00-498Council File # B�- �/9p' �RlGlIVAL RESOLUTION CITY OF SAINT PAUL,IVIINNESOTA Green Sheet # /,�� 7,f-s� 27 Presented Refened To Connxnittee: Date WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City o£ Saint Paul; and WHEREAS, §293.11 pro�tides for the granting of variances from the sound level limitations contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on an applicant, other persons or on the community; and WHEREAS, the Saint Paul Saints Professional Baseball Club, Inc., represented by Bill Fanning, Vice-President and General Manager, who has been designated as the responsible person on the application, has applied for a variance to allow live music at Midway Stadium, 1771 Energy Park Drive, on July 14 and August 26, 2000; and WHEREAS, applicant is seeking a variance for the hours of 3:00 p.m. to 10:00 p.m.on July 14,2000 and the hours of 1:00 p.m. to 10:00 p.m. on August 26, 2000; and WHEREAS, if applicant is not granted a variance it will not be able to present the concerts; and WEiEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application and has made recommendations regarding conditions for the variance; now, therefore, be it RESOLVED, that the Council grants a variance for those two Professional Baseball Club, Inc conditions: of the City of Saint Paul hereby dates to the Saint Paul Saints , subject to the following 1) The variance shall be for the hours of 3:00 p.m. to 10:00 p.m. on Ju1y 14, 2000, and for the hours of 1:00 p.m, to 10:00 p.m. on August 26, 2000. 2) All electronically powered equipment used in conjunction with the event shall not exceed 100 dBA as measured at the closer of the sound mix or at a distance of 100 feet from the front of the stage. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 Do'- -s/9� 3) The appliaant shall provide personnel and equipment who shall provide continuous sound level monitoring between 3:00 p.m. and 10:00 p.m. on July 14, 2000 and between 1:00 p.m. and 1Q:00 p.m. on August 26, 2000 to ensure compliance with Condition #2- 4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be turned off no later than 10:0� p.m. on both dates.
