RESOLVED, That upon execution and delivery of a release in full
to the City, in a form to be approved by the City Attorney , the
proper City officers are hereby authorized and directed to pay
out of the Tort Liability Fund 09070-511-000 , to:
l. Robert M. Behnke the sum of $287.00 in full settlement of his
claim of damages sustained on or about July 17 , 1982 , as more
particularly set out in the Notice of Claim filed in the City
Clerk's office on October 18 , 1982 .
2. Sentry Insurance and Gary Lumpkin the sum of $1,428 . 80 in
full settlement of their claim of damages sustained on or
about September 12 , 1982 as more particularly set out in
the Notice of Claim filed in the City Clerk 's office on
September 17 , 1982.

M E M O R A N D U M
CLAIMS AGAINST CITY OF SAINT PAUL
BY ROBERT M. BEHNKE and SENTRY
INSURANCE AND GARY LUMPKIN
On July 17, 1982 , claimant, Robert Behnke, was injured when a
Saint Paul police officer struck him with a riot baton in front
of the Trend Bar. It is believed that the officer involved was
James Rutten and his actions caused Mr. Behnke 's injuries . The
amount of compensation for medical expense and special damages
is $287 .00 .
On September 12 , 1982 , a Saint Paul police squad driven by
Officer Patrick Scott was enroute on a call when he backed the
squad car into a legally parked vehicle owned by claimant,
Gary Lumpkin. D4r. Luripkin 's vehicle was damaged as a result of
this accident and his vehicle was rendered inoperable for two
weeks which necessitated the use of a rental vehicle. The amount
of $1,428 . 80 represents the damage to his vehicle and car rental
expense. Mr. Lumpkin ' s insurance company , Sentry , also made
partial reimbursement on his damages and we are compensating them
for that amount.
