File N 0. o ncil Resolution Presented By Referred To Committee: Date Out of Committee By Date WHEREAS, As a result of unanticipated reduction in revenues of the City budget created by state and federal budget cuts, it has become necessary to reduce the City's work force through layoffs which are effective January 29, 1982; and WHEREAS, Both the City and various unions of the City of Saint Paul rec- ognize that there will be certain detrimental effects both to the employees and to the City as a result of such layoffs; and WHEREAS, In an effort to reduce the detrimental effect to both parties, the parties have entered into negotiations whereby an incentive pay for early retirement may be implemented so as to provide for reinstatement of such laid- off employees; and WHEREAS, The cost of such incentive pay is approxima.tely equal to the savings the City would receive by reinstating such employees; and WHEREAS, The City and the various unions have agreed to reopen the existing collective bargaining contract and implement the attached amendment to said con- tract; now, therefore, be i.t RESOLVID, That the attached memorandum o� agreement and addition to the existing labor contract is hereby approved; and, be it FURTHER RESOLVID, That the effects of such contract addition are eff ective as of January 29, 1982. In full settlement, the parties hereto have agreed as follows: 1. Except as herein modified the signed 1982-19$3 Collective Bargaining Agreement between the parties, shall be the basis of the forthcoming labor agreement. _ _ 2. Appendix B - Appendix B shall be added to said Agree�ent. This Appendix B is attached hereto and made a part hereof. It is understood that the above settlement shaZl be reco�ended by the City �+Tegot�.ator, but is sub�ect to approval by the City Administration and adoption af the Civil Service Commission and the City Council. It has been necessary, as announced by the Mayor on January 6, 1982, to make permanent personnel reductions affecting numerous city employees as of January 29, 1982. It is recognized by the parties to this agreement that effects detri- mental to the city and its employees flow from these permanent personnel reductions. In order to minimize these detrimental effects, the par�ies have agreed to establish an incen�ive program to facilitate reinstatement of employees who would have otherwise been without employme�t on January 29, 1982, by encouraging voluntary retirement of city employees who meet eligibility requir�ments. The par�ies agree to the incentive program subject to the following specif ic conditions: 1) The City of Saint Paul shall pay ta any member of this baxgaining unit, who meets the requirements for voluntary retirem�nt and who agrees to retire withi.n the dates set forth below, an incentive. of up to $5,000 provided that such retirement leads in an unbroken causal chain to the reinst'atement of an employ.ee who would otherwise be without employment on January 29, I.982, as a result of the permanent personnel reductions. - 2 - 2) The incentive shall be availahle to any eligible employee during the period of January 29, I982, to April 30, 1982, inclusive. The incentive shall automatically ter�inate with respect to this bargaining unit prior. to April 30, 1982, if all employees within this bargainiug unit who are affected by the permanent personneL reductians are reinstated. Such termination shall occur the dag of the reinstatement of the last aff ected employee. 3) Any employee wishing to take advantage of this incentive must submit his or her request far retirement, along with necessary supporting documents, to his or her appointment officer within the time period mentioned above. , • 4) The date of retirement, for purposes of calculating the smount of the incentive, shall be the date the employee actually retires, not the date that inteat to retire is cammuaticated to the appointiag officer. If there is a delay between the employee's desired retirement date and the actual retirement date, and if such delay is caused by circumstances outside �he emgloyez's � - cantrol, the date of retirement, for purposes of calculating the amount of the incentive, shall be the date the �mployee desired to retire. . ' 'tl � �� ' � , - 3 - 5) The maximum incentive shall be $5,�00 and shall be availabe for retirement dates January 29, 2982 - February 14, 1982, inclusive. Commencing on February 15, 1982; and at the beginning af business r each Monday thereafter and continuing through the term of this program, the amount of the incentive shall be reduced $100. In case more than one potential retiree wishes to ava�.l hi.iuself or hersel£ of any remaining available incentive, the remaining � incentive or incentives shall be ma.de available ta the most senior potential xetiree according to the contr�ct Ianguage goverrting seniority. The parties in this contract acknowledge and agree that this Apgendix � has been established through a re-opening of the contract and that the union obtaias ao other benef its under any other provisions of this contract a.nd that the provisions contained in this Appendix apply specifically to the pexmanent personnel reductions which occur on January 29, Z982. It is further agreed that if a dispute arises concerning provisions contained in . this Appendix and the matter is submitted to arbi.tration, the arbitrator may consider oaly those provisions contained in this Appendix and may not make a determination based upon other provisions o£ this contract.
