WHEREAS, 411 Sherburne Avenue is a vacant residential property in the Thomas Dale,
District 7 area which the owner abandoned in 1997 and who cannot be reached to make a
decision regarding subject property; and
WI-IEREAS, the structure at this address had been vacant for several years, was in
disrepair and a blight to the neighborhood; and
WHEREAS, The Citizen Service Office, Division of Code Enforcement, Vacant/Nuisance
Building Unit inspected the single family home and found over 25 dePiciencies in their
October 29, 1999 abatement report; and
WHEREAS, The Vacant/Nuisance Building Unit declared the building constituted a
"nuisance" as defined by Legislative Code, Chapter 45, and scheduled a public hearing
and passed a resolution on February 23, 2000 ordering the repair or removal of the
nuisance building; and
WHEREAS, On April 12, 2000, the Vacant/NUisance Building Unit had the single family home
at 411 Sherburne Avenue demolished and removed, accruing assessments in excess of
$10,400; and
WI-IEREAS, the City of Saint Paul recognizes the problems created by vacant properties in
its neighborhoods, and also recognizes the need to take the initiative to develop the
properties with safe, decent and affordable housing; and
WHEREAS, the Minnesota State Legislature in 1987 adopted the Urban Revitalization Action
Program (URAP) funded through a 1967 state initiative and matched by City resources to
revitalize inner city neighborhoods to ensure a strong and improving future for those
neighborhoods that are most distressed by physical deterioration and lack of economic
opportunity; and
WHEREAS, the City Council did approve on June 23, 1992 by Resolution No.92-838 certain
activities and financing under the Sherburne Initiative URAP proposal which includes
acquisition, rehabilitation, new development, and clearance of blighting conditions in
the area; and
WHEREAS, the Sherburne Initiative area is targeted by Habitat for Humanity for
redevelopment of single family houses under the Replacement Single Family New
Construction Program; and
WHEREAS, the current property owner has unpaid taxes with the Ramsey County Tax
Department in the amount of $4,447.52 plus interest and penalty which is currently in
default since 1997; and
WHEREAS, the current property has accrued approximately $11,600.42 in assessments; and

46 WHEREAS, staff had the property appraised on February 2, 2000, which showed an estimated
47 value of $5,000; and

49 WHEREAS, the Housing and Redevelopment Authority recognizes the need for a continuous
50 commitment from the City to work with non-profit and for-profit developers in an effort
51 to reduce the blighting effect of vacant residential properties in the City's
52 neighborhoods by expanding home ownership opportunities, stabilizing neighborhoods and
53 increasing the City's tax base; and
54
55 WHEREAS, under Chapter 469 of the Minnesota Statutes, the Housing and Redevelopment
56 Authority of the City of Saint Paul, Minnesota, is authorized to engage in activities
57 relating to:
58
59 1_ Housing projects and development (especially for low and moderate income people);
60
61 2. Removal of or prevention of the spread of conditions of blight or deterioration;
62
63 3. Bringing substandard buildings and improvements into compliance with public
64 standards;
65
66 4. Disposition of land for private development; and
67
68 5. Improving the tax base and financial stability of the community, and engaging in the
69 aforementioned activities when these needs cannot be met through reliance solely upon
70 private initiative and which can also be undertaken in targeted neighborhoods; and
71
72 WHEREAS, Minnesota Statutes Chapter 469 gives the HRA a specific range of powers
73 including the power to acquire land by the exercise of the power of eminent domain, sell
74 land, engage in planning, employ a variety of financing instruments, and establish land
75 use controls; and
76
77 WHEREAS, the HRA Board of Commissioners in its Resolution No. 00-3/22-2 did approve for
78 acquisition Parcel 411 Sherburne Ave. under the Single Family Replacement Program; and
79
80 WHEREAS, the HI2A has been unable to acquire the property due to fact that the owner
81 cannot be reached to make a decision regarding subject property; and
82
83 WHEREAS, eminent domain will be necessary for acquisition, also a ninety (90) day quick
84 take will be necessary in order to secure timely possession of the property; and
85
86 WHEREAS, on May 10, 2000, the City Council conducted a public hearing on the proposed
87 acquisition in order that the property owner or representatives may attend and indicate
88 his/her opposition or support for this proposed acquisition.

90 NOW TAEREFORE, BE IT RESOLVED by the Council of the City of Saint Paul in view of the
91 foregoing hereby adopted as findings that the public acquisition by the Housing and
92 Redevelopment Authority of the City of Saint Paul, Minnesota (HRA) of the property
93 identified as follows:

95 411 Sherburne Avenue -Lot 38, Block 16, Smith's Subdivision of Blocks 9, 10, 15,
96 and 16 to the City of St. Paul, according to the recorded plat thereof, and situate
97 in Ramsey County, Minnesota;

99 is hereby approved in accordance with the following:

101 1. The City Wide Redevelopment Plan together with Minnesota Statutes 469.012 subd. 1(6)
102 and (7), which includes acquisition, clearance or rehabilitation of blighting conditions
103 to allow for housing for low/moderate income families together with acquisition,
104 demolition or rehabilitation providing improvements to afford maximum opportunity, is
105 consistent with the sound needs of the community as a whole and provides economic
106 stability for the area, and said property is being purchased in accordance therewith.

108 2. That, in accordance with the Housing and Community Development Act of 1974 and
109Minnesota Statutes 117.52, the HI2A shall provide all relocation assistance services,
110 payments and benefits required by the Uniform Relocation Assistance and Real Property
111Acquisition Policies Act of 1970 as amended, if any, in connection with the acquisition
112 of said property.

