1 WEIEREAS, the City of Saint Pau1 recognizes the Mississippi River and its envixons as
2 the most significant natural resource in the City, and
3 WFIEREAS, City, while further recognizing that the Mississippi is a working river with
4 its attendant commercial-industrial uses, has also made a commitment to acquiring, developing
5 and restoring many areas along the river for preservation and public recreation purposes, and
6 WHEREAS, the Lower Phalen Creek area encompasses the lands below the river bluffs
7 along Mounds Blvd, from East 7ih Street (Swede Hollow) to Indian Mounds Park, and
8 WHEREAS, the City wishes to acquire certain vacant properties located in the Lower
9 Phalen Creek azea for public purposes, and
10 WHEREAS, the lazgest and most critical parcel in the Lower Phalen Creek area is a 25
11 acre parcel owned by the Buriington Northern Santa Fe Railroad (BNSF), as shown on the
12 attached map, and
13 WHEREAS, the BNSF has indicated that it is a willing seller, and
14 WHEREAS, the State of Minnesota Department of Natural Resources, through its Metro
15 Greenways Program, has allocated $600,000.00 to assist in the purchase of said BNSF property,
16 said $600,000.00 to be utilized in the form of a DNR-purchased conservation easement over all
17 ar part of the BNSF property, and
18 WHEREAS, the Dayton's Bluff Community, the Upper Swede Hollow Neighborhoods
19 Association, the East Side Neighbarhood Development Co., the Lowertown Redevelopment
20 Corp., the Capital River Council and many others have been working informally with City staff,
21 the DNR and the Trust for Public Land to ensure preservation of the BNSF property.
22 NOW THEREFORE BE IT RESOLVED, by the Council of the City of Saint Paul, that
23 the City hereby requests and concurs with the participation of the Trust for Public Land in the
24 acquisition of the BNSF property in the Lower Phalen Creek asea, and
25 FURTHER RESOLVED, that the proper City officials are hereby authorized to enter into
26 and participate with the Trust for Public Land in the negotiations for said BNSF property, and

27 FINALLY, that subject to further review and approval by the Council as to project
28 funding, the terms and conditions of the DNR conservation easement and any purchase

The City, the Dayton's Bluff Community, Upper Swede Hollow Neighborhood Assoc., ESNDC, Lowertown
Redevelopment Corp., Capital River Council, DNR, the Trust for Public Land and many others have been working
together informally to ensure preservation ot a 25 acre parcel of Burlington Northern Santa Fe Railroad property in the
Lower Phalen Creek area. The DNR has allocated 5600,000.00 toward this effort from the Metro Greenways Program.
The purpose of this resolution is to formally acknowledge the City's support for these efforts and to establish, in
general, conditions to be met for the City to take ownership of the parcel. ,
