BE IT RESOLVED, That the Council of the City of Saint Paul hereby
certifies and approves the action of the City of Saint Paul Board of
Appeals and Review pertaining to the following listed property and as shown
by the Excerpted Minutes of said Board of Appeals and Review, dated
September 14, 1982, and marked EXHIBIT A, and attached hereto and made a
part hereof by reference:

SUBJECT: Request variance of Section 33. 07, pertaining to fence heights ,
to permit installation of fence 7 ft. , 6 in. in height , because appellant
wants to create greater privacy.
APPEARANCE : Richard A. Smith
PROCEEDINGS• Mr. Smith explained that he wanted to put up a decorative
e�nce t�at would vary in height from 62 ft. to 7� ft. in height. In
addition, he asked for an additional six-inch grade allowance because
of sloping ground. The fence would enclose the rear yard and extend
along the side of the house on the property line as far as the �ront of
the house. There was a particular problem with privacy for the bedroom
areas of his home and the neighbors ' bedroom areas . He proposed to use
- redwood in an attractive design. He exhibited a statement signed by
the owners of adjacent homes indi�cating that they did not object to the
fence.
BOARD ACTION : Mr. Tilton moved that a variance of Section 33. 07 be
grante to permit construction of a fence 7 ft. . 6 in. in height , and
allowing an additional six-incl�s fro� grade � level under tfie fence , to
enclose appellant's back year, on condition that it does not extend
beyond the front line of the house and that it be constructed of redwood.
Mrs . Collins seconded. MOTION CARRIED AND SO ORDERED. � .
THE VOTE : Ayes - 4 Nays - 0 Abstentions - 0
After Mr. Smith left the meeting, Jerry Kern voiced his objection to
the board' s granting a variance on this type of matter without more proof
that the neighbors did not object than a statement purportedly signed
by them. In this case , he noted that one neight�or, Walter Nordstrom,
had been present at the meeting and had stated that he did not object,
but he said a simple piece of paper which the appellant claimed had been
signed by his neighbors could easily be frauduler►t. Mr. Kern requested
that the board obtain a copy of the signed statement to be placed in
the file on the case .

Chairman Glassman called the meeting to order at 1 : 40 p .m.
The minutes of the meeting of August 10 , 1982 , were approved as distributed
to the members .
Chairman Glassman reported that Case 50- 82-H, 491 Stryker, Appellant Mrs .
Floyd M. Johnson, would be rescheduled for the October 12 meeting, a-� the
rec{uest of the appellant , unless there was any objection. Mrs . Johnson
had written that she would be heavily involved with the start of the
school year in her duties as a teacher, and had a special assigr�ment on
today' s meeting date. Board members approved the requested postponement.
