The minutes of the meeting of May 11 , 1982 , �,rere approved as distributed

Chairman Glassman reported that two cases on the agenda had been settled

BOARD ACTION : Mr. Tilton moved to deny a variance on Section 34. 14 ,
pertaining to the requirement of a ground fault interruptor, as designated
by the city' s letter of 5/14/82 . Mr. Knutson seconded. MOTION CARRIED

Chairman Glassman stated that another subject of b7r. Bruning' s appeal
concerned the rec{uirement of a deadbolt lock on the entrance door to an
apartment from a public hallway.
Mr. Bruning displayed a dead bolt lock assembly which he said was similar
to the one he had on the door in auestion, which he said the inspector
found to be deficient. He explained that it was a rear door.
BOARD ACTION: Chairman Glassman moved to grant a variance of Section 34. Q9 ,
pertaining to deadbolt locks , to permit continued use of door eauipped
with deadbolt lock which does not meet all specifications of code.
Mr. Sawyer seconded. MOTION CARRIED Alv'D SO ORDERED.
THE VOTE: Ayes - 6 Nays - 0 Abstentions - 0
Mr. Bruning said the inspector claimed that the kitchen sink in Unit #1
at 503 Como was not vented. Mr. Bruning said the inspector was in error,
that there was a vent.
Mr. Gausman pointed out that,whether or not there was presently a vent�
all that was required was that a vent be installed if and when the sink
or drain is replaced. .
Chairman Glassman stated that there was no need for board action under
the circumstances .
Concerning Items #31 and #32 in the inspector' s list , Mr. Bruning said
he felt there must be a mistake .
Jerry Kern agreed, conjecturing that at some time there must have been a
computer error. The items referred to storage of items and a require-
ment that the toilet stool be provided with an open seat, both of which
applied to public or commercial establishments , and this property con-
tained private dwelling units only. The storage item was a recommendation,
rather than a code violation.
BOARD ACTION: Mr. Tilton moved to grant a variance on Item #32 , pertain-
ing to a requirement that an open seat be provided for the stool in
Apt . #2 at 505 Como. Mr. Gausman seconded. MOTION CARRIED AND SO
ORDERED. .

with a self- closing device , and Mr. Bruning said he would install one .
BOARD ACTION: Mr. Knutson moved to grant a variance of Section 35. 03,
pertaining to smoke door self-closing devices , in regard to the �oor
between the storage-workshop room and the boiler room. Mr. Sawyer
seconded. MOTION CARRIED AND SO ORDERED.
THE VOTE: Ayes - 4 Nays - 2 (Tilton , Gausman) Abstentions - 0
Chairman Glassman clarified the intent of the motion , stating that the
board was waiving only the self-closing device while reQuiring that the
door be covered with the required sheet metal protection.
In regard to the fire sep aration requirements in the boiler area, Mr.
Bruning said a new boiler had been installed recently, was subsequently
inspected, and nothing had been said at that time about putting in S/8-inch
sheetrock above the boiler.
Jerry Kern pointed out that the letter appellant received recommended
that he rec{uest permission to install hard-wire smoke detectors in lieu
of fire-rated ceiling or sprinkling system. Mr. Bruning agreed to this
alternative .
BOARD ACTION: Mr. Tilton moved to grant a variance of Section 35 . 06 ,
pertaining to fire separation above the boiler area, on condition that
he obtain permission to install hard-wire smoke detectors in lieu of
fire-rated ceiling or sprinkling system. Mrs . Collins seconded. MOTION •
CARRIED AND SO ORDERED.
THE VOTE: Ayes - 6 Nays - 0 Abstentions - 0
Chairman Glassman then brought up the matter of Unit #2 in the 503 Como
section of the building, where the bathroom was located outside the walls .
From questioning Mr. Bruning, Chairman Glassman determined that, although
the bath was not within the walls , it was not shared with tenants of any
other apartment , it was located directly outside the unit , and it contained
all required facilities .
BOARD ACTION : Mr. Gausman moved that a variance of Section 34 . 11 be
grante to permit occupancy of Unit #2 at 503 Como where bathroom facilities
are located outside the walls . Mrs . Collins seconded. MOTION CARRIED
AND SO ORDERED.
THE VOTE: Ayes - 6 Nays - 0 Abstentions - 0
Mr. Bruning next objected to the reauirement of a ground fault interruptor
in the b athroom of Unit #1 at 505 Como, citing that this was not a violation
of the code at the �ime the building was erected, nor had the deficiency
ever been listed after previous Certificate of Occupancy inspections .
Mr. Knutson spoke of the importance of the requirement as a sa£ety factor.
He also mentioned that electrical codes have been upgraded periodically
over the years , often affecting existing construction as well as new in
order to provide greater safety to life .

to need for electrical outlet with ground fault interruptor, and Section

may .change. Appellant also contends Item #16 , lack of sink venting, is
in error, and Items #31 � #32 are not applicable because unit is used for
storage only, not as a dwelling unit.

