The City Council requests that you prepare a resolution �ranting
the petition of Lou Ann Ryan, et a1, for the vacation of a portion
of Hastings Avenue subject to the terms and recommedations of the
Valuation Engineer as amended by the City Council. The City Council
approved the petition sub,ject to payment of compensation in the
amount of $800.00.

Subject: Petition of Lou Ann Ryan, et al, for the vacation of e
portioa of Hastings Avenue
Public Hearing - August 17, 1982
The petitioners, Lou Ann Ryan and others, request that the proposed vacation
be granted in order to establish an improved arrangement for maintenance and
beautification of said property by private ownership.

The department of Public Works has reviewed the proposed vacation and reports
it has no objection to it.
The department of Planning and Economic Development has reviewed this vacation
and finds no objection to the vacation as proposed.
There were no other objections or recommendations from any other public or pri-
vate agencies involved.
In view of the foregoing, I recommend that the vacation be approved, subject to
the following texms and conditions:
1. That the description of Aastings Avenue to be vacated
read as follows:
All �at part of Hastings Avenue as originally platted
whicH'��tween the west line extended northerly, of Lot
10 an� the esst line, extended northerly, of Lot 11 all
in Block 2, Wessel�s Addition to St. Paul� Ramsey County,
Minnesota.
�.�L": That the vacation be subject to all the terms and8SO8mendeds
of Chapter 130 of the St. Paul Legislative Codeublic utilities
March 1, 1981, includiag the retention of all p
easements.
1-r3'. That the petitioner pay to the City as market value, the sum

amouat of $5,000.00, and in addition thereto, by acceptance
of the terms and conditions of this vacation, agrees to in-
demnify, defend and save harmless the City of Saint Paul,
its officers and employees fran all suits, actions, or claims
of any character, including, but not limited to, a claim
brought because of any injuries, or damages received or
sustained by any person, persons or property, on account of
this vacation; or because of aay act or omission, neglect or
misconduct of said petitioner; or because of any claim or
liability arising from or based on any violation of any law
or regulation made in accordaace with the law, whether by
the petitioner or any of its agents or employees.
