An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul
and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462 . 357 and �64 .210
of the Legislative Code, DeGidio, Inc. duly petitioned to rezone
the south 80 feet of Lot 8, the south 80 feet of the west 2.5 feet
of Lot 9, Block 4-, Leech' s Addition, and the north 33 feet of
adjacent vacated McBoal Street, located on Douglas between Forbes
and West Seventh Street from RT-2 to B-2 , to permit parking or
bocce ball courts, the petition having been certified by the
Department of Finance and Management Services on August 6, 1982
as having been consented to by at least 67� of the owners of the
area of the property to be rezoned, and further having been con-
sented to by at least two-thirds of the owners of the property
situated within 100 feet of the total contiguous descriptions of
real estate held by the same owner or any party purchasing any
such contiguous property within one year preceding the date of
the petition; and
WHEREAS, The current Zoning Committee on September 2 , 1982
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107. 03 of the Admini-
strative Code, submitted its recommendation to the Planning Cam-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on September 10, 1982 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezaning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having
been conducted on October 7, 1982 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 28,
as incorporated by reference in Section 60. 301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on Douglas Street between
Forbes and West Seventh, being more particularly
described as the south 80 feet of Lot 8, the south
80 feet of the west 2 .5 feet of Lot 9, Block 4,
Leech' s Addition, and the north 33 feet of adjacent
vacated McBoal Street, be and is hereby rezoned from
RT-2 to B-2 .
Section 2 .
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
On September 2, 1982, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. A representative of the petitioner was
present to answer questions. There was no testimony. At the close of the
public hearing the Zoning Committee voted 4 to 0 to recommend approval of
the rezoning.
The Planning Commission considered this petition and the Zoning Committee's
recommendation on September 10, 1982, and voted to approve the rezoning,
11 to 0.
This rezoning is scheduled to be heard by the City Council on October 7, 1982.
Please notify me by October 6 if any member of the City Council wishes to
have slides of the site presented at the public hearing.

C. PARCEL SIZE: 113' (Douglas Street) x 54.34' = 6,140.42 square feet.
D. EXISTING LAND USE: Vacant parcel with bocce ball courts.
E. SURROUNDING LAND USE:
North: Townhouse, medium density residential (RT-2)
East: DeGidio's, commercial (B-2)
South: Commercial , medium density residential (B-2, RT-2)
West: Duplex and medium density residential (RT-2)
F. ZONING HISTORY: The site was zoned light industry prior to 1975, when it was rezoned
RT-2. On July 20, 1981 , the Zoning Administrator sent the" applicant a letter enumerating
several zoning violations concerning the adjacent parking lot as well as the locating .
of bocce ball courts accessory to a business in a residential zoning district.
On May 24, 1982, the Zoning Administrator notified the applicant that his failure to
' meet conditions of approved site plans would result in an ordinance violation ticket.
On June 24, 1982, the Division of Housing and Building Code Enforcement came to an
understanding with the applicant that variances would be requested for the existing
parking lot and that a rezoning petition would be submitted for the bocce ball courts.
G. FINDINGS:
1 . Submission of this petition is part of an agreement with the Zoning Administrator
to rectify zoning violations .
2. The bocce ball courts would not be permitted as an accessory use in the RT-2 district
in this case because they are accessory to a commercial , not a residential use.
3. Land Use Plan policy 4.2-2 recommends that the City modify current land use
regulatory provisions to permit appropriate flexibility in the reuse of land along
existing commercial strips.
4. Because of the parcel ' s small area and shallowness, it would be difficult to develop
at RT-2 density. A total of 5 rooms or two units would be permitted. A commercial
. reuse of this land would therefore seem appropriate. .
H. STAFF RECOMMENDATION: Based on findings 1 through 4, staff recommends approval of .
the petition to rezone this prope��ty from RT-2 ta B•-2 fer use as bocce ball courts
or parking.
