The basis for the adverse action is as foliows: On February 1, 2000 you signed conditions to be placed on your license, one of which was that there would be a metal detector used. All customers are to be checked grior to entry and reentry, without exception. On Rebrnary 11, 2000, the Saint Paul police conducted a premise check at your establishment, and observed that no metal detectors were being used. The police spoke to you and to the head of security for the bar, and were told that one of the two metal detectors was broken and the other was missing. They watched as people went inside the bar and noted that about every third male entering the premises was being pat searched and no females entering were being searched. Saint Paul Legislative Code §310.06(b)(5) permits adverse action against a license when the licensee has failed to comply with conditions set forth on the license. The matter wiil then be scheduled for a public hearing before the St. Paul City Council to determine what penalty, if any, to impose. You will have an opportunity to appear and speak on your own behalf, or to have someone appear there for you. On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary hearing before an Administrative Law Judge (AL.�. If you wish to have such a heazin�, please send me a letter stating that you aze contesting the facts. You will then be sent a"Notice of Heazing," so you will know when and where to appear, and what the basis for the hearing wi11 be. In either case, please let me know in writing no later than Monday, April 3, 2000, how you would like to proceed. Saint Paul Legislative Code §310.06(b)(5) permits adverse action against a license when the licensee has failed to comply with conditions set forth on the license. The basis for the adverse action is as foliows: On February 1, 2000 you signed conditions to be placed on your license, one of which was that there would be a metal detector used. All customers are to be checked grior to entry and reentry, without exception. On Rebrnary 11, 2000, the Saint Paul police conducted a premise check at your establishment, and observed that no metal detectors were being used. The police spoke to you and to the head of security for the bar, and were told that one of the two metal detectors was broken and the other was missing. They watched as people went inside the bar and noted that about every third male entering the premises was being pat searched and no females entering were being searched. Saint Paul Legislative Code §310.06(b)(5) permits adverse action against a license when the licensee has failed to comply with conditions set forth on the license. The matter wiil then be scheduled for a public hearing before the St. Paul City Council to determine what penalty, if any, to impose. On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary hearing before an Administrative Law Judge (AL.�. If you wish to have such a heazin�, please send me a letter stating that you aze contesting the facts. You will then be sent a"Notice of Heazing," so you will know when and where to appear, and what the basis for the hearing wi11 be. In either case, please let me know in writing no later than Monday, April 3, 2000, how you would like to proceed.
