WHEREAS, Pursuant to P�Iinnesota Statutes §462. 357 and §64. 210
of the Legislative Code, Leo Gadbois duly petitioned to rezone
Lot 30, Block 9, Holcombe' s Addition, located on the northwest
corner of Ashland and Dale, from RM-2 to P-1 for the purpose of
constructing a parking lot, the petition having been certified
by the Department of Finance and Management Services on July 12,
1982 as having been consented to by at least 67% of the owners of
the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property
situated within 100 feet of the total contiguous descriptions of
real estate held by the same owner or any party purchasing any such
contiguous property within one year preceding the date of the
petition; and
rr�HEREAS, The current Zoning Committee on August 5, 1982 and
on October 7 , 1982 conducted public hearings for the purpose of
considering the rezoning petition, and pursuant to Section 107 .03
of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on October 8, 1982 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

Dear Sir:
The Zoning Committee of the Planning Commission held two public hearings
on this rezoning. The first hearing was held on August 5, 1982. At that
hearing, one letter was received opposing the proposal , and two people
testified in opposition. At the close of the hearing, the Zoning Committee
voted 3 to 0 to deny the rezoning because of the variances that would be
needed to construct the parking lot. After the hearing, staff found that
a revised site plan requiring no variances had been submitted, and on
August 13, the Planning Commission returned the matter to the Zoning
Committee. The rezoning was considered again by the Zoning Committee on
September 2, 1982, at which time the Committee decided to renotify property
owners and hold a second public hearing.
The second hearing was held on October 7, 1982. At that hearing, two
letters were received in support of the rezoning. There was no opposition.
The Zoning Committee voted to approve the rezoning, 7 to 0.
On October 8 the Planning Commission considered the Zoning Committee's
recommendation and approved the rezoning by a vote of 18 to 0.

G. FINDINGS:
1 . Parcels may be rezoned to P-1 Vehicular Parking District, provided the site meets the
intent and the eight required conditions of the district.
2. The intent of the district is to serve areas that have developed without adequate
parking by permitting off-street parking lots. These parking lots are to be used
� solely for parking of private passenger vehicles. The petitioner is proposing an
off-street parking lot for private passenger vehicles in an area that has very
little off-street parking, meeting the intent of the district.
3. The proposed P-1 district is accessory to a business, Sweeny's Saloon, meeting the
first condition.
4. The principal use, Sweeney's, is open from 11 :00 a.m. to 1 :00 a.m. The petitioner
has stated that the parking lot will be used only during these hours , meeting the
second condition.
5. The parking lot will be used by customers and will not be used for off-street
loading, meeting the third condition.
6. There will be no repair work or sales on the lot, meeting condition four.
7. The petitioner Mas stated that he will not erect signs on the lot, and his plans
show that there will be no buildings, meeting the fifth and sixth conditions.
8. The petitioner has submitted a site plan for the lot, and it is going through
site plan review, so the last two conditions are met.
9. Land Use Plan policy 4.2-7 recommends that the City encourage businesses ta reduce
traffic and parking problems.
10. The District 8 Housing Development Plan's recommendation f� this site is parking
for Sweeney`s.
H. STAFF RECOMP�1ENDATION: Based on findings 1 through lU, staff recommends approval of the
rezoning of 621 Ashland to P-1 .

' and Pangal of the Zoning Committee; Mr. Segal , Assistant City
Attorney; Ms. Lane of the Division of Housing & Building Code
Enforcement; Ms. Beseman, Mr. Ford, Ms. James, and Ms. McNeally
of the Planning Division Staff.

The meeting was chaired by James Bryan, Chairman.
LEO GADBOIS (#9099) : Rezone from RM-2 to P-1 to provide parking� for Sweeney's
Saloon at 621 Ashland Avenue.
This matter was laid over from September 2, 1982, to allow time for property
owners within 350' of the site to be renotified.
Two letters were received in support of the rezoning.
Leo Gadbois , owner of Sweeney's Saloon, stated that over the past 3 years
through a lot of effort and capital expenditures, he has turned the building
into a viable bar and restaurant. Sweeney's is completely renovated on
2 floors , seats 300 people, employs between 25 to 35 full and part-time people,
and has only 10 off-street parking spaces. On their busy nights when the
bar is running at near capacity, all on-street parking is taken up and there
is a lot of congestion on the streets. The proposed parking would double
their off-street parking and help alleviate some of the existing parking
problems. With the activity in the area, the aspect of crime and safety
should also be considered. As far as property values, it would be more
detrimental without the parking lot because it would be completely uncontrolled.
He stated that the lot was advertised for residential a number of times by the
flousina & Redevelopment Authority and no one was interested in developing it.
They have been working on rezoning the property for about 2 years , District 8
is in support of their proposal , and the adjacent property owners do not
oppose the parking lot. .
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
Mr. Lanegran moved approval based on findings 1 through 10 of the staff report.
Mr. Levy seconded the motion, which passed on a roll call vote of 7 to 0.

The applicant was present. There was opposition present at the hearing.
Ms. James reported that on August 5, 1982, the Zoning Committee voted to
deny the petition based on the inadequacy of the lot and the number of
variances that would be required. After that meeting, staff discovered that
the applicant had submitted a revised site plan for the parking lot which
did not require any variances. The Comprehensive Land Use Plan and the
District 8 Plan appear to support the rezoning. The District 8 Housing
Development Plan recommendation for the site is parking for Sweeney's.
Staff recommends approval of the rezoning.

