You have before you this mor_ning a matter of licensing TZr.
Gerald Born to operate tY�e llu�ch 13ar located at &99 Rice Street.
I would like to give you some background information on the licensing
of this bar.

` left outside during the day, loud music and excessive noise after

In September and October of 1980 the District Council held two
meetin�s vrith neighborhood people concerning these problems, at that
time Nir. Born agreed to the following things:
1 . To hurry people off the premises after closing,
2. To install a fense screening the yard area from the street
3. To direct staff to clean the outside area each day.
The next summer, June of 1g81 the District Council again began
to recieve complaints. T�Tany of these complaints involved the
illegal construction of an outdoor serving area, and excessive noise
connected with serving outside. On NTarch 4, �982 the District Council
asked the �t. ��aul City Council to delay action on the renewal of •
the license until these complaints could be discussed with Mr. Born.

1 . drop th� live music license

of breaking his agreement with the �istrict Planning Council only
three months after it was made.
P�r. Born's track record indicates either an unwillingness or
an inability to correct the serious nature of the problems experienced
by his neighbors as a result of his business.
If you grant an outdoor serving license to Mr. Born the
District Six Planning Council will keep records of the complaints
recieved and the incidents involving Nir. Born's clientele. That
information will be made available to you when the license is next
due for renewal.
Perhaps three strikes will be enough.
