An-agreement with the City of SainC Paul governing the billing and collection of sanitary
sewer charges was approved in 1996. This agreement specified that the fees paid for sanitary
sewer and rainleader billing and collections would increase each year by the percentage of
increase in residential water rates, with the condition that the fee not exceed that paid by
other municipaiities served by the Board £or like services. The Agreement expires on December
31, 1999. Staff from both Saint Paul Public Works Depart�aent and Regional Water Services
believe the billing arrangement is working well and desire to extend the term of the
Agreement to December 31, 2001. The Board has approved said Agreement by Resolution No. 4679

and the
BOARD OF WATER COMMISSIONERS
This Amendment I3o. 1 to the Agreement for Billing and Coilecting Sewer Service Chazges
is made this � day of�z�� , 2000, by and between the City of Saint Paul (Saint Paul

Sewer Utility Fund), hereinafter refened to as"CITY", and the Boazd of Water Commissioners,
hereinafter refeaed to as "BOARD."
WHEREAS, CITY and BOARD have previously entered into an Agreement for Billing and
Collecting Sewer Service Chazges dated 7anuary 8, 1997, hereinafter refened to as the
"Agreement;" and
WHEREAS, the Agreement is scheduled to expire on December 31, 1999; and
WFIEREAS, The parties do wish to amend the Agreement in the manner described below
and also to extend the term of the Agreement beyond the initial expiration date of December 31,
1999, so that the Agreement shall remairA in effect until December 31, 2001;
NO W THEREFORE, in consideration of the terms and conditions of this Amendment No.
1, CITY and the BOARD agree as follows:
1. The following pazagraph shall replace Paragraph D. of ARTICLE 1V of the
Agreement:

The future compensation the CITY wili pay the BOARD for billing service charges will be the same
percentage increase that the water rates increase based on the first step residential water rate. The
CITY and BOAl2D agree to meet and confer at least two months before the expiration date of ttus
aa ee�ent to discuss continuing the parties' contractual relationship.
2. The following pazagraph shall replace Paragraph A. of ARTICLE V of the
Agreement:

WHEREAS, the Board of Water Commissioners ("Boazd°) did adopt Resolution No. 44&7 on
November 12, 1999 which approved an Agreement for Billing and Collecting Sewer Service
Chazges with the City of Saint Paul ("City"); and
WHEREAS, said Agreement expires on December 31, 1999, and both the Board and the Ciry
desire to extend the term of the Aa eement for an additional two yeazs; and
W�REAS, the assistant city attomey has prepazed an Amendment No. i to Agreement for Billing
and Collecting Sewer Service Charges which extends the term of said agreement to December 31,
2001, and which specifies that the Boazd and the City shall meet and confer at least two months
before that date to discuss the continuation of such billing and collection services, with all other
terms and conditions remaining unchanged and in effect; now, therefore, be it

November 12, 1999 which approved an Agreement for Billing and Collecting Sewer Service
Chazges with the City of Saint Paul ("City"); and
WHEREAS, said Agreement expires on December 31, 1999, and both the Board and the Ciry
desire to extend the term of the Aa eement for an additional two yeazs; and
W�REAS, the assistant city attomey has prepazed an Amendment No. i to Agreement for Billing
and Collecting Sewer Service Charges which extends the term of said agreement to December 31,
2001, and which specifies that the Boazd and the City shall meet and confer at least two months
before that date to discuss the continuation of such billing and collection services, with all other
terms and conditions remaining unchanged and in effect; now, therefore, be it
RESOLVED, that Amendment No. 1 to Agreement for Billing and Collecting Sewer Service
Chazges between the Boazd of Water Commissioners and the Ciry of Saint Paui is hereby approved
and that the proper officers aze hereby authorized to execute said Amendment No. 1 on behalf of the
Board.
