Re: All Licenses held by White Lily, Inc, d/b/a White Lily Restaurant, for the premises at 758
Grand Avenue in St. Paul
License ID No.:0083595
Dear Sir/Madam:
The Office of License, Inspections and Environmental Protection (LTEP) has
recommended adverse action aainst the licenses held by White Lily, Inc. d/b/a White Lily
Restaurant at the above location. This recommendation is based on the following information:
On March 20, 2000 an 18-year old female entered the premises
of White Lily Restaurant at 758 Grand Avenue as part of a
compliance check. The young woman was able to purchase
beer without being asked for any proof of age. Sale of alcohol
to an underage person is a violation of Minn. Stat. §340A.503,
subd. 2(1) and Saint Paul Legislative Code §409.08, subd. (2)a.
Since this is considered a first violation, the licensing office will recommend a$500.00 fine,
pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
If you do not dispute the above facts and do not vish to have a public hearing, you wll
need to pay the recommended fine for this violation. If this is your choice, you should
make payment direcfly to the Office of License, Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the heazing to which you aze entitled.

2. Altematively, if you do not dispute the above facts, but wish to have a public hearing
before the Saint Paul City Council, you will nezd to send me a letter vith a statement
admittin the violation and requestin a hearin by Thursday, Apr3127, 2000. The matter
will then be scheduled before the City Council for a public hearing to determine what
penalty, if any, to impose. You will have an opportunity to appeaz before the Council and
make a statement on your own behaif as to the penalty to be imposed.
If you do dispute the above facts, a hearing vill be scheduled before an Administrative
Law Judge. At that heazing both you and the City will be able to appear and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Thursday,
April 27, 2000, how you wish to proceed.
If you have not contacted me by Thursday, Apri127, 2000, I will assume that you are not
contesting the facts and vili schedule this matter for the St. Paul City Council and have it
placed on the Consent Agenda during which no public discussion is allowed and the
recommended penalty will be imposed.
Tf you have any questions, feel free to contact me at 266-8710.
Sincerely,

Sincerely,

T( checker h2d no form of identification to snow.
On this date at 1600 hours the checker was sent into the White Lily Res:aurant at 758 Grand Ave.
The checker was seated ai a table. The checker ordered a MGD beer. The checker was served a
bottle of MGD ber by a waiter who was later identified as DAVIS, Jesse Colin (DOB 1 -2-77, of 353

restaurant and saw the checker sitting alone at a tabie with an opened bottie of MGD beer in front of
her. Tfie checker pointed to the waiter who had served her the beer. We idetified ourselves to
DAVIS and we told him about the violation. DAVIS toid us that he was "in charge" and that the
manager LANG, Ghu was not on the premises. We told DAVIS that a report of the violation would be
forwarded to LIEP and that possible criminal charges would be forthcoming.
DAVIS and the bottle of MGD were photographed together. The MGD beer was leit at the restaurant.

Sincerely,

took the checkes pefsonal property and gave her buy money. The checker was trined on how to
conducY the checks_ The checker was trained that she couid not lie about her age or date of birth.
T( checker h2d no form of identification to snow.
On this date at 1600 hours the checker was sent into the White Lily Res:aurant at 758 Grand Ave.
The checker was seated ai a table. The checker ordered a MGD beer. The checker was served a
bottle of MGD ber by a waiter who was later identified as DAVIS, Jesse Colin (DOB 1 -2-77, of 353
ColfaxAv. N. Mpts, MN 55411 (N}612-52'1-2581 (U185'1-293-9'124).
Sgt Ramstad and I were monitoring the checicer by a microphone and transmitting device thaf the
checker was wearing. The checker gave the signal that she had been served beer. We entered the
restaurant and saw the checker sitting alone at a tabie with an opened bottie of MGD beer in front of
