RESOLVED� that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to Thomas Devine the sum of $1,077.13
in full settlement of his claim for dama.ges sustained Ma.y 18,
1981, as a result of an accident with a City owned vehicle at
or near Shepard Road and Wilkin.

RE: Claim against the City of Saint Paul
by Thomas Devine
On Ma.y 18 , 1981, a Public Works warning truck became involved
in a collision with a car driven by Thoma.s Devine. The accident
occurred on Shepard Road near Wilkin. T'he Public Works truck
was in the process of ma.king a lefthand turn at the time tha.t
the vehicles collided. According to the plaintiff, the Public
Works truck was ma.king its turn from the righthand lane. This
is the version that was given to the police officer at the scene.
However, the Public Works driver later advised us that he was
ma.king his turn from a lefthand lane and the other car was in
the process of passing him on the wrong side of the street.
Due to the fact that a different version was given to the officer
at the scene it was felt that a settlement of some portion
of plaintiff;s damages would be advisable. Therefore, the case
was settled for 70% of plaintiff's damages or $1,077. 13.
