The Office of License, Inspections and Bnvironxnental Protection (LIEP) has
recommended adverse action against the licenses held by Sakura Restaurant, Inc. dib/a Sakura
Japanese Restaurant at the above location. This recommendation is based on the following
information:
On April l, 2000 an 18-year old female enfered the premises of
Sakura Japanese Restaurant at 350 St. Peter Street, Suite 195
as part of a compliance check. The young woman was able to
purchase a Miller Genuine Draft beer without being asked for
any proof of age. Sale of alcohol to an underage person is a
violation of Minn. Stat. §340A.503, subd. 2(1) and Saint Paul
Legislative Code §409.08, subd. (2)a.
Since this is considered a first violation, the licensing ofFice will recommend a$500.00 fine,
pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
Tf you do not dispute the above facts and do not wish to have a publlc hearing, you wiil
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Envirorunental
Protection, Room 300 Lowry Professional Building, 3�0 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you aze entitled.

2. Altematively, if you do not dispute the above facts, but �uish to have a public hearin�
before the Saint Paul City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearin� by Thursday, Apri127, 2000. The matter
will then be scheduled before the City Council for a public hearing to determine what
penalty, if any, to impose. You will have an opportunity to appear before the Council and
make a statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that heazing both you and the City will be able to appeaz and present
wimesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Thursday,
Apri127, 2000, how you wish to proceed.
If you have not contacted me by Thursday, April 27, 2000, I will assume that you are not
contesting the facts and wili schedule this matter for the St. Paul City Council and have it
placed on the Consent Agenda during c�•hich no public discussion is allowed and the
recommeuded penalty wili be imposed.

�I, Sgt Ramstad, am assigned Eo ths Vice Unit. The Vice Unit doing
iiquor compiiance checics of ali Sicensed liquor establishments in the Cify of 8t
Paul. We are using checicers that are under the age of 21. They have been
trained in how to conduct the checks. They have besn in front of an age
verification group to detertnine that they look age appropriate. They are tofd
that ihey can not lie about their age os date of birth. They wear a microphone
and a transmitter so we can monitor tfieir conversation to detertnine if the
check was conductad properly.
❑On 4/'t/2d00 1 went out and canducted checks using Checker # 45.
I verified that her date of birth was 7/19l1981 making her �8 years of age. i
took any fortn of identifica5on she had atong with any money she had. She
was given department funds ta make any purchases.
At 17'I5 hours I sent her into Sakura Japanese Restaurant at 350 St Peter St. She sat by a window
where I could see her. The waifress asked if she wanted anything to drink. The checker asked for
a Miller Genuine Draft. The waitress retumed witri the can of beer and a giass. She poured some
of the beer in the glass and leR the can and the gfass on the table with the checker. The waitress
then left the area. THe waiV25s never inquired about the age af the c.h�er.
I entered and identified myself to the waitress. I toid her of the violation. She told me that she was
going to ask her for indentifccation but didn't. She was going to wait to see who was meeting her.
The waifress stated she was nervous because it was her first day at this restuaranY and sfie was
being trained in 6y anothec woman.
t informed her that to be safe she should get indentification from anyone looking under 30. She was
in(ortned that i would be forwarding the report to the St Paul City Attomey's OfFce for criminal
charges. I infortned the staff U1at the report would be forvvarded to L1EP for action against the
liquor License.

The Office of License, Inspections and Bnvironxnental Protection (LIEP) has
recommended adverse action against the licenses held by Sakura Restaurant, Inc. dib/a Sakura
Japanese Restaurant at the above location. This recommendation is based on the following
information:
On April l, 2000 an 18-year old female enfered the premises of
Sakura Japanese Restaurant at 350 St. Peter Street, Suite 195
as part of a compliance check. The young woman was able to
purchase a Miller Genuine Draft beer without being asked for
any proof of age. Sale of alcohol to an underage person is a
violation of Minn. Stat. §340A.503, subd. 2(1) and Saint Paul
Legislative Code §409.08, subd. (2)a.
Since this is considered a first violation, the licensing ofFice will recommend a$500.00 fine,
pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
Tf you do not dispute the above facts and do not wish to have a publlc hearing, you wiil
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Envirorunental
Protection, Room 300 Lowry Professional Building, 3�0 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you aze entitled.

2. Altematively, if you do not dispute the above facts, but �uish to have a public hearin�
before the Saint Paul City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearin� by Thursday, Apri127, 2000. The matter
will then be scheduled before the City Council for a public hearing to determine what
penalty, if any, to impose. You will have an opportunity to appear before the Council and
make a statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that heazing both you and the City will be able to appeaz and present
wimesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Thursday,
Apri127, 2000, how you wish to proceed.
If you have not contacted me by Thursday, April 27, 2000, I will assume that you are not
contesting the facts and wili schedule this matter for the St. Paul City Council and have it
placed on the Consent Agenda during c�•hich no public discussion is allowed and the
recommeuded penalty wili be imposed.

