00-477�� ����� RESOLUTION council File # 00 � KRR Green Sheet # 1 �271 �__ __ - - �%� ` ���TY� O�F SAINT PAUL, MINNESOTA � Presented By Referred To Committee: Date `� � WHEREAS, The City of Saint Paul has requested that the Department of Transportation grant a variance from 2 the State's standards for parking on CASE AVENUE (MSAS 115) between Duchess Street and Forest Street; and 3 4 WHEREAS, the City of Saint Paul requested a variance to allow parking on the south side of Case Avenue 5 beiween Duchess Street and Forest Street on Sundays beiween 6:00 A.M. and 1:00 P.M.; and 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 WHEREAS, The Commissioner of the Department of Transportation has notified the City that the request for variance has been granted upon condition that the City of Saint Paul adopt a resolution indemnifying, saving and holding harmless the State of Minnesota from any claims arising out of the granting of this variance; and WHEREAS, the City has no other option available to it to receive the variance requested unless it complies with the demand of the Commissioner of tfie Department of Transportation; now, therefore, be it RESOLVED, That as the sole condition of receiving a variance from the provisions of State Aid Rules Section 8820.9936, the Council of the City of Saint Paul does hereby agree to indemnify, save and hold harmless the State of Minnesota and its agents and empfoyees of and from any and all ciaims, demands, actions, or causes of action arising out of or by reason of the parking change of Municipal State Aid Street 115 (Case Avenue) located between Duchess Street and Forest Street in any other manner than as in accordance with Minnesota Rules 8820.9936 and further agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of whatsoever character arising as a result of the granting of this variance. The State requires that a hoid harmless resolution be approved as part of Yne variance process. ADVANTAGESIFAPPROVE�. The State of Minnesota will not revoke the variances which permitted the parking. A variance wili alleviate a shortage of parking spaces for the Holy Trinity Orthodox Church on Sundays. Approximately 10-12 parking spaces will be created.
