1 WHEREAS, Citizen Service Office, Division of Code Enforcement has requested the City
2 Council to hold public hearings to consider the advisability and necessity of ordering the repau or
3 wrecking and removal of a one-story, concrete block, wood frame structure with an attached gazage and
4 auto repair bays located on properry hereinafter referred to as the "Subject Properiy" and commonly

WIlEREAS, based upon the records in the Ramsey County Recorder's Office and 'uiformation
obtained by Division of Code Enforcement on or before November 10, 1999, the following are the now
known interested or responsible parties for the Subject Property:Jerry L. Anderson; 352 Carl Street;

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated January 4, 2000; and

and the testimony and evidence including the action taken by the Legislative Hearing Officer was
considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order
conceming the Subject Property at 62 Winifred Street West:
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

of Code Enforcement, Vacant/Nuisance Buildings.

48 the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
49 codes and ordinances, or in the aiternative by demolishing and removing the shucture in

51 removal of the shucture must be completed within fifteen (15) days after the date of the Council

In the event the building is to be demolished and removed by the CiTy of Saint Paul, all personal
property or fixtures of any kind which interfere with the demolition and removal shall be
removed from the property by the responsible parties by the end of this time period. If all
pexsonal property is not removed, it sball be considexed to be abandoned and the City of Saint
Paul shall remove and dispose of such property as provided by law.
It is fiu•ther ardered, that a copy of this resolution be mailed to the owners and interested parties
in accordance with Chapter 45 of the Saint Paul Legislative Code.

Tom Lipschultz, 631 Mt. C�rve Boulevard, appeazed and stated his parents are one of the
building owners. The building has been vacant since December 1998. Last summer, the
neighborhood accumulated a lot of trash. It was not coming from his building because it was
vacant. Mr. Lipschultz does not think he should have to pay for mattresses and other items that
aze being dumped on his properiy. Before he went out of town, he picked up his mail from his
post office box. Upon his return, two or three notices were received. He did not haue a chance
to do anything about the problem.
Mr. Strathman asked did Mr. Lipschultz want to view the videotape. Mr. Lipschultz responded
no because he knows it was cleaned up.
Mr. Strathman stated there aze two issues: was notice given as required by law and did the City
do the cleanup. Mr. Lipschultz is not azguing the point that either one was not done, stated Mr.
Strathman.
Mr. Lipschultz stated there were two notices and they could not have been more than a week
apart. If a person is out of town, he asked, what is suppose to happen. Mr. Strathman responded
this assessment is not a punishment, fine, or penalty. The City is just recovering the cost it bore
of cleaning up the properry. �

Tom Edholm, owner, appeazed and stated he does not recall getting one of the notices.
Sally Peterson reported notice was sent to Thomas Edholm, 419 View Street, and it was also
posted on site at 541 Superior. The notice was mailed on 1-19-00, and the items were picked up
by the City on 1-31-00. Mr. Edholm responded he did not get the notice, but that does not mean
it did not arrive.

Mr. S�athman added that the papenvork indicates the inspector called Tom, but there was no
answer and no answering machine.
The tenants informed him they did not throw anything out, stated Mr. Edhoim. Across the alley,
townhouses were recenfly rented, and the people moving in were disposing of their junk.
(The videotape was shown at the request of Mr. Edholm.)
Mr. Strathman stated the items look like they were from the tenant and not from across the alley.
Mr. Edholm stated there was not more than three bags and that isn't worth $300. Mr. Strathman
responded more than three bags were seen on the videotape, and there is no question that it could
be done for a cheaper amount.

Raquel Cordero appeared and stated she received a notice to board the windows, and she boazded
them. She has a contract for deed with Bric Weisman who went into the house, took down the
boards, and opened up the windows. She sent a letter to her attorney who contacted Mr.

