THE COUNGIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Section 331.08, Subdivision 6 of the Saint Paul Legislative Code be and the same hereby is amended to read as follows: Subd. 6. Sources of ineat and poultry. Presented By �� ''�,;„'."� Referred To Committee: Date Out of Committee By Date Page 2. accordance with the consumer' s instructions in normal retail quantities as defined in CFR Title , 1�381. 10 d ii , if not licensed because of exemption from the requirements of the Poultry Products Inspection Act of 1957 and the re�ulations for inspection of the processin� of poultry and poultry products, such possession and sale will not be unlawful, but the operator must nevertheless operate in compliance with standards set forth therein; or unless (2) It shall have been slaughtered, processed and inspected in accordance with the laws of a state, or a govern�ental subdivision thereof, which is approved by the director. The director may approve any such source if the laws under which it is operating are substantially equivalent to those of this chapter and are enforced with equal effectiveness by an agency of the state or a governmental subdivision. Section 2. This ordinance shall be deemed a part of the Saint Paul Legislative Gode and shall be incorporated therein and given an appropriate chapter and/or section number at the time of the next revision of said Legislative Code. Section 3. This ordinance shall take effect and be in force 30 days from and after its passage, approval and publication. Under the present Ordinance such an operation wou].d be prohibited, since it is unlawful for any person to sell �or-have in poss�s:�ian,- �: for sale such }�oultry products unless licensed under the Poultry Products Inspection Act af 1957. That act and the federal regulations adopted pursuant thereto do provide for _ an exemption to such licensing snd regulations for the type of operation described above. °The proposed ordinance would remove the prohibition against such an operation. The oper- ator would, however, by the terms of the proposed ordinance, be required to operate in compliance with standards set forth in the act and regulations. A loophole in the federal regulations did allow this practice; this loophole will be eliminated.
