5. That the petitioners furnish the City with a bond in
the amount of $2,000.00, and in addition thereto, by
acceptance of the terms and conditions of this
vacation, agrees to indemnify, defend and save harm-
less the City of St. Paul, its officers and employees
from all suits, actions, or claims of any character,
including, but not limited to, a claim brought because
of any injuries, or damages received or sustained by
any person, persons or property, on account of this
vacation; or because of any act or omission, neglect
or misconduct of said petitioners; or because of any
claim or liability arising from or based on any
violation of any law or regulation made in accordance
with the law, whether by the petitioners or any of
their agents or employees.

RESOLVED, That upon the petition of Dianne and Robert
Walsh, et al, that section of public alley hereinafter described,
be and the same hereby is vacated and discontinued as a public
alley:
"All of the East-West alley as platted
in Block 6, Lexington Park Platt Eleven;"
subject expressly to the following conditions and reservations:
l. That the vacation be subject to all the terms and
conditions of Chapter 130, codified March 1, 1981,
of the St. Paul Legislative Code, as amended,
including the retention of all public utilties
easements.
2. Tha t a spec if ic ea sement be reta ined to protect the
interests of Northern States Power Company within
the vacated alley.
3 . Tha t a spec if ic ea sement be reta ined in. the a lley to
protect the interests of Northwestern Bell Telephone

Subject: Petition of Dianne and Robert Walsh, et al, for the vacation
of East-West alley in Block 6, Lexington Park Platt Elev�n
public Hearing - October 19, 1982
The petitioners, Dianne and Robert Walsh, et al, owners of the abutting
property to the proposed vacated alley propose to use the vacated area for
additional yard space. This East-West alley is unimproved, 20 feet by 182.78
feet more-or-less consisting of approximately 3,656 square feet
and is zoaed R-3.
Northwestern Bell Telephone Company has serial telephone facilities in
the proposed vacation area and requests that their interest be protected.
Northern States Power Company has poles with overhead conductors in the
proposed vacation area and they request that their interest be protected.
The Department of Public Works has no objection to the proposed alley
vacation.
There were no objections from any other public or private agencies in-
volved. In view of the foregoing, I recommend the alley vacation be approved,
subject to the following terms and conditions:
1. That the description of the alley to be vacated reads as follows:
"All of the East-West alley as platted in Block 6, Lexington Park
Platt Eleven"
1 x That the vacation be subject to all the terms and conditions of
Chapter 130, codified March 1, 1981, of the St. Paul Legislative
Code, as amended, including. the retention of all public utilities
easements.
