That Section 331.01 of the St. Paul Legislative Code is hereby amended as follows : "331.01. License required; exceptions. No person shall operate a food establishment as defined in Section 331.07 within the corporate limits of the city of Saint Paul for the purpose of dealing in or selling food for human consuu��aaption without first obtaining a license. This chapter shall not apply �e-�l�e-g�.b��e-�e.�l�e�-e� to Chapter 341 of this code dealing with milk and milk products." Section 2. This ordinance shall take effect and be in force thirty (30) days from and after its passage, approval and publication. Cox, Director of Environmental Health RE: Food Ordinance . ACTION REQUESTED: Amend Section 331.01, Food Code. Deleting that portion of Section 331.01 which exempts the public market from the provisions of the Food Code. PURPOSE AND RATIONALE FOR THIS ACTION: Section 7.04(1), Administrative Code, states t at the Division of Public Health . : , "shall be responsible for . . , inspection of all food handling facilities as they relate to health and-sanitation matters. " Zhe Division has a duty to inspect food handling facilities at the City Market, and failure to inspect at all or conducting an inspection in negligent manner, exposes the City to potential claims liability. Chapter 11, Legislative Code, conferred upon the Health Departa►ent a right to inspect even though Section 331.01 exempted the City Market. When the market was City owned it was proper to exempt it from licensiag requirements and procedures. Now the market is leased to a private entity for private gain. If the City exempts one private market from licensing and food handling stan- dards, then arguably all others should be exempt. The City now has a duty to it�spect, yet may not require adherence to food handling standards through the licensing process.