Weisman and informed him that Ms. Cordero had boazded up the windows. Mr. Weisman said
he would redo the work. He put the boards up but did not cover the entire windows.
Sally Peterson reported this is a vacant building. Qrders were mailed to Ms. Cordero and Eric
Weisman on 12-30-99, posted on the site on 12-29-99, and the City boazded the building on
1-11-00.
Gerry Strathman recommends approval of the assessment. The notice was sent, Ms. Cordero
received it, Mr. Weisman received it, and the City did the work. One window was boazded, the
contractor charged $37.96 plus the administration fee for a total of $82.96. This is the cost the
City incurred and it needs to be recovered from the properry owner.
Resolution ordering the owner to remove or repair the building at 408 Blair Avenue. If the
owner fails to camply with the resolution, Code Enforcement is ordered to remove the
building.
Steve Magner reported this properiy has been vacant since April 1997. Eleven summary
abatement notices have been issued to secure dwelling, remove refuse, cut tail grass, remove
snow and/or ice, and repair stairway. On 2-15-00, an inspection was conducted and a list of
deficiencies that constitute a nuisance condition was developed and photographs were taken. An
order to abate a nuisance building was issued on 3-1-00 with a compliance date of 3-31-00. The
vacant building fees are paid. Real estate taxes are current. Taxation has placed an estimated
mazket value of $28,300 on this property. On 2-11-00, a building permit was issued. Code
Enforcement estimates the cost to repair is $45,000; cost to demolish, $7,000 to $8,000.
Cha Sur Vang, owner, appeared and stated he lives in Saint Paul and is trying to buy a house. He
is doing the work himself and hires someone to help him occasionally. He has repaired many
houses before. The inside of the house is noY much of a problem; the outside looks bad because
the neighbors damaged a lot of windows. This building is big, tall, and there is a lot to do. He
received notice about a bond, and has never had to do one before. He will do the plumbing,
heating, and electricai first. He needs more than siac months because he does not have a crew.
Gerry Strathman recommends granting the owner six months to complete rehabilitation on the
property on condition that a$2,000 bond is posted by noon of May 24, 2000. Mr. Magner added
the bond has to be posted at the Office of License, Inspections, Environmental Protection. The
owner can ask about the code compliance inspection that was done in November1998, but the
building has not changed much since that time.

Steve Magner reported this is a concrete block wood frame structure with an attached garage and
auto repair bays. It has been vacant since July 1990. The current owner is Jerry L. Anderson.
Nine summary abatement notices have been issued to secure the dwelling, remove refuse, cut tall
grass, and remove snow and/or ice. On 12-22-99, an inspecfion of the building was conducted
and a list of deficiencies that constitute a nuisance condition was developed and photographs
were taken. An order to abate a nuisance building was issued on 1-4-00 with a compliance date
of 2-3-00 and an extension date of 2-15-OQ. The vacant building fees are paid. The real estate
taxes aze paid. Taxation has placed a market value of $26,500 on this property. A code
compliance inspection has not been done. The estimated cost to repair is $50,000; the estimated
cost to demolish, $9,000 to $10,000. The owner has submitted numerous plans over the last ten
years, but nothing has come to fnution. The roof was installed without a pernut and overhangs
the neighboring properry, which is a water displacement issue.

Tom Lipschultz, 631 Mt. C�rve Boulevard, appeazed and stated his parents are one of the
building owners. The building has been vacant since December 1998. Last summer, the
neighborhood accumulated a lot of trash. It was not coming from his building because it was
vacant. Mr. Lipschultz does not think he should have to pay for mattresses and other items that
aze being dumped on his properiy. Before he went out of town, he picked up his mail from his
post office box. Upon his return, two or three notices were received. He did not haue a chance
to do anything about the problem.
Mr. Strathman asked did Mr. Lipschultz want to view the videotape. Mr. Lipschultz responded
no because he knows it was cleaned up.
Mr. Strathman stated there aze two issues: was notice given as required by law and did the City
do the cleanup. Mr. Lipschultz is not azguing the point that either one was not done, stated Mr.
Strathman.
Mr. Lipschultz stated there were two notices and they could not have been more than a week
apart. If a person is out of town, he asked, what is suppose to happen. Mr. Strathman responded
this assessment is not a punishment, fine, or penalty. The City is just recovering the cost it bore
of cleaning up the properry. �

Tom Edholm, owner, appeazed and stated he does not recall getting one of the notices.
Sally Peterson reported notice was sent to Thomas Edholm, 419 View Street, and it was also
posted on site at 541 Superior. The notice was mailed on 1-19-00, and the items were picked up
by the City on 1-31-00. Mr. Edholm responded he did not get the notice, but that does not mean
it did not arrive.

Mr. S�athman added that the papenvork indicates the inspector called Tom, but there was no
answer and no answering machine.
The tenants informed him they did not throw anything out, stated Mr. Edhoim. Across the alley,
townhouses were recenfly rented, and the people moving in were disposing of their junk.
(The videotape was shown at the request of Mr. Edholm.)
Mr. Strathman stated the items look like they were from the tenant and not from across the alley.
Mr. Edholm stated there was not more than three bags and that isn't worth $300. Mr. Strathman
responded more than three bags were seen on the videotape, and there is no question that it could
be done for a cheaper amount.

