential applicant or affiliated firm; b. A statement of any potential conflict of interest arising from professional or personal affiliation; c. A list of contacts with lobbyists, potential applicants, and their spokespersons. 6. Potential applicants shall file the following information: a. A letter of intent; b. Names and addresses of lobbyists and of persons who will be speaking on its behalf; c. All transfers or agreements for future transfers of stock options, cash, property or other consid- erations or inducements on the part of applicants or affiliated persons or entities ; d. All expenses incurred in seeking the franchise award, including but not limited to, lobbying, public relations, marketing, advertising, research, salaries, legal fees, personal service agreements, contracted services, and donations or gifts to local individuals, groups or institutions. 7. All lobbyists shall register with the City Clerk by pro- viding the following information: � a. Name and address; b. Principal place of business; c. Name and address of each person, if any, by whom the lobbyist is retained or employed or on whose behalf the lobbyist appears ; d. If the lobbyist lobbies on behalf of an association, the names and addresses of officers and directors. Such registration shall be ma.de within five days of adoption of this resolution or within f ive days of the date the person becomes a lobbyist. 9. Purpose of the Guidelines City staff has proposed extensive municipal uses for cable technology. In order to encourage positive response by cable companies to these uses we must provide open access to knowledgeable department staff. At the same time, we want to structure the contacts so that the information given to cable companies accurately reflects city and � departmental priorities. For these reasons , we are setting up a � structured access policy. Timin "° This policy as per City Council Resolution ` will be in effect from October lst until the closing date for cable companies to submit their proposals. � Designated Departmental Representatives The attached list states the names, addresses . and phone number of those individuals designated to represent their departments �� or city offices. This list (including any changes �registered with the City Clerk' s Office) comprises the allowable contacts between city staff and cable companies representatives. Method of Contact Contact between the city staff and cable companies shall be in person or by letter of inquiry with minimal or no information exchange by telephone. Department heads and designated representatives shall provide adequate accessibility to all interested cable companies. ,The designated representatives shall provide equal access to all cable companies. Other employees may be brought in as their expertise is necessary. However, a designated representative will. attend�-each � , meeting. , Meeting Recordinq � The attached form shall be used in documenting all meetings between city staff and cable company representatives. The form contains the following information: date, location, attendees and subject matter covered. It shall be submitted to the City' s Cable Communications Office at the end of each month.