1143. 2'hat acquisition of the above described property is hereby approved to be undertaken
115 by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, by the
116 exercise of the power of eminent domain including use of quick take. Any actions
117 previously taken by the FIRA in this regard are hereby ratified and affirmed.

119 4. That pursuant to Chapter 548, Laws of Minnesota 1984, it is hereby certified that
120 said property meets the conditions of Minnesota Statutes Section 272.02, Subd. 1(7) and
121 469.040, Subd. 1 and is exempt from property taxes until sold for private redevelopment.

Enclosed for your review please find a copy of the resolution to acqxire the property at 411
Sherburne Avenue by direct purchase or exercise of the power of eminent domain and quick-
take, subject to a Public Hearing on May 10, 2000 before the Saint Paul City Council. The
original Resolution is being routed for signatures.
The Fee Owner, James R. Justice has abandoned the property and cannot be reached to make a
decision.
The single family home at 4ll Sherbume was declared a"nuisance" property as defined by
Legislative Code, Chapter 45, and at a scheduled a public hearing on February 23, a resolution
was passed ordering the repair or removal of the nuisance building. The Citizen Service Office,
Division of Code Enforcement, Vacant(Nuisance Building Unit had the house demolished and
removed on April 12, 2000.
Habitat for Humanity would like to develop the property when it becomes available. HRA
resolution 00-3/22-2 seeking authorization to acquire this properiy under the Replacement Single
Family New Construction Program, Thomas-Dale District 7 was approved by the HRA Board of
Commissioners.
The properry is in taac farfeiture. The last record of payment of taxes was in 1997.
Staff recommends that acquisirion of 411 Sherburne Avenue be approved by direct purchase or
exercise of the power of eminent domain and quick-take, subject to a Public Hearing before the
Saint Paul City Council.

73 including the power to acquire land by the exercise of the power of eminent domain, sell
74 land, engage in planning, employ a variety of financing instruments, and establish land

77 WHEREAS, the HRA Board of Commissioners in its Resolution No. 00-3/22-2 did approve for
78 acquisition Parcel 411 Sherburne Ave. under the Single Family Replacement Program; and

80 WHEREAS, the HI2A has been unable to acquire the property due to fact that the owner
81 cannot be reached to make a decision regarding subject property; and

83 WHEREAS, eminent domain will be necessary for acquisition, also a ninety (90) day quick
84 take will be necessary in order to secure timely possession of the property; and

86 WHEREAS, on May 10, 2000, the City Council conducted a public hearing on the proposed
87 acquisition in order that the property owner or representatives may attend and indicate
88 his/her opposition or support for this proposed acquisition.

90 NOW TAEREFORE, BE IT RESOLVED by the Council of the City of Saint Paul in view of the
91 foregoing hereby adopted as findings that the public acquisition by the Housing and
92 Redevelopment Authority of the City of Saint Paul, Minnesota (HRA) of the property
93 identified as follows:

95 411 Sherburne Avenue -Lot 38, Block 16, Smith's Subdivision of Blocks 9, 10, 15,
96 and 16 to the City of St. Paul, according to the recorded plat thereof, and situate
97 in Ramsey County, Minnesota;

101 1. The City Wide Redevelopment Plan together with Minnesota Statutes 469.012 subd. 1(6)
102 and (7), which includes acquisition, clearance or rehabilitation of blighting conditions
103 to allow for housing for low/moderate income families together with acquisition,
104 demolition or rehabilitation providing improvements to afford maximum opportunity, is
105 consistent with the sound needs of the community as a whole and provides economic
106 stability for the area, and said property is being purchased in accordance therewith.

108 2. That, in accordance with the Housing and Community Development Act of 1974 and
109Minnesota Statutes 117.52, the HI2A shall provide all relocation assistance services,
110 payments and benefits required by the Uniform Relocation Assistance and Real Property

112 of said property.

1143. 2'hat acquisition of the above described property is hereby approved to be undertaken
115 by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, by the
116 exercise of the power of eminent domain including use of quick take. Any actions
117 previously taken by the FIRA in this regard are hereby ratified and affirmed.

119 4. That pursuant to Chapter 548, Laws of Minnesota 1984, it is hereby certified that

Enclosed for your review please find a copy of the resolution to acqxire the property at 411
Sherburne Avenue by direct purchase or exercise of the power of eminent domain and quick-
take, subject to a Public Hearing on May 10, 2000 before the Saint Paul City Council. The
original Resolution is being routed for signatures.
The Fee Owner, James R. Justice has abandoned the property and cannot be reached to make a
decision.
The single family home at 4ll Sherbume was declared a"nuisance" property as defined by
Legislative Code, Chapter 45, and at a scheduled a public hearing on February 23, a resolution
was passed ordering the repair or removal of the nuisance building. The Citizen Service Office,
Division of Code Enforcement, Vacant(Nuisance Building Unit had the house demolished and
removed on April 12, 2000.
Habitat for Humanity would like to develop the property when it becomes available. HRA
resolution 00-3/22-2 seeking authorization to acquire this properiy under the Replacement Single
Family New Construction Program, Thomas-Dale District 7 was approved by the HRA Board of
Commissioners.
The properry is in taac farfeiture. The last record of payment of taxes was in 1997.
Staff recommends that acquisirion of 411 Sherburne Avenue be approved by direct purchase or
exercise of the power of eminent domain and quick-take, subject to a Public Hearing before the
Saint Paul City Council.
