ventilation, to permit continued use of basement apartment where kitchen
is deficient , and Section 13. 06, pertaining ta fire separation, to permit
smoke detector in lieu of sheetrock abave boiler area, because of
financial hardship. (There may also be a zoning pxablem. )
APPEARANCE: Lawrence J. Krenik
PROCEEDINGS: Mr. Krenik explained that the ki.tchen windoti� of the basement
apartment measured 18" by 33" , somewhat s:�ort of code rec{uirements. It
faced out undex a porch and i,rould be difficult to ivork on if an attempt�
�vas made to enlarge the area to comply wath light and ventila-�ion speci-
fications . In regard to fire separation above the boiler, he asked that
he be permitted to install a fire and smoke detector instead of sheet°
rocking.
Jerry Kern stated that the kitchen windoco xovided �%%
required 80 of floor area in light and venpi.lation ; but sinceptheret�ash�
a fair-sized archway into the adjoining room where there were more �ain- ��
dows , he did not see any problem. As to the fire separation matter, he �
told the appellant to put his request to use a smoke detector i�l i+rriting �
to the code enforcemer�t office , where it wou].d be handled administrati.vezy, �
rather than through the appeal process .
BOARD ACTION: NIr. Knutson moved that a vaxiance of Section 34. 14s pe�-
taining to laght and ventilation, be granted, to permit continued occupancy
of the basement dwelling unit, contingent on appraval of the Zoning Boa.rcl �

cit—y or�ers to remove lead paint on exterior, because of practical diffi-
culty.
APPEAR�'�CE : None
PROCEEDINGS : Frank Staffenson told the board there should be no postpone-
men� on hearing this case. A child living in this house had recently
been hospitalized with lead poisoning, and immediate action �vas required
to eliminate the lead paint on the interior of the first floor and on the
porch floar and railings . He noted that b1r. Lindeke stated on his appeal
that he would agree to repaint the interior by September 1. Nir. Staff-
enson said this �oould be too great a delay, that the work should �e done
�right now.
Chairman Glassman asked if Mr. Staffenson taas as cancerned about th� other
exterior surfaces , or could a delay safely be given on that part of the
work.
Mr. Staffensan replied that the exterior, except for t,he porch and razlings
he had previously mentianed, was not as serious a problem.
BOARD ACTION : Mr. Tilton moved to deny any time extension for removal of
loose lead paint and the resurfacing �aith non-toxic materials in the
interior of the first floor, the exterior back door, and the front porch
floor and railings ; remaining exterior paint removal and resurfacing _
must be completed by spring of 1983. Mr. Knutson seconded. 1�70TION CARRIED

suggested deconversion to original four units . Appeal ti�as dismissed at
July 1980 meeting after appellant informed code enforcement office he
tiJOUld follow board' s suggestion, which eliminated need to appeal.

PROCEEDINGS : Mr. Craig stated that, on appeal to the City Council from
.. an un avora le zoning decision, the council had granted permission to
continue opexating 12 units . The .first floor had thxee efficiency
units and four sleeping rooms , each with a single occupant , sharing use
of two complete bathroom facilities . The second floor had one large
apartment with its oian bathxoom, and four efficiency apartments sharing
use of one complete bathroom. He asked for a variance on the shared
bathrooms , explaining that no more than foux persons ever shared use
of one facility.
Jerry �:ern noted that the number of persons sharing one bathroom was
fet�er than would be permitted in a rooming house, and this property had
some units that tvere simply sleeping rooms .
BOARD �1CTION: Mr. Gausman moved that a variance of 5ection 34. 11, per-
taining to asic facilities be granted, ta permit occupants of 11 units
to share use of three bathroom facilities , on condition that no more than

stances a out this proper�y that would indicate a need for Mr. Lindeke
to be present for the hearing.
Jerry Kern said there were no other pxoblems lJi't�l this property and he
could see no reason to deny appellant' s request.
BOARD ACTION : Mr. Tilton moved that a permanent variance of Section 34. 11 be
granted, to permit occupants of eight apartments to share use of four