�I, Sgt Ramstad, am assigned Eo ths Vice Unit. The Vice Unit doing
iiquor compiiance checics of ali Sicensed liquor establishments in the Cify of 8t
Paul. We are using checicers that are under the age of 21. They have been
trained in how to conduct the checks. They have besn in front of an age
verification group to detertnine that they look age appropriate. They are tofd
that ihey can not lie about their age os date of birth. They wear a microphone
and a transmitter so we can monitor tfieir conversation to detertnine if the
check was conductad properly.
❑On 4/'t/2d00 1 went out and canducted checks using Checker # 45.
I verified that her date of birth was 7/19l1981 making her �8 years of age. i
took any fortn of identifica5on she had atong with any money she had. She
was given department funds ta make any purchases.
At 17'I5 hours I sent her into Sakura Japanese Restaurant at 350 St Peter St. She sat by a window
where I could see her. The waifress asked if she wanted anything to drink. The checker asked for
a Miller Genuine Draft. The waitress retumed witri the can of beer and a giass. She poured some
of the beer in the glass and leR the can and the gfass on the table with the checker. The waitress
then left the area. THe waiV25s never inquired about the age af the c.h�er.
I entered and identified myself to the waitress. I toid her of the violation. She told me that she was
going to ask her for indentifccation but didn't. She was going to wait to see who was meeting her.
The waifress stated she was nervous because it was her first day at this restuaranY and sfie was
being trained in 6y anothec woman.
t informed her that to be safe she should get indentification from anyone looking under 30. She was
in(ortned that i would be forwarding the report to the St Paul City Attomey's OfFce for criminal
charges. I infortned the staff U1at the report would be forvvarded to L1EP for action against the
liquor License.

The Office of License, Inspections and Bnvironxnental Protection (LIEP) has
recommended adverse action against the licenses held by Sakura Restaurant, Inc. dib/a Sakura
Japanese Restaurant at the above location. This recommendation is based on the following
information:
On April l, 2000 an 18-year old female enfered the premises of
Sakura Japanese Restaurant at 350 St. Peter Street, Suite 195
as part of a compliance check. The young woman was able to
purchase a Miller Genuine Draft beer without being asked for
any proof of age. Sale of alcohol to an underage person is a
violation of Minn. Stat. §340A.503, subd. 2(1) and Saint Paul
Legislative Code §409.08, subd. (2)a.
Since this is considered a first violation, the licensing ofFice will recommend a$500.00 fine,
pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
Tf you do not dispute the above facts and do not wish to have a publlc hearing, you wiil
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Envirorunental
Protection, Room 300 Lowry Professional Building, 3�0 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you aze entitled.

2. Altematively, if you do not dispute the above facts, but �uish to have a public hearin�
before the Saint Paul City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearin� by Thursday, Apri127, 2000. The matter
will then be scheduled before the City Council for a public hearing to determine what
penalty, if any, to impose. You will have an opportunity to appear before the Council and
make a statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that heazing both you and the City will be able to appeaz and present
wimesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Thursday,
Apri127, 2000, how you wish to proceed.
If you have not contacted me by Thursday, April 27, 2000, I will assume that you are not
contesting the facts and wili schedule this matter for the St. Paul City Council and have it
placed on the Consent Agenda during c�•hich no public discussion is allowed and the
recommeuded penalty wili be imposed.

�I, Sgt Ramstad, am assigned Eo ths Vice Unit. The Vice Unit doing
iiquor compiiance checics of ali Sicensed liquor establishments in the Cify of 8t
Paul. We are using checicers that are under the age of 21. They have been
trained in how to conduct the checks. They have besn in front of an age
verification group to detertnine that they look age appropriate. They are tofd
that ihey can not lie about their age os date of birth. They wear a microphone
and a transmitter so we can monitor tfieir conversation to detertnine if the
check was conductad properly.
❑On 4/'t/2d00 1 went out and canducted checks using Checker # 45.
I verified that her date of birth was 7/19l1981 making her �8 years of age. i
took any fortn of identifica5on she had atong with any money she had. She
was given department funds ta make any purchases.
At 17'I5 hours I sent her into Sakura Japanese Restaurant at 350 St Peter St. She sat by a window
where I could see her. The waifress asked if she wanted anything to drink. The checker asked for
a Miller Genuine Draft. The waitress retumed witri the can of beer and a giass. She poured some
of the beer in the glass and leR the can and the gfass on the table with the checker. The waitress
then left the area. THe waiV25s never inquired about the age af the c.h�er.
I entered and identified myself to the waitress. I toid her of the violation. She told me that she was
going to ask her for indentifccation but didn't. She was going to wait to see who was meeting her.
The waifress stated she was nervous because it was her first day at this restuaranY and sfie was
being trained in 6y anothec woman.
t informed her that to be safe she should get indentification from anyone looking under 30. She was
in(ortned that i would be forwarding the report to the St Paul City Attomey's OfFce for criminal
charges. I infortned the staff U1at the report would be forvvarded to L1EP for action against the
liquor License.
