BE IT RESOLVED, that, upon the petition of Three Bears LLC, as documented in Technology
Departrnent File Number 4-2000, puhlic properties hereinafter described are hereby vacated and
3 discontinued as public property.

Drewry Lane lying between the south line of Payne Avenue extended northeasterly to the east
line of said Drewry Lane and the south line of L,ot 7, Block 3, Irvine's 2° AddiUon extended
easterly.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall pay the depreciated value of the publicly funded portion of the cost paid
to improve this street in 1984. The depreciation to be calculated on a straight line basis assuming
a 40 year life of the street improvements. The amount is calculated to be $8,213.34 based on a 40
percent depreciation. This amount is to be paid within 60 days of the effective date of this
resolution.
That the petitioner shall be responsible for all costs associated with the removal of the existing
street lighting system within the vacated area.
That the petitioner shail dedicate additional right-of-way for a turn-around at the north end of
remaining Drewry Iane, and construct said turn-around, all to the safisfaction of the Department
of Public Works Street Engineering.
That the petitioner shall be responsible for the rreconstruction of the intersection of Payne Avenue
and Drewry Lane and Drewry Lane at the south limits of the vacation, which will be necessary to

1 properly eliminate the appearance of a public thoroughfare, including but not limited to, costs for
2 new curbs, sidewalks, boulevazds, storm drains and si�s, all to the satisfaction of the
3 Deputment of Public Works.

5 6. That a permanent utility easement shall be retained within the vacated area on behalf of the City
6 of Saint Paul, Board of Water Commissioners subject to the following restrictions:

a. No buildings, sWctures, trees or any temporary structure, material starage, fixture, or
other object that will prohibit normal access to water facilities for maintenance purposes
will be permitted within the easement azea,.

No change from the existing grade will be permitted without written permission from the
Water Utility.
No change in surfacing within the easement area will be permitted without written
pernussion from the Water Utility.
d. The petitioner, its successors and assigns shall fully indemnify, defend and save harmless
the Board of Water Commissioners, its officers, agents, employees, and servants from all
suits, action or claims which shall atise from any injuries or damages received or
sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resulting from any action or negligence of the petitioner, its
employees, agents or business invitees.
That a permanent utility easement shal] be retained witlun the vacated area to protect the interest
of Northern States Power Company.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of U.S. West Communication, Inc.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulafion made in
accordance with the law, whether by the petitioners or any of their agents or employees.

Council Resolution. The purpose of the resolution is to vacate a portion of Drewry Lane
in order to allow construction of a parking lot for a proposed charter school. I have
enclosed photocopies of the Green Sheet, the Council Resolution and a map of the area
to be vacated. Please let me know if there is any additional information you might need.
The resolution is currently being routed for signatures along with the responses from the
utilities and other pertinent information.

The Department of Public Works has completed a review of the above-referenced vacation proposal.
Drewry Lane was reconstructed in 1984. When the City vacates its interest in a right-of-way, the
general public no longer has the right to the use of that right-of-way, therefore, we wouid require the
peUtioner to pay the depreciated value of any publicly funded portion of the cost to construct these
street improvements. The depreciation would be calculated on a straight line basis assuming a 40 year
life of the street improvements. If you have any questions regarding this, you may contact Tom Kuhfeld
at 266-61ll.
Sewer Engineering requires that a curb at Payne is installed to direct surface drainage from Payne to the
southwest along Payne Avenue, away from the area proposed to be vacated. This should be
incorporated into the site plan you submit for City approval of the parking lot. Contact Pete Gallagher
at 266-6250 with any questions.
Street Engineering also zequires that a curb and sidewalk be constructed on the southly side of Payne
Avenue across Drewry Lane. Construct curb and sidewalk across Drewry Lane at the south limits of
the vacation and construct a"T" cul-de-sac or turn-around. Contact Paul St.Martin at 651-266-6118

is an issue.
Therefore, the Department of Public Works has no objections to the above-referenced vacation
subject to site plan approval and the following conditions: ___
1. The petitioner shall pay the depreciated value of any publicly funded portion of the cost paid to
improve these streets in 1984. The depreciation shall be calculated on a straight line basls assuming a
40 year life of the street improvements.
2. The petitioner shall be responsible for all costs associated with the removal of the existing street
lighting system within the vacated azea.
3. The petitioner shall dedicate additional right-of-way for a turn-azound at the north end of remaining
Drewry Lane, and construct said riun-uound, all to the saUSfaction of the Department of Public Works,
Street Engineering.
4. The petitioner shall be responsible for the reconstruction of the intersection of Payne and Drewry
Lane and Drewry Lane at the south limits of the vacation, which will be necessary to properly eliminate
the appeazance of a public thoroughfaze, including but not limited to, costs for new curbs, sidewalks,
boulevazds, storm drains, and signs, all to the sausfaction of the DeparUnent of Public Works.