Raquel Cordero appeared and stated she received a notice to board the windows, and she boazded
them. She has a contract for deed with Bric Weisman who went into the house, took down the
boards, and opened up the windows. She sent a letter to her attorney who contacted Mr.

Weisman and informed him that Ms. Cordero had boazded up the windows. Mr. Weisman said
he would redo the work. He put the boards up but did not cover the entire windows.
Sally Peterson reported this is a vacant building. Qrders were mailed to Ms. Cordero and Eric
Weisman on 12-30-99, posted on the site on 12-29-99, and the City boazded the building on
1-11-00.
Gerry Strathman recommends approval of the assessment. The notice was sent, Ms. Cordero
received it, Mr. Weisman received it, and the City did the work. One window was boazded, the
contractor charged $37.96 plus the administration fee for a total of $82.96. This is the cost the
City incurred and it needs to be recovered from the properry owner.
Resolution ordering the owner to remove or repair the building at 408 Blair Avenue. If the
owner fails to camply with the resolution, Code Enforcement is ordered to remove the
building.
Steve Magner reported this properiy has been vacant since April 1997. Eleven summary
abatement notices have been issued to secure dwelling, remove refuse, cut tail grass, remove
snow and/or ice, and repair stairway. On 2-15-00, an inspection was conducted and a list of
deficiencies that constitute a nuisance condition was developed and photographs were taken. An
order to abate a nuisance building was issued on 3-1-00 with a compliance date of 3-31-00. The
vacant building fees are paid. Real estate taxes are current. Taxation has placed an estimated
mazket value of $28,300 on this property. On 2-11-00, a building permit was issued. Code
Enforcement estimates the cost to repair is $45,000; cost to demolish, $7,000 to $8,000.
Cha Sur Vang, owner, appeared and stated he lives in Saint Paul and is trying to buy a house. He
is doing the work himself and hires someone to help him occasionally. He has repaired many
houses before. The inside of the house is noY much of a problem; the outside looks bad because
the neighbors damaged a lot of windows. This building is big, tall, and there is a lot to do. He
received notice about a bond, and has never had to do one before. He will do the plumbing,
heating, and electricai first. He needs more than siac months because he does not have a crew.
Gerry Strathman recommends granting the owner six months to complete rehabilitation on the
property on condition that a$2,000 bond is posted by noon of May 24, 2000. Mr. Magner added
the bond has to be posted at the Office of License, Inspections, Environmental Protection. The
owner can ask about the code compliance inspection that was done in November1998, but the
building has not changed much since that time.

Steve Magner reported this is a concrete block wood frame structure with an attached garage and
auto repair bays. It has been vacant since July 1990. The current owner is Jerry L. Anderson.
Nine summary abatement notices have been issued to secure the dwelling, remove refuse, cut tall
grass, and remove snow and/or ice. On 12-22-99, an inspecfion of the building was conducted
and a list of deficiencies that constitute a nuisance condition was developed and photographs
were taken. An order to abate a nuisance building was issued on 1-4-00 with a compliance date
of 2-3-00 and an extension date of 2-15-OQ. The vacant building fees are paid. The real estate
taxes aze paid. Taxation has placed a market value of $26,500 on this property. A code
compliance inspection has not been done. The estimated cost to repair is $50,000; the estimated
cost to demolish, $9,000 to $10,000. The owner has submitted numerous plans over the last ten
years, but nothing has come to fnution. The roof was installed without a pernut and overhangs
the neighboring properry, which is a water displacement issue.

Le�islative Code, Chapter 45. Division of Code Enforcement has issued an order to the then known
responsible parties to eliminate this nuisance condition by correctin� the deficiencies or by razin� and

Tom Lipschultz, 631 Mt. C�rve Boulevard, appeazed and stated his parents are one of the
building owners. The building has been vacant since December 1998. Last summer, the
neighborhood accumulated a lot of trash. It was not coming from his building because it was
vacant. Mr. Lipschultz does not think he should have to pay for mattresses and other items that
aze being dumped on his properiy. Before he went out of town, he picked up his mail from his
post office box. Upon his return, two or three notices were received. He did not haue a chance
to do anything about the problem.
Mr. Strathman asked did Mr. Lipschultz want to view the videotape. Mr. Lipschultz responded
no because he knows it was cleaned up.
Mr. Strathman stated there aze two issues: was notice given as required by law and did the City
do the cleanup. Mr. Lipschultz is not azguing the point that either one was not done, stated Mr.
Strathman.
Mr. Lipschultz stated there were two notices and they could not have been more than a week
apart. If a person is out of town, he asked, what is suppose to happen. Mr. Strathman responded
this assessment is not a punishment, fine, or penalty. The City is just recovering the cost it bore
of cleaning up the properry. �

Tom Edholm, owner, appeazed and stated he does not recall getting one of the notices.
Sally Peterson reported notice was sent to Thomas Edholm, 419 View Street, and it was also
posted on site at 541 Superior. The notice was mailed on 1-19-00, and the items were picked up
by the City on 1-31-00. Mr. Edholm responded he did not get the notice, but that does not mean
it did not arrive.

