RESOLVED, tha.t upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-S11-Q00 to Richard Marose the svm of
$2,500.00 in full settlement of his claim for damages and
injuries sustained February 4� 1980, as a result of a dog
bite at or near 1879 Earroll Avenue, Saint Paul.

RE: Richard Marose v. City of St. Paul
Plaintiff, Richard Marose, was bitten by a dog on February 4,
1980 at 1879 Carroll Avenue, St. Paul. He sued both the owner
of the dog and the City. He alleged that the City knew the dog
was dangerous , which it did. It ha.d been found to be dangerous
under the procedures set forth in Section 200.12 of the Legislative
Code.
In addition, plaintiff alleged tha.t the City did not do all it
could to have the dog removed from the City. In fact, when
it was learned that the dog was back in the City, the owner
was tagged.
This off ice approves the settlement of this lawsuit in the amount
of $2,500.