The Saint Paul Regional Water Services (SPRWS) has a six-inch water main in that part of Drewry
Lane proposed far vacation. To provide far continued access to our facility the SPEW S requires an
easement be retained over that part of Dreary Lane lying southerly of the south right-of-way line of
Payne Avenue and northerly of the south line of Lot 7, Block 3 of Irvine's 2rttl Addifion extended.
Restrictions within the azea are as follows:
No buildings, shuctures or trees aze permitted within the easement area, or any
temporary shucture, material storage, fixture or other objects that may prohibit
normal access to water facilities far maintenance purposes without written
pernussion from the SPEWS.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the SPEWS.
Should it be necessary that the petitioner's warks or unprovements be
removed or damaged as a result of SPEWS' operations, all removal,
replacement or modification costs shall be borne solely by the peritioner.

4. That the petitioner, its successors and assigns shall fully indemnify,
defend and save l�armless the Board of Water Coxnmissioners, its officers,
agents, employees and servants from all suits, actions or ciaims which

in any service pipe, water main, or connection in said reserved easement,
arising out of or resulting from any action or negligence of the
petitioner, its employees, agents or business invitee.

BE IT RESOLVED, that, upon the petition of Three Bears LLC, as documented in Technology
Departrnent File Number 4-2000, puhlic properties hereinafter described are hereby vacated and

Drewry Lane lying between the south line of Payne Avenue extended northeasterly to the east
line of said Drewry Lane and the south line of L,ot 7, Block 3, Irvine's 2° AddiUon extended
easterly.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall pay the depreciated value of the publicly funded portion of the cost paid
to improve this street in 1984. The depreciation to be calculated on a straight line basis assuming
a 40 year life of the street improvements. The amount is calculated to be $8,213.34 based on a 40
percent depreciation. This amount is to be paid within 60 days of the effective date of this
resolution.
That the petitioner shall be responsible for all costs associated with the removal of the existing
street lighting system within the vacated area.
That the petitioner shail dedicate additional right-of-way for a turn-around at the north end of
remaining Drewry Iane, and construct said turn-around, all to the safisfaction of the Department
of Public Works Street Engineering.
That the petitioner shall be responsible for the rreconstruction of the intersection of Payne Avenue
and Drewry Lane and Drewry Lane at the south limits of the vacation, which will be necessary to

other object that will prohibit normal access to water facilities for maintenance purposes

suits, action or claims which shall atise from any injuries or damages received or
sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resulting from any action or negligence of the petitioner, its
employees, agents or business invitees.

property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulafion made in
accordance with the law, whether by the petitioners or any of their agents or employees.

Council Resolution. The purpose of the resolution is to vacate a portion of Drewry Lane
in order to allow construction of a parking lot for a proposed charter school. I have

The resolution is currently being routed for signatures along with the responses from the

The Department of Public Works has completed a review of the above-referenced vacation proposal.
Drewry Lane was reconstructed in 1984. When the City vacates its interest in a right-of-way, the
general public no longer has the right to the use of that right-of-way, therefore, we wouid require the
peUtioner to pay the depreciated value of any publicly funded portion of the cost to construct these
street improvements. The depreciation would be calculated on a straight line basis assuming a 40 year
life of the street improvements. If you have any questions regarding this, you may contact Tom Kuhfeld
at 266-61ll.
Sewer Engineering requires that a curb at Payne is installed to direct surface drainage from Payne to the
southwest along Payne Avenue, away from the area proposed to be vacated. This should be
incorporated into the site plan you submit for City approval of the parking lot. Contact Pete Gallagher
at 266-6250 with any questions.
Street Engineering also zequires that a curb and sidewalk be constructed on the southly side of Payne
Avenue across Drewry Lane. Construct curb and sidewalk across Drewry Lane at the south limits of
the vacation and construct a"T" cul-de-sac or turn-around. Contact Paul St.Martin at 651-266-6118

is an issue.
Therefore, the Department of Public Works has no objections to the above-referenced vacation
subject to site plan approval and the following conditions: ___
1. The petitioner shall pay the depreciated value of any publicly funded portion of the cost paid to
improve these streets in 1984. The depreciation shall be calculated on a straight line basls assuming a
40 year life of the street improvements.
2. The petitioner shall be responsible for all costs associated with the removal of the existing street
lighting system within the vacated azea.

Street Engineering.
4. The petitioner shall be responsible for the reconstruction of the intersection of Payne and Drewry
Lane and Drewry Lane at the south limits of the vacation, which will be necessary to properly eliminate
the appeazance of a public thoroughfaze, including but not limited to, costs for new curbs, sidewalks,

The Saint Paul Regional Water Services (SPRWS) has a six-inch water main in that part of Drewry
Lane proposed far vacation. To provide far continued access to our facility the SPEW S requires an
easement be retained over that part of Dreary Lane lying southerly of the south right-of-way line of
Payne Avenue and northerly of the south line of Lot 7, Block 3 of Irvine's 2rttl Addifion extended.
Restrictions within the azea are as follows:
No buildings, shuctures or trees aze permitted within the easement area, or any
temporary shucture, material storage, fixture or other objects that may prohibit
normal access to water facilities far maintenance purposes without written
pernussion from the SPEWS.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the SPEWS.
Should it be necessary that the petitioner's warks or unprovements be
removed or damaged as a result of SPEWS' operations, all removal,
replacement or modification costs shall be borne solely by the peritioner.

