Subject: Petition of Barl Billings and A. L. Gingold, et al, for the va-
cation of the East 8 feet and the West 8 feet of Mercer Street
that lies Southerly of Fort Road (fo=merly West Seventh Street).
Public Hearing Date - August 3, 1982
The Qetitioners request that- this vacation be granted as the City has �
eliminated all through traffic on this portion of Mercer Street by vacation
of the southerly portion of Mercer Street and constructing a cul-de-sac in
its place.
Mercer Street is $ 66-foot wide, dedicated improved street. The pro-
posed vacation of 8 feet from both sides �of the street would result in only
narrowing the street to a right-of-way of 50 feet. The area to be vacated
consists of 2,188 aquare feet and is zoned B-3 (Business). One of the peti-
tioners, Judge A. L. Gingold, did by request from the City grant an easement
over and acroas 31.65 square feet of his property for street purposes (cul-
de-sac) and should be reimbursed by reducing his portion of compensation to
be paid to the City.
The Department of Planning and Econamic Development co�ented that a
corner-cut or turning radius should be retained at the southwest corner of
Mercer Street and Fort Road in order to reduce the sharp turn. The Depart-
�nent of Public �lorks reviewed this suggestion and didn't think it would be
necessary.
The Department of Public FTorks did reco�►end that the southerly limits
of this proposed vacation be limited to said cul-de-sac and all encroachments
be removed from Mercer Street right-of-way. �
Northern States Pawer Company reports of having a 4-inch gas line and
a pole with overhesd conductors attached. They requeat that their interest be
prot�cted.
� There were no objections, recommendations or restrictions received from
any other City department or utility rompany in response to my letter of in-
quiry sent them.

In view of the foregoing, I reco�end that the vacation be approved sub-
ject to the following terms and conditions:
1. That the description of the portion of said street to be
vacated be described as follaws:
"All that part of the westerly eight feet (8') of
Mercer Street as originally platted, which lies
southerly of the southeasterly line of West Seventh
Street as widened by order of the Co�soon Council
December 4th, 1889, said westerly eight feet (8')
also abutts and adjoins the easterly line of Lots 1
and 2 Block 6, Ruggs Addition to the City of St. Paul
and said westerly eight feet (8') which lies norther-
ly of the follawing described cul-de-sac.
A circular cul-de-sac haarii�g � a radius of forty-five
feet (45�) whose circular arc intersects a point on
the most northerly line of Fort Road co�ons, said
point being a distance of nine feet (9�) easterly of
the a►ost northerly northwesterly corner when measured
along said northerly line of said plat; said circular
arc also being tangent to the easterly line of Block 6,
Ruggs Addition to the City of St. Paul; also
All that part of the easterly eight feet (8') of Mercer
Street, as originally platted, which lies southerly of
the southeasterly line of West Seventh Street as widen-

the west line of Lots 9, 10 and 11 and the northerly
extension thereof, of Block 2, Cottage Lots Addition

described cul-de-eac:
A circular cul-de-sac having a radius of forty-five
feet (45�) whose circular arc intersecte a point on �

section with the southeasterly line of said widened
West Seventh Street, thence; northeasterly along
the southeasterly line of said widened Seventh Street
to the point of beginning.''
� l2: That the vacation be subject to all the terms and conditions of
Chapter 130, codified March 1, 1981, of the St. Paul Legislative
Code, as amended.
a 2: That a specific easement be retained to protect the interest of
Northern States Power Company within said portion of Mercer Street.
.�, f�• That the petitioners agree to remove all encroachments from Mercer
Street right-of-way remaining after the vacation.
::�' ,b: That the petitioners pay to the City as market value the amount of
$1,�+04.00. for the westerly 8 feet of vacated Mercer Street and
$2,217.00 for the easterly pottion of vacated Mercer Street includ-
• ing reduction of $71.25, for street easement dedicated to the City
of Saint Paul. The total compensation for this vacation is $3,621.00.
l�. That the petitioners furnish the City with a bond in the amount of
$5,000.00, and in addition thereto, by acceptance of the terma and
conditions of this vacation agree to indemnify, defend and save harm-
less the City of Saint Paul, its officers and employees from all suits ,
actions , or claims of any character, including, but not limited to, a
claim brought because of any injuries, or damages received or sus-
tained by any person, persons or property, on account of this vacation;
or because of any act or omission, neglect or misconduct of said pe-
titioner; or because of any claim or liability arising from or based
on any violation or any law or regulation made in accordance with
� the law, �hether by the petitioner or any of its agents or employees.
I further reca�nm�end that a permanent easement for street purposes on, over
and across all that part of Lot 11, Cottage Lots Addition lying SouthWesterly
of an arc of a circle concave to the Southwest, having a radius of 45.0 feet.
Said are starting at a point on the West line of Lot 11, 6.47 feet northerly
of the Southwest corner of said lot and ending at a point on the South line of
said lot, 9.00 feet Easterly of the Southwest corner of Lot 11, be accepted
and recorded by the City of Saint Paul.
