RESOLVED, that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to Terrance J. Boyd the sum of
$1,250.00 in full settlement of his claim for injuries sustained
December 12, 1975, as a result of an accident with a City
vehicle at or near Maryland and Clarence Streets.

RE: Claim against the City of Saint Paul
by Terrance J. Boyd
This case arises out of an accident that occurred on December 12,
1975, in the vicinity of Maryland and Clarence Streets in the
City of Saint Paul.
At about 2 :55 a.m. police officers were westbound on Ma.ryland
when they saw a vehicle travelling at a high rate of speed.
They began to follow the car which then accelerated travelling
eastbound on Maryland. Theyclocked the vehicle at 80 m.p.h.
and the officers continued following with their lights flashing.
Just prior to entering the intersection of Ma.ryland and Clarence,
the vehicle which they were following suddenly braked sha.rply,
swerved and turned up over the curb on the east side of the parking
lot entrance on the southwest corner of Clarence and Ma.ryland.
The car continued into the parking lot when it swerved in a
gradual arch-like movement. The police officers entered approximately
one car length behind. The first car suddenly braked, swerved
broadside in front of the squad and slide sideways across the
lot. The officers braked, but the squad car struck the right
side of the vehicle which they were following.
The first vehicle was driven by David Fernandez. The plaintiff,
Terrance Boyd, was a passenger in that car. As a result of this
accident, plaintiff required surgery for removal of a thickened
tendon of the muscle attached to the pelvis underneath the fascia
lata muscle into the deep surface of the fascia lata. He was
in the hospital from January 17 , 1977 to January 21, 1977 .
His medical expenses were in the neighborhood of $1,058.

As settlement of this case, it is recommended that the City
pay $1,250 and that David Fernandez be required to pay $6,250.
