i WHEREAS, the City of Saint Paul has sponsored a family ice fishing event for a
2 number of years, and is planning such an event for February 5, 2000, at Round Lake, located
s in the City of Maplewood, Raznsey County; and
4 WFIEREAS, the Ramsey County Sheriff's Office has jurisdiction over the County's
5 lakes and waters, and is willing to permit the use of Round Lake for such an event on the
6 condifion that the City of Saint Paul indemnify and hold harmless the County; and

WHEREAS, the Saint Paul City Council finds that a family ice fishing event has a
legidmate public purpose; and
WHEREAS, the expenditure of public funds, which includes the promise of
indemnificadon and defense, for such a puipose will facilitate and enable the event to take
place; now, therefore, be it
FURTHER RFSOLVED, that the foregoing defense and indemnification does not
cover:
1) any occurrences or events which aze not part of the ice-fishing event and which
do not occur or take place at Round Lake during the course of the event.
2) injuries or damages which arise from hidden traps or conditions existing on the
grounds surrounding Round Lake of which the county had actual or construcfive nodce.

3) injuries which arise out of criminal actions, assaults, batteries or other acts of p0 - �� O
violence committed by any person or persons; and be it
FURT'HER RESOLVED, that nothing in the foregoing provisions shall be construed as
a waiver of the municipal tort liability limits set forth in Minn. Stat. S466.01 et seq.
