Stephenson t• �� Assistant City Attorney��:J—' DATE: October 28 , 1982 RE: Edna Gordon v. City of St. Paul T'his case involves allegations by plaintiff that she tripped and fell and incurred damages and sustained permanent irijuries � on the corner of Bayard and Cretin on April 9, 1980. She identified the location as being on the northeast corner of that intersection and claimed that there was a depression there which she stumbled in or near after stepping up on the curb. The plaintiff 's doctors opined that she had sustained permanent injury and which manifested itself with the following symptoms : headaches, dizziness , vertigo and spots appearing before her eyes. The doctor which the City had examine this lady did not agree with these findings. This office approves settlement of this lawsuit for the amount of $3,000 which takes into account the fact that the plaintiff 's medical bills were in the neighborhood of $3,300, that she claimed other expenses related to this incident and the fact that if the jury would find the City responsible for her dama.ges, that the award would be much greater.