PROCEEDINGS : Mr. Bruning stated that he was half-owner of the property.
In regard to the smoke door and self-closing device rec{uirement , the
particular door referred to by the inspector is kept barred and is not
meant to be used by anyone but himself. If the equipment in the boiler
room needs servicing , he is the only person w}io can admit another. The
door leads from his workwhop , which is private . There is a separate
laundry area used by the tenants , but admittance is t}irough another

In addition, the neighboring driveway is somewhat elevated' frorr the
east side , and he figured an 8 ft. fence on that side would create more
privacy for the people living in that half of the property. On the west
half, jahere Mr. Wendle lived, he estimated a distance of 10 or 12 ft .
from the neighborin g house , and his living c{uarters were somewhat elevated.
He judged that a 10 ft. fence �aould be needed there . He propose'd to erect
the fences just between the houses . Mr. Wendle said he had discussed his
plans with both immediate neighbors and they had not objected. Without
the fence heights he was requesting, it would be necessary to pu11 the
drapes closed to maintain privacy within the homes . His plans were to
install attractive redwood or cedar fencing.
BOARD ACTION: P•7r. Tilton moved to grant a variance on fence height to
permit installation of redwood or cedar fencing 8 ft . in height on the
east side and 10 ft. on the west side of the property, so long as the
fence d.oes not extend beyond the front or re ar lines of the house , and
on condition fihat the neighbors on either side have no objectiQn. Mr.
Gausman seconded.
Mr. Knutson asked to amend the motion with a restriction to no more than
a height of eight feet on eithex side , but after a discussion, withdrew
his amendment.
MOTION CARRIED AND SO ORDERED.

Mr. Tilton recommended to the appellant that he obtain written agreement
from both neighbors. •

SUBJECT: Request variance of Section 34. 11 , pertaining to basic facilities ,
to permit continued occupancy of units lacking vrivate bathrooms , because ,
of �conomic considerations and practical difficulty.

PROCEEDINGS : Mr. Masterman explained that three bathrooms were shared
y ten people , each the single occup ant of a dwelling unit that included
cooking facilities . There was a resident caretaker who was responsible
for keeping each shared bathroom clean. He has oiJned the building for
about two and one-half years and has made many improvements , updating
the electrical service , reroofing, replacing bathroom carpeting with
linoleum, and extensive repainting. The taxes increased the past year
from $1, 800 to $4 ,500 , which meant he would have to increase rents an
average of $17 per unit. His tenants were mostly elderly persons and
students at the nearby Vo-Tech school , so if it became necessary to put -
in bathrooms in each unit , rents would have to be further increased to
a point beyond their ability to pay.
Jerry Kern said he was more concerned that 13 units were being operated
in a building listed as a 12-unit complex than he was with the shared
bath situation. This was a matter that should be cleared up �,rith
zoning authorities .
BOARD ACTION: Mr. Tilton moved to grant a variance of Section 34. 11 ,
to permit occupancy of 10 units sharing use of three bathroom facilities ,
on condition that no more than four persons share use of one bathroom

SUBJECT: ReQuest variance of Section 34. 17, pertaining to roominghouses ,
to p rmie t sharing of four bathroom facilities between 23 residents ,
because of economic hardship if rec{uired to reduce number of units .

PROCEEDINGS: Mr. Cortright explained that the building had been run as
a Tiotel unti� recently. To improve the nature of the building and the
tenancy, the owner had made substantial improvements and had instigated
a policy of aggressively screening prospective tenants to insure a more
stable type of resident. It was felt that changing to a roomir�g house
woulcl attract good tenants , but there was a deficiency of one bathroom
under roominghouse requirements . There was a caretaker on the premises
and a cleaning woman was employed to maintain sanitary conditions in the
shared b ath facilities .
Chairman Glassman noted that there did not appear to be a representative
of the Public Health Dept. present , and asked the secretary to call the
age�.cy. The secretary returned to report that Don Miller, of the Health
Dept . , was on his way.
Chairman Glassman suspended the hearing temporarily, pending the arrival
of Mr. Miller, an a proceeded to another case .

Afte r a review of the prior discussion by the chairman , Mr. Miller stated
that he had riot personally inspected the raominghouse because he had
been newly assigned to this type of accommodation insnection. He ��ould
therefore rely on the previous inspector' s re�ort. With four bathrooms
provided for 23 residents , there was no auestion that the house was de-
ficient urider the code and reQuired one additional facility.

Mr. Cortright pointed out that the bathroom facilities were divided, with
separate compartments for toilets , wash basins , and showers , so the entire
facility would not be tied up by one person.
BOARD ACTION: Mr. Knutson moved to grant a variance of Section 34. 17 ,
pertaining to the rec{uirement of one bathroom for each five residents of
a roominghouse , to permit occupancy of no more than 24 residents sharing
use of four bathrooms , Mr. Gausman seconded, but reauested that the
motion be amended with the proviso that there reside on the premises
someone to be responsible for the maintenance of cleanliness of all the
shared bathrooms . Mr. Knutson accepted the amendment. MOTION CARRIED
AND SO ORDERED.