There was discussion regarding laying the matter over.
Mr. Soderholm commented that notices were sent out to people who had testified
at the previous meeting informing them that the matter would be reconsidered
on September 2.
John McLaughlin, 633 Holly, stated that he did not receive written notice of
the hearing and if the Committee were going to reconsider the matter,
property owners within 350' should be renotified. He expressed opposition
stating that a 10-car parking lot would not help the existing parking
problems and felt the property should be used for residential .
Leo Gadbois, owner of Sweeney's Saloon, stated that to his knowledge the
neighbors that were present at the zoning meeting on August 5 were .present
at the District 8 meeting last night when the matter was discussed. He stated
that Sweeney's does have a serious parking problem in that it seats nearly
400 people and currently has parking for 10 cars. He felt that any move
that would help to alleviate the problem would be beneficial , and requested
that the matter not be laid over.
Mr. McLaughlin reported that he has not seen the revised site plan and
� a requested a continuance of the hearing.

IN CITY COUNCIL CHAMBERS, ST. PAUL, MINNESOTA ON AUGUST 5, 1982
PRESENT: Mmes. Karns and Surimers; Messr. Pangal of the Zoning Committee;
Mr. Segal , Assistant City Attorney; Ms. Lane of the Division of

The meeting was chaired by Joseph Pangal , Vice-Chairman.
LEO GADBOIS (#9099) : Rezone to provide parking for Sweeney's Saloon at
621 Ashland Avenue.
The applicant was present. There was opposition present at the hearing.
Ms. James showed slides of the site and reviewed the staff report with a
recommendation for approval . One letter was received in opposition.
Carol Mottaz, representing the applicant, was present to answer any questions.
Debra Ellis, 629 Ashland, spoke in opposition stating that the proposed parking
lot would be a threat to the safety of children in the neighbarhood because
the entry to the lot will be through the alley. Bordering on the alley is an
apartment building housing several children. A 10-car parking lot would not
help the overall parking problerr�and could set a precedent on the adjacent
property. She questioned the location of the parking lot because it would be
on an obscured intersection and expressed concern with the upkeep of the
property.
Richard Rhode, 630 Ashland, stated his opposition. The character of the block
is essentially residential ; there are no other businesses on the block. Four
new condominiums were built in the neighborhood which indicates there is
interest in the housing market. He felt that adding a 10-car lot would not
help the parking problem in the area.
John McLaughlin, 633 Holly testified in opposition stating that a 10-car parkin�
lot would not change the existing parking problems.
Ms. Mottaz, 676 Ashland, remarked that as far as the safety of the children is
concerned, 90% of their business is after 9:00 p.m. She also stated that a
10-car parking lot would help the parking situation because it would double
their off-street parking.
There was discussion regarding the entrance and exit to the proposed lot.
Mr. McLaughlin stated his objection to the entrance on Ashland.
Hearing no further testimony, Mr. Pangal closed the public hearing portion of
the meeting.
`' '�' Mr. Segal reported the code requires that entrances and exits cannot be less
than 25 feet from adjoining residential property.

Ms. Lane stated that in the Schedule of Regulations there are yard requirements
that are not met by the proposed site plan. The applicant would have to
modify the site plan or obtain variances.
Ms. Summers made a motion to recommend denial of the rezoning based on the
inadequacy of the lot and the number of variances that would be required.
Ms. Karns seconded the motion. The motion passed on a roll call vote of
3 to 0. The Committee also directed staff to review the Comprehensive Plan
relative to the land use and the District 8 Plan as to the recommended use of
the property.

On August 5, 1982, the Zoning Committee voted to deny the petition of
Leo Gadbois to rezone property from RM-2 to P-l . The denial of the petition
was based on the number of variances that would be required. Staff was also
directed to review the Comprehensive Plan regarding land use and the
District 8 Plan.
After the meeting, I discovered that Mr. Gadbois had submitted a revised site
plan on July 17, 1982, which meets all of the conditions required for off-
street parking facilities. He now needs no variances.
The Comprehensive Land Use Plan and the District 8 Plan also appear to be
supportive. Land Use Plan Policy 4.2-7 recommends that the City encourage
businesses to reduce traffic and parking problems. The District 8 Plan
suggests that the possibility of using vacant publicly owned land for
off-street parking be studied. The District 8 Housing Development Plan
recommendation for this site is parking for Sweeney's.
For these reasons , it is being recommended that the petition be referred back
to the Zoning Committee for further consideration.

On August 5, 1982, you attended a meeting of the Zoning Committee and
testified against the proposed rezoning. The Committee voted to deny
the petition to rezone, based largely on the need for variances for the
proposed parking lot.
After the meeting, I learned that Mr. Gadbois had submitted a revised
site plan that requires no variances. The matter was therefore referred
back to the Zoning Committee and will be discussed again on September 2,
19II2. This will not be a public hearing, but it is a public meeting so
you may attend if you wish. No further testimony will be taken, however.

I live on the NE corner of Ashland and Dale. :vty home has
two addresses, 617 Ashland and 104 N Dale.
I have no objections to any off-street parking £or Sweeney's
Saloon.
As � matter of fact, I'm s�e any other off-street pa.rking
would be beneficial to the nei�hborhood. I�m certain ar�y
off-street parking by Sweeney's would be very well lighted.
Also, patroled if necessary.
I'm wondering if "Pudges" problems Nould be solved if he
(Pudges) had off-street parking, lighting and patroling.
