1 WHEREAS, the Swift Rail Act, passed by Congress in 1994, requires that trains sound horns
2 at all grade crossings, and
3
4 WHEREAS, the United States Secretary of Transportation is expected in late 1999 to issue a
5 Notice of Proposed Rulemaking for implementation of the Swift Act, and
6
7 WHEREAS, this rule will take effect two years after being finalized, and
8
9 WHEREAS, the rule implementing the Swift Act is expected to supercede Saint Paul's
10 ordinance governing train whistles, and
11
12 WHEREAS, Saint Paul has 41 at-grade railroad crossings, and
13
14 WHEREAS, train horns have been a major irritation to Saint Paul residents, now, therefore,
15 be it
16 RESOLVED, that the Saint Paul City Council hereby supports the following position as stated
17 in proposed Federal Rule Number 1999-6439 allowing a state or local government to create a
18 quiet zone without the need for Supplementary Safety Measures or Alternative Safety Measures if
19 the following requirements are met:
20
21 1) Train speed does not exceed 15 miles per hour;
22
23 2) Train travels between traffic lanes of a public street or on an essentially parallel course
24 within 30 feet of the street;
25
26 3) Signs are posted at every grade crossing indicating that locomotive horns do not sound;
27
28 4) Unless the railroad is actually situated on the surface ot a public street, traffic on all
29 crossing streets is controlled by STOP signs or traffic lights which are interconnected
30 with automatic crossing warning deviCes; And
31
32 5) The locomotive bell wiil ring when approaching and traveling through the crossing,
33
34 AND BE IT FURTHER RESOLVED, that the Saint Paul City Council hereby adopts the
35 following position with respect to Federal Rule Number 1999-6439:

1) That the federal government provide financial assistance to states and municipa{ities
for capital +mprovements necessary to comply with the standards for the establishment
of a train horn quiet zone, and
2) That the effective deadline for physical changes necessary to meet quiet zone
standards be extended for those municipalities that have begun a planning or
construction process to make these changes, and be it further
44 RESOLVED, that the Council requests that this position be expressed to the Secretary of
45 Transportation during the public comment period on Federal Rule Number 1999-6439.

INITIATING PROBLEM, ISSUE, OPPORTUNlIY (WHO, MHA7, WHEN, WHERE, WHY).
In 1994, Congress passed the Swift Rail Development Act which directed the Federal Railroad
Administration (FRA) to issue a rule requiring the use of train horns at all public rail crossings. This rule
would supercede Saint Paul's current ordinance goveming train whistles. The result would be many
areas of the city would have to endure the constant sounding of locomotive horns.
ADVANTAGESIFAPPROVED:
The Resolution supports portions of the proposed Federal rufe which are in the best interests of Saint
Paul (higher thresholds for horn sounding), requests financial assistance for train horn quiet zones and
extending deadlines for quiet zone compliance.
DISADVANfAGESIF APPROVED:
None.
