V�HEREAS, Richard Sagstetter applied to the Board of Zoning
Appeals for a variance from the strict application of the provisions
of Section 61.101 (b) of the Saint Paul Legislative Code pertaining
to the required front yard setback in an RM-2 zoning district for
property located on the southwest corner of Como Avenue and Jessamine,
being legally described as Lot l, Block l, Royal Oaks Addition to
the City of St. Paul; and
WHEREAS, Following a public hearing with notice to affected
property owners the Board of Zoning Appeals by its Resolution No.
9201 adopted August 10, 1982 denied the request for variances based
upon the following findings of fact:
(1) That the request for variance could not be granted without
substantial detriment to the community or the intent of the zoning
code. One intent of the zoning code is to provide an adequate
amount of open space and privacy for occupants of the building and
the proposed site plan does not meet this intent of the code.
(2) The building setbacks set forth in the zoning code
influence streetscape and the character of the neighborhood. The
request for variance therefore could not be granted without detri-
ment to the character of the streetscape by reason of the double
frontage and irregular shape of the subject property.
(3) The request for variance cannot be granted without sub-
stantial detriment to the neighbors ' supply of light and air,
health, safety� or property values and granting of the variance
could impair traffic safety;

WHEREAS, Acting pursuant to Sections 64 .205 through 64 .208
and upon notice to appellant and other affected property owners,
a public hearing was duly conducted by the City Council on
September 16, 1982 where all interested parties were given an
opportunity to be heard; and
WHEREAS, The Council having heard the statements made and
having considered the variance application, the report of staff,
the minutes and findings of the Board of Zoning Appeals, does
hereby
RESOLVE, That the Council of the City of Saint Paul does
hereby affirm the decision of the Board of Zoning Appeals in this
matter and does hereby concur in the findings made and determined
by said Board; and, be it
FURTHER RESOLVED, That the appeal of Richard Sagstetter be
and is hereby denied; and, be it
FURTHER RESOLVED, That the City Clerk shall mail a copy of
this resolution to Richard Sagstetter, the Zoning Administrator,
the Planning Commission and the Board of Zoning Appeals.

PURPOSE: To consider an appeal of a Board of Zoning Appeals decision to
deny front yard setback variances for a parcel located at the
southeast corner of Jessamine and Como Avenue (Lot 1 , Block 1 ,
Royal Oaks Addition) .

Dear Sir:
On July 27, 1982, the Board of Zoning Appeals held a public hearinq on the
application of Richard Sagstetter to vary the minimum front yard setback
from 35' required along Como to 23' and from 25' required along Jessamine
to 4' . Granting these variances would allow construction of a single-family
house on an irregular shaped parcel with a double street frontage. The
limited size of the parcel , its irregular shape, and the double street
frontage presented extraordinary site design limitations not adequately
covered in the site plan. Staff recommendation was to layover the matter
to allow the applicant time to discuss the site with the District 6 Planning
Council and amend the site plan. The Board voted to deny the variances
primarily by reason of its findings determining a substantial detriment to
the streetscape and character of the community.
The applicant met with the District 6 Land Use Task Force on June 27, 1982,
and the site plan was approved by that committee. On August 3, 1982 the
District 6 Planning Council discussed the property and discovered
discrepancies in lot size between public records and the applicant's site
plan. It vras determined that the parcel size is approximately 3,850 sq. ft.
rather than 4,125 sq. feet as shown on the applicant's site plan. Based on
the reduced size of the parcel , the District 6 Plannin� Council voted to
oppose the variances.

Richard Sagstetter filed an appeal of the Board of Zoning Appeals decision
on August 18, 1982. Mr. Sagstetter bases his appeal on the similarity
between the requested setback and five con�iguous parcels as well as
noting the added tax base this development would provide.
This matter is scheduled to be heard by the City Council on September 16,
1982. Please notify me by September 15 if any member of the City Council
wishes to have slides of the site presented at the City Council public

The Staff recommended that the site p�an-be revised and submitted
to llistrict 6 Council for approval. The amended plan was submitted
and approved by the Council on July 29, 1982.
The setback for the block is set at 35 feet. Sub�ect lot asks
23 feet. The five contiguous parcels to the East have setbacks of
23, 23, 24, 22, 17 feet respectively. The front and rear setback
variauce of subject property will be no more than adjacent property.
Subject lot has 4125 square feet. See Exhibit B. The house
would cover 16% of lot area, or 650 square feet.
Existing trees would remain and extensive buffering would be
provided by a five foot fence on ,Tessamine street. � See Exhibit B.
The house would be 75 feet from the intersection, causing no
harmful safety factor. r '
The developed lot would generate $1000 in revenue for Government.
Applicant proposes to develop with aid of McKnight financing,
creating jobs and reasonable price housing.

