October 19th, 1982. d������ ��+ (Discussion continued from the previous page) Councilman Tedesco suggested that the matter be set for public hearing and Ms. McPeake explained that all persons must be treated the same and all operators would be affected. After further discussion it was agreed that Mr. Carchedi should set up the necessary public hearing and provide proper notification. Public Hearing on the application for the transfer of the On Sale Liquor License (inactive) from Geae Nardini Li.quor, Inc. at 828 E. Seventh Street, to Eugene J. Nardini as inactive. (Eugene J. Nardini notified to attend). Mr. Carchedi said he recommends approval of the application with the stipulation that when the license is made active or transferred that outstanding bills be paid. Mr. Daubney, attorney representing Mr. Nardini, said he sent a letter to Mr. Carchedi concerning payment of bills and he referred specifically to a letter from attorney Rutzick representing an insurance agency who claims a judgment in a greater amount then they admit to and he said they will pay delinquent fees and request transfer of the license and from the proceeds will prorate obligations to the extent possible. Mr. Rutzick appeared and said he has no problem in lieu of the memorandum from the insurance company showing a breakdown of the bills involved. After further discussion Councilman Nicosia moved approval of the application. Adopted. Yeas - 7 Nays - 0 Petition of Robert and Dianne Walsh, et al, for the vacation of the east-west alley in Block 6, Lexington Park Platt Eleven. (Public Works Committee reco�nends that hearing be continued to November 9th, 1982) . Councilman Nicosia moved that the matter be continued to November 9th, 1982. Adopted. Yeas - 7 Nays - 0 . Hearing on the appeal of Jeanette Johnson to an order of the Housing Code Division for property at 88 E. Belvidere. (Recommended for denial by the City Development and Transportation Committee) . Jeanette Johnson appeared and said they have a court date scheduled and at that time the yard will be cleaned up and she said they need a couple of months and the problems will be solved. ' Councilman Scheibel said there is no question that there is a violation and the building inspectors want the yard cleaned up and Ms. Johnson said she reaTizes that there are violations but everything will be taken care of when construction starts. Councilman Nicosia said he doesn't see the connection between construction and clean up and Ms. Johnson explained that the work would have to be done again during construction. Councilman Fletcher said the matter was heard in committee and considerable testimony was received and he feels the appeal should be denied. Councilman Scheibel said he has viewed the area and he understands that they have been in the court process for two years and there is a person in the neighborhood who complains often concerning this property. He said the court date is November 4th but there is a violation and it is diff icult to say nothing should be done. At the question of Councilman Fletcher, Ms. Johnson said it would take a couple of hours to clean up the property. . After further discussion Councilman Fletcher moved that the appeal be denied and that the property be cleaned up by November llth, 1982. Adopted. Yeas - 7 Nays - 0 C.F. No. 279283. FINAL ADOPTION. An ordinance amending Chapter 60 of the Legislative Code and rezoning property located on the southeast corner of Ruth St. and Burns Avenue, aka parts as listed of Battle Creek Heights Plat 3, Park Homes Addition and Pathways Addition.
