The petitioner testified and explained his position. A representative from the District 5 Land Use Committee also appeared in support of the rezoning. At the close of the public hearing, the Committee voted 7 to 0 to approve the rezoning based on the fact that it is adjacent to I-2 zoning and the location is not likely to attract high intensity industrial uses . On November 19, 1982, the Planning Commission upheld the Zoning Committee's recommendation on a vote of 16 to 0. This rezoning is scheduled to be heard by the City Council on December 9, 1982. Petitioner proposes rezoning to I-1 to construct a building in which to store construction vehicles (trucks and bobcats). 2. Wells Street is "split level" at this point, with the westbound lane higher than the eastbound lane. Each lane is marked one-way. Vehicles entering the site would have to enter from the Payne Avenue end of Wells; and vehicles exiting the site would have to turn right toward Arcade. 3. We�ls is classified as a local street in the Street and Highway Plan. 4. The Land Use Plan supports the maintenance of well-defined neighborhoods and the necessity to buffer or eliminate incompatible land uses (p. 10). 5. Currently the railroad tracks provide a clean boundary between the residential uses to the north and the industrial uses to the south. 6. Under current zoning, the site could contain up to 4 two-family structures. However, the site would have to be re-subdivided, and a lot area variance would be necessary. � . 7. Other uses permitted in the I-1 district include: all B-3 uses , trucking facilities , lumber yards , laboratories , public utility buildings, manufacturing, compounding and packaging of chemicals, foundries , metal finishing and plating, and bottling works. H. STAFF ANALYSIS: This site is fairly small . Some of tr�e lots are quite shallow �ecause� o t e curve of the railroad tracks. Because of the size of the parcel , adequate b'uffering of housing from the railroad tracks might be difficult. The proposed use is basically a garage, or storage, for the petitioner's vehicles with a small office. Petitioner states that the office may be expanded in the future. The proposed use does not seem to be unduly intense as it is currently described. One problem with many older areas of the City is the inappropriate and haphazard mixing of industrial and residential uses. The Comprehensive Plan seeks to remedy this condition whenever possible. It would seem inappropriate to provide the , opportunity for another such conflict to be created. Finally, the Department of Public Works has stated that the retaining wall holding up westbound Wells is in poor condition, principally because of drainage problems. If this is the case, the increased traffic created by this use would not help the condition of the wall . In addition, access to the site could be blocked if the wall were to give way. In conclusion, while the specific proposed use would not seem that harmful to the neighborhood, it would muddy an existing and fairly firm land use boundary without providing a clear benefit. Future I-1 uses that might later locate at the site could also create significant problems for neiqhboring residents. I. Mr. Biagini discussed his plans with the committee and residents of Wells Street and responded to questions. He presented a picture and a written description of his proposed building and plans for the -� use of the property. Comments and sentiments were mixed from residents. Scime felt the proposal was a reasonable use of th s � property, while others were concerned about truck traffic on such a: narrow street as well as the future consequences or impacts Q on their property when rezoning land to Industrial in the middle of a residential area. The Land 'Use/Zoning Committee approved the rezoning request because they felt Mr. Biagini' s plans would be compatible with nthe neighborhood.