Mr. S�athman added that the papenvork indicates the inspector called Tom, but there was no
answer and no answering machine.
The tenants informed him they did not throw anything out, stated Mr. Edhoim. Across the alley,
townhouses were recenfly rented, and the people moving in were disposing of their junk.
(The videotape was shown at the request of Mr. Edholm.)
Mr. Strathman stated the items look like they were from the tenant and not from across the alley.
Mr. Edholm stated there was not more than three bags and that isn't worth $300. Mr. Strathman
responded more than three bags were seen on the videotape, and there is no question that it could
be done for a cheaper amount.

Raquel Cordero appeared and stated she received a notice to board the windows, and she boazded
them. She has a contract for deed with Bric Weisman who went into the house, took down the
boards, and opened up the windows. She sent a letter to her attorney who contacted Mr.

Weisman and informed him that Ms. Cordero had boazded up the windows. Mr. Weisman said
he would redo the work. He put the boards up but did not cover the entire windows.
Sally Peterson reported this is a vacant building. Qrders were mailed to Ms. Cordero and Eric
Weisman on 12-30-99, posted on the site on 12-29-99, and the City boazded the building on
1-11-00.
Gerry Strathman recommends approval of the assessment. The notice was sent, Ms. Cordero
received it, Mr. Weisman received it, and the City did the work. One window was boazded, the
contractor charged $37.96 plus the administration fee for a total of $82.96. This is the cost the
City incurred and it needs to be recovered from the properry owner.

Steve Magner reported this properiy has been vacant since April 1997. Eleven summary
abatement notices have been issued to secure dwelling, remove refuse, cut tail grass, remove
snow and/or ice, and repair stairway. On 2-15-00, an inspection was conducted and a list of
deficiencies that constitute a nuisance condition was developed and photographs were taken. An
order to abate a nuisance building was issued on 3-1-00 with a compliance date of 3-31-00. The
vacant building fees are paid. Real estate taxes are current. Taxation has placed an estimated
mazket value of $28,300 on this property. On 2-11-00, a building permit was issued. Code
Enforcement estimates the cost to repair is $45,000; cost to demolish, $7,000 to $8,000.
Cha Sur Vang, owner, appeared and stated he lives in Saint Paul and is trying to buy a house. He
is doing the work himself and hires someone to help him occasionally. He has repaired many
houses before. The inside of the house is noY much of a problem; the outside looks bad because
the neighbors damaged a lot of windows. This building is big, tall, and there is a lot to do. He
received notice about a bond, and has never had to do one before. He will do the plumbing,
heating, and electricai first. He needs more than siac months because he does not have a crew.
Gerry Strathman recommends granting the owner six months to complete rehabilitation on the
property on condition that a$2,000 bond is posted by noon of May 24, 2000. Mr. Magner added
the bond has to be posted at the Office of License, Inspections, Environmental Protection. The
owner can ask about the code compliance inspection that was done in November1998, but the
building has not changed much since that time.

Steve Magner reported this is a concrete block wood frame structure with an attached garage and
auto repair bays. It has been vacant since July 1990. The current owner is Jerry L. Anderson.
Nine summary abatement notices have been issued to secure the dwelling, remove refuse, cut tall
grass, and remove snow and/or ice. On 12-22-99, an inspecfion of the building was conducted
and a list of deficiencies that constitute a nuisance condition was developed and photographs
were taken. An order to abate a nuisance building was issued on 1-4-00 with a compliance date
of 2-3-00 and an extension date of 2-15-OQ. The vacant building fees are paid. The real estate
taxes aze paid. Taxation has placed a market value of $26,500 on this property. A code
compliance inspection has not been done. The estimated cost to repair is $50,000; the estimated
cost to demolish, $9,000 to $10,000. The owner has submitted numerous plans over the last ten
years, but nothing has come to fnution. The roof was installed without a pernut and overhangs
the neighboring properry, which is a water displacement issue.