CITY COUNCIL CHAP16ERS, ST. PAUL, MINNESOTA, JULY 27, 1982
PRESENT: Mmes. Morton, Summers ; Messrs . Grais , Kirk, Osborn, Peterson, and
Woods of the Board of Zoning Appeals ; Mr. Segal , Assistant City

The meeting was chaired by Gladys Morton, Chairman.
RICHARD SAGSTETTER (#9201 ) : Variance request to allow construction of a single
family house located on�the southwest corner of Como Avenue and Jessamine.
The applicant was not present. There was opposition present at the hearing.
Mr. Haider showed sl.ides of the site and reviewed the staff report with a
recommendation to lay the matter over to permit the applicant an opportunity
to amend the site plan to include a landscaping proposal . Two letters were '
received in opposition.
James Edman, 126 Maywood Place, spoke in opposition. He stated that Como Avenue
and Jessamine was a dangerous corner and also expressed concern with snow removal
in the winter.
Kathy Zieman, 991 Jameson, requested if the �oard were to consider approving th�
variance, the matter be laid over to allo►v time for the applicant to meet+��th
the District Land Use. Task Force Committee and residents of the area.
Patrick Stanchfield, 785 Como, stated that because of the shape of the parcel
he felt it was ridiculous to consider building anything on the site. He also
expressed concern with safety when backing out from his garage.
Hearing no further testimony, Ms . Morton closed the publ:ic hearing portion of
the meeting.
Mr. Peterson made a motion to deny- the variance request. The variance cannot
be granted without substantial detriment to the community or the intent of the
code and without detriment to the character of the streetscape by reason of
the double frontage and irregular shape of the property. Ms. Summers seconded
the motion. The motion passed on a roll call vote of 7 to 0.

A. PURPOSE: To consider front yard setback variances from Como and Jessamine to allow
construction of a single-family dwelling 23' frpm Como and 4' from Jessamine. Code
requires 35' setback from Como and a 25' setback from Jessamine. ' .
B. PARCEL SIZE & FRONTAGE: The site is a 4,125' irregular shaped parcel_,with 126.21'
frontage on Jessainine and 107' frontage on Como. �
C. SITE & AREA CONDITIONS: The site is vacant and surrounded by mixed residential uses.
One and two family residences are prevalent to the south and west. Multi-family
residences are prevalent to the inunediate north and east.
D. ZONING CODE CITATION: Section 61 . 101 (b) , Schedule of Regulations , requires that
structures be set back from the front property line a distance equal to the average
setback of the block. • In this case, code requires a 35' front yard setback from
Como and a 25' front yard setback from Jessamine.
E. HISTORY: On Flpril 18, 1978, the Board of Zoning Appeals denied a request for variance
of the minimum lot area required by Code for this property.
F. FINDINGS:
1 . The rcquest for variance is bas'�d on the exceptional physical condition of the
property. The site is irregular in shape, small in total area, and has a double
fror�tage.
2. Strict application of the Code regulations would result in exceptional practical
difficulty as distinguished from mere inconvenience by reason of the existing
conditions of the property. A single-family house cannot be built without variance.
3. Sectior� 62. 102 Subd. 2, Nonconforming Lots, indicates that a single-family dwelling
may be erected on any single lot of record even though such lot fails to meet
the requii�ements for area or width. This site is a single lot of record and a
substandard lot.
4. The applicant has expressed an interest in amending the site plan by (1 ) providing
an attached single car garage, and (2) providing intensive landscaping to buffer
the building and street.
5. The request for variance can be granted without substantial detriment to the
coriiinur�ity or the intent of ti�e Code only if conditions are attached. .

One intent of the Code is to {�rovide an adequate amount of open space and privacy
for uccupar�ts of the building. The proposed site plan does not meet this
inter�t of the Code. The applicant intends to modify the site plan to include
additional landscaping so as to be more in accord with the intent of the Code.
6. The Plan for Streets and Hig�iways component of the Comprehensive Plan of St. Paul
states: "One of the criteria for evaluating a street is the streetscape. The
streetscape includes all the physical elements that affect the way the street
looks and I�ow it functions , and thus includes not only the right-of-way but
facades ofi homes which are near the street." Therefore building setbacks and
public boulevard together make up the streetscape and influence the character
of ti�e site. The property includes a double street frontage that must be taken
into accou��t in the site p1an .

One intent of the Code is to buffer adjacent residential zones. Intensive
landscaping of property boundaries will reduce stormwater, impact, glare and noise,
and be of general benefit to surrounding properties: '
8. The request for variance is not based primarily on a desire for economic gain.

G. STAFF AN�LYSIS: This site is in a high visability area and requires landscaping to
complimerit the streetscape if a sir�gle-family dwelling is to be built. At this time,
the proposed site plan does not provide adequate landscaping to meet the intent of
the Code. The applicant has expressed a desire to amend the site plan and increase
landscaping.
H. STAFF RECOMMENDATION: Based on findings 1 through 8, and the staff analysis , staff
recommends this matter be laid over to permit the applicant an opportunity to amend
the site plan to include a landscaping proposal .
