Christine Rozek reported this applicant is looking for an original container, cigazette/tobacco, and liquor off sale licenses. An original container license allows someone to sell items to eat off the premise in their original container, such as potato chips. Fire and zoning haue approved this application. Bnvironmental Health has not approved it yet, but that is pending a final inspecrion after the business opens. License has approved this application pending liquor liability insurance, which is not needed until the store is ready to open. At this point, there are no suggested conditions for this license application. Gerry Strathman stated a number of the letters raise the issue of two other establishments nearby. He asked is there anything that limits the number ar location of liquar establishments. Ms. Rozek responded the licensing code does not a11ow two liquor establishments that are off sale to be within'/z mile of each other. There is not another one within half a mile. The complainants may be refening to on-sale liquor establishments that aze nearby. Roger Schaefer, 1105 Hudson Road, appeared and stated he is within a block of the establishment and is on the District 4 Community Council, but he is not speaking on behalf of the Council. He and another resident petifioned the neighborhood regazding this business. He collected 25 signatures. This pefition was presented to the community council, who voted to oppose this license application. There aze aiready two liquor establishments in the neighborhood. Now that one liquor establishment is gone, the traffic has gone down and there is not as much trash. He and another neighbor periodically clean up the trash in the neighborhood, which is generated from the patrons that visit bazs. They are also concerned about parking. Mr. Strathman asked about the tr�c concerns. Mr. Schaefer responded he has a11ey parking so he does not use the street. When bands play, parking builds up on the weekends. There was a lot of problems with Johnson Liquor Store (which has since closed): tr�c in the alley and in the street, rush traffic toward the end of sale hours, foot traffic, and drinkiug once they aze out of the store. Mr. Schaefer responded the petirion reads as follows: I the undersigned oppose the applicarion for liquor off sale, cigazette/tobacco, and original container licenses for 1047 Hudson Road by Paul Damico, dba Comer Liquors, per LIEP License Number 20000000470 as noted in the license of application notice dated 2-28-2000. There were 25 signatures and Mr. Schaefer went to about 50 homes. Some people were not available or not answering. Four people wouid not sign, of which one or two said they would like to have the business. SiY had no comments. Mr. Strathman stated he received the following correspondence: Luella Heroff, 1037 Hudson Road, wrote about two liquor establishxnents in a one block radius, debris, noise; John Vaughn, Community Organizer, Dayton's Bluff District 4 Community Council, 281 Maria Avenue, wrote about this business being deleterious to the neighborhood and suggested conditions to be placed on the license; Ella Wilsey, 1035 Wakefield, wrote about traffic, noise, more cazs and people; Mr. and Mrs. Michael Ryan, 1055 Wakefield Avenue, wrote about two bars within two blocks, parking, foot traffic, trash; Gina M. Steele, 1087 Hudson Road, wrote about two bars within two blocks, trash, traffic; and another letter from John Vaughn regarding a flyer that came to his attention. (Mr. Schaefer added he was there when Mr. Vaughn found this flyer. It looked well worn from being in the weather a few days.} Paul Damico, owner, and Mark Ubel, appeared. Mr. Ubel stated one of their goals is to not make this business a heightened level of traffic and trash. He contacted John Vaughn and Jim Urchel from Dayton's Bluff Housing about trash receptacles. Hudson Road is alongside the I-94 freeway and the exit ramp is closed. The only exit ramp is Suburban Avenue and Mound Park Boulevard. The amount of traffic has been reduced significantly. Johnson Liquor closed February 1 and is two blocks away. There are many vacant store fronts. They aze trying to treat this business on a low scale venture. How will the business be operated, asked Mr. Strathman. Mr. Ubel responded it is tough to compete with MGM and Johnson Brothers Liquars which are huge buildings. Corner Liquors has US of their squaze £ootage. Corner Liquors is there for people that want to patronize the business. For those that don't paironize, hopefully the business will not interrupt their daily life. Mr. Strattunan asked is it a delicatessen. Mr. Ubel responded they aze working with food products. Paul Damico stated the store will not draw any more traffic than they already ha�e for the simple reason that their prices wi11 not be able to compete with the big stores. It is obvious that there are a significant number of people who are concemed that this business wiil have a negative or blighting effect on the neighborhood. Christine Rozek reported this applicant is looking for an original container, cigazette/tobacco, and liquor off sale licenses. An original container license allows someone to sell items to eat off the premise in their original container, such as potato chips. Fire and zoning haue approved this application. Bnvironmental Health has not approved it yet, but that is pending a final inspecrion after the business opens. License has approved this application pending liquor liability insurance, which is not needed until the store is ready to open. At this point, there are no suggested conditions for this license application. Gerry Strathman stated a number of the letters raise the issue of two other establishments nearby. He asked is there anything that limits the number ar location of liquar establishments. Ms. Rozek responded the licensing code does not a11ow two liquor establishments that are off sale to be within'/z mile of each other. There is not another one within half a mile. The complainants may be refening to on-sale liquor establishments that aze nearby. Roger Schaefer, 1105 Hudson Road, appeared and stated he is within a block of the establishment and is on the District 4 Community Council, but he is not speaking on behalf of the Council. He and another resident petifioned the neighborhood regazding this business. He collected 25 signatures. This pefition was presented to the community council, who voted to oppose