00-415ORIGINAL Presented By co���� F,�e # ao -y�5 Green Sheet # � � ( /3 RESOLUTION CITY OF SAINT PAUL, MIl�]NESOTA � Refened To Committee: Date 1 WIIEREAS, The City of Saint Paul, Division of Parks & Recreation, provides a variety 2 of special events for youth including irack & fieid meets; and 4 WHEREAS, Saint Paul Parks & Recreation is in need of facilities for its Youth Track & Field Meets; and WHEREAS, Macalester College of Saint Paul owns land at 1600 Grand Avenue which includes an athletic track, stadium seating, concession area, restrooms and field space; and �� 10 WHEREAS, Macalester College is willing to give permission for Parks & Recreation to 1 I use the stadium and track for its Youth Track & Field Meet on Friday, June 23, 2000, but wishes 12 to have the City indemnify and hold the College hannless from claims related to the City's use of 13 the facilities; and 14 15 WHEREAS, provision of track & field opportunities serve a legitimate public purpose by 16 serving the youth of the City; and 17 18 WHEREAS, the expenditure of public funds, which includes the promise of 19 indemnification and defense, for such a purpose will facilitate and a11ow the City to provide such 20 opportunities, now therefore, be it 21 22 23 24 25 26 27 28 RESOLVED, that the Ciry Council of the City of Saint Paul on behalf of the Ciry of Saint Paul hereby agrees to defend, indemnify and hold Macalester College harmless from any and a11 damages it may be required to pay as a result of suits, claims, actions, or judgments arising out of the use of Macalester's athletic facilities at 1600 Grand Avenue on June 23, 2000 which are attributable to the negligent act ar omission by the City of Saint Paul, its employees, agents or contractors. � � z 3 4 5 6 7 8 00 -��s FLTRTHER RESOLVED, that this indemnification does not include: 1) injuries or damages atising from hidden traps or dangerous conditions of the facilities and track itself as to which the College had actual or constructive notice; and 2) damages or injuries arising out of occunences or events which are not part of the authorized use of the premises or which do not take place on the premises being used as part of the event. Furthermore, nothing in the foregoing provisions shall be consirued as a waiver of the municipal tort liability limits and defenses set forth in Minu. Stat. §466.01 et. seq.
