William Donovan Valuation and Assessment Engineer Date : �anuary 8, 1982 Subject: Petition of Theresa Schema and Louis Shields for the vacation of a portion of Riverview Avenue. Public Hearing - February 16, 1982 The petitioners, Theresa Schema and Louis Shields, being the only abutting property owners to the proposed vacation area request this vacation in order to clear the tities to their properties. They have recently dis- covered that their garages were built on the Riverview Right-of-Way by the previous owners. They were told that the street had been vacated at the time they purchased their properties in the 1930's. The vacation of this portinn of Riverview Avenue will help clear up this improper situation and make the titles to the properties marketable. That part of Riverview Avenue proposed for vacation consists of 7,779 square feet and is zoned R-�+ (single f�mily residential), Northern States Pav�er Compar�y has poles and secondary wires in the proposed vacation area and they request that their interest be protected. There were no objections, recommendations or restxictions received �rom any City department or utility compar�y in response to �y letter of inquiry sent them on November 17, 1981. In view of the foregoing, I recommend that the vacation be approved subject to the iollowing terms and condi�ions: l. That the description of the portion of said street to be vacated be described as follows; All that part of Riverview Avenue lying South of a line drawn from the northwest corner of Lot 12, Block 11 to the northeast corner of Lot 21, Blocx 10, and which lies north of a Iine drawn from the southwe�t corner of Lot 12, Block 11 to the southeast corner of Loti 21, Block 10, all in the West St. Paul Real Estate and Improve- ment Syndicate Addition No. l. /.� That the vacation be subject to all the terms and conditions of Chapter 130, codified March l, Zg8? of the St. Paul � Legislative Code, as amended. - f�''18�59 -2- ,�,�!� That a specific easement be retained to protect the interests of Northern States pc�wer Compar�y within said portion of Riverview Avenue. �-s,,,1+.
