This recommendation is based on the following information: On March 20, 2000 an 18-year old female entered the premises of White Lily Restaurant at 758 Grand Avenue as part of a compliance check. The young woman was able to purchase beer without being asked for any proof of age. Sale of alcohol to an underage person is a violation of Minn. Stat. §340A.503, subd. 2(1) and Saint Paul Legislative Code §409.08, subd. (2)a. Since this is considered a first violation, the licensing office will recommend a$500.00 fine, pursuant to St. Paul Legislative Code §409.26. At this time you have three options on how to proceed: If you do not dispute the above facts and do not �vish to have a public hearing, you w�ll need to pay the recommended fine for this violation. If this is your choice, you should make payment direcfly to the Office of License, Inspections and Environmental Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul, Minnesota 55102. The letter should be directed to Ms. Christine Rozek. NARRATIVE On 03-30-00 Squad 795 (F. Reilly) and Squad 791 (Sgt. Ramstad) were conducting liquor compliance checks of licensed liquor establishments in the city of St. Paui. We used an under aged checker. We verified that the checicer was under the age of 21. We used checker #45 (DOB 07-19-8�). On this date at 1600 hours the checker was sent into the White Lily Res:aurant at 758 Grand Ave. The checker was seated ai a table. The checker ordered a MGD beer. The checker was served a bottle of MGD be�r by a waiter who was later identified as DAVIS, Jesse Colin (DOB 1 �-2�-77, of 353� ColfaxAv. N. Mpts, MN 55411 (N}612-52'1-2581 (U1�85'1-293-9'124). Sgt Ramstad and I were monitoring the checicer by a microphone and transmitting device thaf the checker was wearing. The checker gave the signal that she had been served beer. We entered the restaurant and saw the checker sitting alone at a tabie with an opened bottie of MGD beer in front of her. Tfie checker pointed to the waiter who had served her the beer. We ide�tified ourselves to DAVIS and we told him about the violation. DAVIS toid us that he was "in charge" and that the manager LANG, Ghu was not on the premises. We told DAVIS that a report of the violation would be forwarded to LIEP and that possible criminal charges would be forthcoming. DAVIS and the bottle of MGD were photographed together. The MGD beer was leit at the restaurant. The checker was served a bottle of MGD be�r by a waiter who was later identified as DAVIS, Jesse Colin (DOB 1 �-2�-77, of 353� ColfaxAv. N. Mpts, MN 55411 (N}612-52'1-2581 (U1�85'1-293-9'124). Sgt Ramstad and I were monitoring the checicer by a microphone and transmitting device thaf the checker was wearing. The checker gave the signal that she had been served beer. We entered the restaurant and saw the checker sitting alone at a tabie with an opened bottie of MGD beer in front of her. Tfie checker pointed to the waiter who had served her the beer. We ide�tified ourselves to DAVIS and we told him about the violation. DAVIS toid us that he was "in charge" and that the manager LANG, Ghu was not on the premises. We told DAVIS that a report of the violation would be forwarded to LIEP and that possible criminal charges would be forthcoming. DAVIS and the bottle of MGD were photographed together. The MGD beer was leit at the restaurant. This recommendation is based on the following information: On March 20, 2000 an 18-year old female entered the premises of White Lily Restaurant at 758 Grand Avenue as part of a compliance check. The young woman was able to purchase beer without being asked for any proof of age. Sale of alcohol to an underage person is a violation of Minn. Stat. §340A.503, subd. 2(1) and Saint Paul Legislative Code §409.08, subd. (2)a. Since this is considered a first violation, the licensing office will recommend a$500.00 fine, pursuant to St. Paul Legislative Code §409.26. At this time you have three options on how to proceed: If you do not dispute the above facts and do not �vish to have a public hearing, you w�ll need to pay the recommended fine for this violation. NARRATIVE On 03-30-00 Squad 795 (F. Reilly) and Squad 791 (Sgt. Ramstad) were conducting liquor compliance checks of licensed liquor establishments in the city of St. Paui. We used an under aged checker. We verified that the checicer was under the age of 21. We used checker #45 (DOB 07-19-8�). On this date at 1600 hours the checker was sent into the White Lily Res:aurant at 758 Grand Ave. The checker was seated ai a table. The checker ordered a MGD beer. The checker was served a bottle of MGD be�r by a waiter who was later identified as DAVIS, Jesse Colin (DOB 1 �-2�-77, of 353� ColfaxAv. N. Mpts, MN 55411 (N}612-52'1-2581 (U1�85'1-293-9'124). Sgt Ramstad and I were monitoring the checicer by a microphone and transmitting device thaf the checker was wearing. The checker gave the signal that she had been served beer. We entered the restaurant and saw the checker sitting alone at a tabie with an opened bottie of MGD beer in front of her. Tfie checker pointed to the waiter who had served her the beer. We ide�tified ourselves to DAVIS and we told him about the violation. DAVIS toid us that he was "in charge" and that the manager LANG, Ghu was not on the premises. We told DAVIS that a report of the violation would be forwarded to LIEP and that possible criminal charges would be forthcoming. DAVIS and the bottle of MGD were photographed together. The MGD beer was leit at the restaurant.