this license application. There aze aiready two liquor establishments in the neighborhood. Now that one liquor establishment is gone, the traffic has gone down and there is not as much trash. He and another neighbor periodically clean up the trash in the neighborhood, which is generated from the patrons that visit bazs. They are also concerned about parking. Mr. Strathman asked about the tr�c concerns. Mr. Schaefer responded he has a11ey parking so he does not use the street. When bands play, parking builds up on the weekends. There was a lot of problems with Johnson Liquor Store (which has since closed): tr�c in the alley and in the street, rush traffic toward the end of sale hours, foot traffic, and drinkiug once they aze out of the store. The East Side is picking up little by littie, but the liquor establishments do not contribute toward that. oa -�t�4� CORNER LIQUORS, 1047 HLTDSON ROAD Page 2 Mr. Strathman asked how the petirion reads, how many signatures were obtained, and how may people were in favor of the business. Mr. Schaefer responded the petirion reads as follows: I the undersigned oppose the applicarion for liquor off sale, cigazette/tobacco, and original container licenses for 1047 Hudson Road by Paul Damico, dba Comer Liquors, per LIEP License Number 20000000470 as noted in the license of application notice dated 2-28-2000. There were 25 signatures and Mr. Schaefer went to about 50 homes. Some people were not available or not answering. Four people wouid not sign, of which one or two said they would like to have the business. SiY had no comments. Mr. Strathman stated he received the following correspondence: Luella Heroff, 1037 Hudson Road, wrote about two liquor establishxnents in a one block radius, debris, noise; John Vaughn, Community Organizer, Dayton's Bluff District 4 Community Council, 281 Maria Avenue, wrote about this business being deleterious to the neighborhood and suggested conditions to be placed on the license; Ella Wilsey, 1035 Wakefield, wrote about traffic, noise, more cazs and people; Mr. and Mrs. Michael Ryan, 1055 Wakefield Avenue, wrote about two bars within two blocks, parking, foot traffic, trash; Gina M. Steele, 1087 Hudson Road, wrote about two bars within two blocks, trash, traffic; and another letter from John Vaughn regarding a flyer that came to his attention. (Mr. Schaefer added he was there when Mr. Vaughn found this flyer. It looked well worn from being in the weather a few days.} Paul Damico, owner, and Mark Ubel, appeared. Mr. Ubel stated one of their goals is to not make this business a heightened level of traffic and trash. He contacted John Vaughn and Jim Urchel from Dayton's Bluff Housing about trash receptacles. Hudson Road is alongside the I-94 freeway and the exit ramp is closed. The only exit ramp is Suburban Avenue and Mound Park Boulevard. The amount of traffic has been reduced significantly. Johnson Liquor closed February 1 and is two blocks away. There are many vacant store fronts. They aze trying to treat this business on a low scale venture. How will the business be operated, asked Mr. Strathman. Mr. Ubel responded it is tough to compete with MGM and Johnson Brothers Liquars which are huge buildings. Corner Liquors has US of their squaze £ootage. Corner Liquors is there for people that want to patronize the business. For those that don't paironize, hopefully the business will not interrupt their daily life. Mr. Strattunan asked is it a delicatessen. Mr. Ubel responded they aze working with food products. Paul Damico stated the store will not draw any more traffic than they already ha�e for the simple reason that their prices wi11 not be able to compete with the big stores. If he knew he had to bring in a petifion, he could have brought in one with 500 names. Regarding letters received from the neighbors, Mr. Ubel stated, he tried to contact some of the people. In regards to the flyer, 1047 Hudson is also an apartment above Comer Liquors. The flyer has nothing to do with his estabiishment, and the person who wrote it was not familiaz with Oo-�{4� CORNER LIQUORS, 1047 HIJDSON ROAD Page 3 the azea and is not connected with the Tuscany Crrill. Mr. Ube1 went to a community meeting and tried to convey what his goals were for the business: keeping it simple and very low key. It will not really increase iraffic. Individuals will show up to patronize the business and other people will not see it as an issue. Mr. Damico stated he has been in that baz for five years and has hired someone on a regular basis to mow the lawn and clean the boulevard. The bar will do its fair share. Mr. Strattunan asked their reaction to the second proposal to not seli fortified wines, half pints, and forty ounce containers. Mr. Ubel responded they are not going to sell keg beer or returnable bottles. As for other Types of bottles and individuai containers, they do not want them if they are a deterrent from the business. They would take it upon themselves to elnninate it if they fmd an empty 40 ounce bottle in someone's yazd. Mr. Strathman stated it is generally believed that the sell of half pints attracts a particular type of clientele. Mr. Ubel responded he has not committed to any particular type of inventory at this tune. There aze two ways tlus can be handled, stated Mr. Strathman. It is obvious that there are a significant number of people who are concemed that this business wiil have a negative or blighting effect on the neighborhood. It seems there is enough ini6al evidence to forward this on to a formal hearing before an admnustrative law judge. Tkus is a di�cult and slow process. The other course of action is to recommend the license be granted with the conditions menrioned earliet: no sale of fortified wines, half pints, or forry ounce contaaners or quarts, malce every effort to control loitering and litter around the business. Mr. Ubel responded they will accept the conditions based on the fact that they are looking to open the business within the best interest. Gerry Strathman recommended the license application be approved with the following conditions: 1) Business owner will make all reasonable efforts to control litter in the azea and regularly pickup trash on the property; 2) No sale of 40 ounce containers of malt liquor; 3) No sale of single serve containers of malt liquor, nor sale of fortified wines, nor sale of half pints; and 4) Signage to be posted that loitering is discouraged.
