WHEREAS, the Departments of Public Works and Planning and Economic Development
have reviewed the attached lot split at 1518 East Seventh Street (Lot 2 except
the S. 199.4' , Block 4, Cruickshanks Garden Lots) ; and
�JHEREAS, the proposed lot split meets three of the requirements of Section 67.304
of the Zoning Code:
1 . The lot has frontage on an existing improved street and access to municipal
services;
2. The lot to be divided is previousl,y platted land; and
3. The lot meets the minimum standards for lot width and area for the zoning
districts in �vhich it is located; and
WHEREAS, the proposed lot split does not meet t�vo of the requirements of
Section 67.304 of the Zoning Code:
1 . The division of the lot will cause a remaining part of the lot to become a
separately described tract which does not have street frontage and access
to municipal services ; and
2. The division will result in a split zoning classification on a single lot;
and
laHEREAS, the lot split can be modified by taking 30 feet from the southern
parcel and adding it to the northern parcel so that the proposed lots will not
have split zoning; and
WHEREAS, a variance of the requirement for Street frontage and access to
munlcipal services can be granted without detriment to the intent of the chapter,
the public safety, or neighboring property, provided one condition is attached;

NOW, �THEREFORE, BE IT RESOLVED, that the City Council accepts and approves
this �lot split, subject to the following modification and condition:
1 . the proposed legal descriptions be amended to read as follows:
Northern tract - that part of Lot 2, Block 4 Cruickshank's Garden Lots
which lies north of a line running from a point on the West line of said
lot 2 distant 281 .81 feet south from the northwest corner of said Lot 2
to a point on the East line of said Lot 2 distant 281 .75 feet south from
the northeast corner of said Lot 2,
Southern tract; Lot 2 except the S. 199.44 feet, and except that part which
lies North of a line running from a point on the West line of said Lot
distant 281 .81 feet South from the northwest corner to a point on the East
line of said Lot distant 281 .75 feet South from the northeast corner;
2. Development of the southern tract must include improvement of dedicated
Bush Avenue.

Gentlemen:
We would like to request a variance to Section 67.304 of the zoning code
for the property located at 1518 East Seventh Street, St. Paul, Ramsey
County.
I have been appointed Guardian of Alice Bruder by the District Court of
,R amsey County and have found it necessary to sell the property. Because
,of the size of the land, approx. 100' wide and 647.56 feet deep we could
not find a buyer for the property. It was decided that it would be easier
to sell if there was less land involved. We listed and sold the house
with a land width of 100' and 251.81' deep. From Seventh Street to Ross
Street.
When the property was sold we were not aware of the City Ordinance regard-
ing Section 67.304 passed July 1, 1982 and as a result cannot record the
deed to complete the sale.
If the variance is granted this will leave approx.. 395.75 feet of vacant
land between Ross Street and Bush Street, which is being filled with brick
by Kamish Construction Co. Bush Street is dedicated as a right of way.
