City of St. Paul Plaintiff, Richard Marose, was bitten by a dog on February 4, 1980 at 1879 Carroll Avenue, St. Paul. He sued both the owner of the dog and the City. He alleged that the City knew the dog was dangerous , which it did. It ha.d been found to be dangerous under the procedures set forth in Section 200.12 of the Legislative Code. In addition, plaintiff alleged tha.t the City did not do all it could to have the dog removed from the City. In fact, when it was learned that the dog was back in the City, the owner was tagged.