4. That the petitioner, its successors and assigns shall fully indemnify,
defend and save l�armless the Board of Water Coxnmissioners, its officers,
agents, employees and servants from all suits, actions or ciaims which

arising out of or resulting from any action or negligence of the
petitioner, its employees, agents or business invitee.

Departrnent File Number 4-2000, puhlic properties hereinafter described are hereby vacated and

Drewry Lane lying between the south line of Payne Avenue extended northeasterly to the east
line of said Drewry Lane and the south line of L,ot 7, Block 3, Irvine's 2° AddiUon extended
easterly.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall pay the depreciated value of the publicly funded portion of the cost paid
to improve this street in 1984. The depreciation to be calculated on a straight line basis assuming
a 40 year life of the street improvements. The amount is calculated to be $8,213.34 based on a 40
percent depreciation. This amount is to be paid within 60 days of the effective date of this
resolution.
That the petitioner shall be responsible for all costs associated with the removal of the existing
street lighting system within the vacated area.
That the petitioner shail dedicate additional right-of-way for a turn-around at the north end of
remaining Drewry Iane, and construct said turn-around, all to the safisfaction of the Department
of Public Works Street Engineering.
That the petitioner shall be responsible for the rreconstruction of the intersection of Payne Avenue
and Drewry Lane and Drewry Lane at the south limits of the vacation, which will be necessary to

sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resulting from any action or negligence of the petitioner, its

brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulafion made in
accordance with the law, whether by the petitioners or any of their agents or employees.

The Department of Public Works has completed a review of the above-referenced vacation proposal.
Drewry Lane was reconstructed in 1984. When the City vacates its interest in a right-of-way, the
general public no longer has the right to the use of that right-of-way, therefore, we wouid require the
peUtioner to pay the depreciated value of any publicly funded portion of the cost to construct these
street improvements. The depreciation would be calculated on a straight line basis assuming a 40 year
life of the street improvements. If you have any questions regarding this, you may contact Tom Kuhfeld
at 266-61ll.
Sewer Engineering requires that a curb at Payne is installed to direct surface drainage from Payne to the
southwest along Payne Avenue, away from the area proposed to be vacated. This should be
incorporated into the site plan you submit for City approval of the parking lot. Contact Pete Gallagher
at 266-6250 with any questions.
Street Engineering also zequires that a curb and sidewalk be constructed on the southly side of Payne
Avenue across Drewry Lane. Construct curb and sidewalk across Drewry Lane at the south limits of
the vacation and construct a"T" cul-de-sac or turn-around. Contact Paul St.Martin at 651-266-6118

said Drewry Lane and the south line of L.ot 7, Block 3, Irvine's 2nd Addition extended easterly.
Is this in an Historical Preservation District? Check with Aazon Rubenstein at ext. 6-9087, to see if this
is an issue.
Therefore, the Department of Public Works has no objections to the above-referenced vacation
subject to site plan approval and the following conditions: ___
1. The petitioner shall pay the depreciated value of any publicly funded portion of the cost paid to
improve these streets in 1984. The depreciation shall be calculated on a straight line basls assuming a
40 year life of the street improvements.
2. The petitioner shall be responsible for all costs associated with the removal of the existing street
lighting system within the vacated azea.
3. The petitioner shall dedicate additional right-of-way for a turn-azound at the north end of remaining
Drewry Lane, and construct said riun-uound, all to the saUSfaction of the Department of Public Works,
Street Engineering.
4. The petitioner shall be responsible for the reconstruction of the intersection of Payne and Drewry
Lane and Drewry Lane at the south limits of the vacation, which will be necessary to properly eliminate
the appeazance of a public thoroughfaze, including but not limited to, costs for new curbs, sidewalks,
boulevazds, storm drains, and signs, all to the sausfaction of the DeparUnent of Public Works.

The Saint Paul Regional Water Services (SPRWS) has a six-inch water main in that part of Drewry
Lane proposed far vacation. To provide far continued access to our facility the SPEW S requires an
easement be retained over that part of Dreary Lane lying southerly of the south right-of-way line of
Payne Avenue and northerly of the south line of Lot 7, Block 3 of Irvine's 2rttl Addifion extended.
Restrictions within the azea are as follows:
No buildings, shuctures or trees aze permitted within the easement area, or any
temporary shucture, material storage, fixture or other objects that may prohibit
normal access to water facilities far maintenance purposes without written
pernussion from the SPEWS.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the SPEWS.
Should it be necessary that the petitioner's warks or unprovements be
removed or damaged as a result of SPEWS' operations, all removal,
replacement or modification costs shall be borne solely by the peritioner.

defend and save l�armless the Board of Water Coxnmissioners, its officers,

petitioner, its employees, agents or business invitee.
