In full settlement, the garties hereto have agreed as follows: . 1. Except as herein modified the signed 1982-1983 Collec�ive Bargaining Agreement between the parties, shall be the basis of the forthcoming labor agreement. . 2. Appendix B - Appendix B shall be added to said Agreer�ent. • This Appendix B is attached hereto and made a part hereof. It 3s understood that the above settlement shall be recommended by the City Tegotiator, but is subject to approval by the City Administration and adagtion : of the Civil Service Commission and the City Council. It has been necessary, as anno}inced by the r�yor on January 6, 1982, to make permanent personnel reductions affecting numerous eity employees as of January 29, I982. . It is recognized by the parties to this agreement that ef€ects detri— mental to the city and its eznplQyees flow from these per�anent personnel. reductions. In order to minimize these detrimental effects, the parties have a�reed ta establish an incentive program to facilitate reinstatement of employees who would have otherwise been without employment on January 29, 1982, by encouraging voluntary retirement of city employees who meet , eligibility requirements. The parties agree to the incentive program subject ta the folZowing specif ic condi.tions: 1) The City af Saint Paul shall pay to any member vf this bargaining unit, who meets the reqairements for voluntary retirement and who agrees to retire �,rithiu the dates. set forth below, an incentive of up to ,SS,OOQ provided that such retiremeat leads in an unbroken causal chain to the reinstatement of an employee who would otherwise be without employment on January 29, ].982, as a result of the permanent personnel reductions. s �' s 2 ^ 2) The incentive shall be available to any eligihle employee during the period of January 29, 1982, to Apri1 30, 1982, inclusive. The incentive shall automatically terminate with respect to this bargaining unit prior to April 30, , , 1982, if all employees within this bargaining uni� ��ho are affected by the permanent personnel reductians are reinstated. Such termina.tion shall occur the day of the reinstatement of the last affected employee. 3) Any employee wishing to take advantage of this incentive must submit his or her requesfi for retirement, along with necessary supporting documents, to his ar her appointment officer within the time geriod mentioned above. � G) The date of retirement, for purposes of calculatittg the amount of the inc.entive, shall be the date the employee actually xetires, not the date that iatent to retire is communicated to the appointing officer. If there is a delay between the employeeTs desired retiretiient date and the actual retirement date, and if such delay is caused by circumstances outside the employee�s contro�, the date of retirement, for gnrposes o€ calculating the amount of the incentive, shall be the date the employee desired to retire. : • ' , - 3 - 5) The maximum incentive shall be $5,ODQ and shall be availabe for retirement dates 3anuary 29, 1982 - February I4, 1982, inclusive. Commencing on February 15, 1982, and at the beginning of business each Monday thereaf ter and continuing through the term of this program, the amount of the incentive shal.l be reduced $100. In case more than one potential retiree wishes to avail himself or herself of any remaining available incentive, the r�nmaining incentive or incentives shall be made available � to the most senior potenti.al retiree according to th� , Contract language governing seniority. The parties in this contract acknowledge and agree that this Appendix has been established through a re-opening of the contract an.d that the union abtains no other benefits under any other provis�ons of this contract and that the pro�isions contained in this Agpendix apply specifically to the permaneat personnel reductions which occur on January 29, I982. It is further agreed that if a d3.spute arises concerning provisions contained in this Appendix and the matter is submitted to arbitration, the arbitrator niay consider only those provisions contained zn this Appendix and nay not make a determina.tion based upon other provisions o£ this contract.
