THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 That Sections 189. 10 and 189. 12 of the Saint Paul Legislative Code p�rtaining to Truth-in-Sale of Housing are hereby amended. Section 2 That Section 189.10 of the Saint Paul Legislative Code be and the same if hereby amended as follows: 189• 10 Fee for certificates and renewals. The holder of a certificate of competency shall ,upon paym�nt of a renewal fee of $58 $60 annually, have said certificate renewed for the ensuing year. A holder of a certificate shall not allow said certificate to be used by another person. (Code 1956, as amended, §54A. 110) . Section 3 That Section 18q. 12 of the Saint Paul Legislative Code be amended as fol lot�s: 189.12 Report, filing and filing fees. Each truth in housing evaluator shall prepare a diselosure report which shall set forth any major structural defect or immediate hazards to health and safety. The report shall be either type�ritten or legi.bly printed in ink. In the event the evaluation is of a condominium unit , a copy of the report shall elso be submitted to the Condominium Association within the te�=day time period mentioned above. A filing fee of �en-Bo}}arz-{$}6.-ee} Twelve Dollars ($12.00) made payable to the City of St. Paut shall be required with each evaluation report so submitted to the Secretary- Treasurer of the Examining Board. Any evaluator who fails to submit the disc.losure report within 10 days of the evaluation date, or the re-evaluation date in the event of a re-evaluation, shall be assessed a late penalty fee of $10.00. ln addition to the above penalty fee and any other penalties provi.ded in this Chapter, the failure to pay the required filing fees or the failure to timely file any disclosure report shall be sufficient cause for the Examining Board to suspend and/or revoke the Certificate of Competency of a Truth in Housing evaluator. Truth in Housing evaluators may charge a reasonable fee of the property owner or prospective seller for services hereunder. Each person desiring a certificate of competency such as herein provided shall .fi.le with the examinln� board at least three days prior to the date of examination, an application to take the required examination and shall pay the non=refundable sum of $25 as an examination fee. Such application shall contain information relative to name, address, place of employment, time and place of schools attended and studies completed, together with a chronological record of candi- date's employment, with complete information relative to duties and type of work performed. This application shall be deemed public and available to any person upon request, and if copies thereof are requested, upon the payment of a reasonable fee therefor. (Code 1956, as amended, 54A.80. ) -� 189.09. Insurance. No Certificate of Competency shall be issued or renewed without satisfac- tory proof of insurance insuring the applicant in the sum of at least Two Hundred and Fifty Thousand t)o]lars($250,000.00) aggregate per evaluation against: (a) liabiiity im- posed by law on account of damages or destruction of property; and (b� against any liabilit, imposed by law on account of damages or destruction of property or bodily injury or death � of one or more persons in any one accident, due to errors or omissions or the negligence in the inspection or completion of the truth in Housing Disclosure Report defined in Sectio 189.01, and such applicant's or evalutor's insurance shall remain in force continuously thereafter and no Certificate of Competency shall be deemed to be in effect during any per- iod of �time when such insurance and proof thereof are not also in effect. The City shall be included as a named insured on the insurance required hereunder at the expence of the evaluator. (Code 1956, as amended, 54A.90.) 189.10. The failure of any owner or agent of an owner to comply with the provisions of this chapter sha11 be a misdemeanor. (Code 1956, as amended, 54A.130. ) 198.14. Review. The current fees were established in May of 1979 and were based upon projected income and costs. Because the program was just starting, there wasn't an established program to determine the actual income and costs. Since 1979 the actual number of inspections reported have declined slightly each year and the actual costs have increased.
