278178 WHITE - CITY CLERK PINK - FINANCE CANARY - DEPARTMENT COUflC1I BLUE - MAYOR G I T Y O F S A I N T PA U L File N O. o ncil Resolution Presented By _ Referred T Committee: Date Out of Committee By Date WHEREAS, As a result of unanticipated reduction in revenues of the City budget created by state and federal budget cuts, it has become necessary to reduce the City's work force through layoffs which are effective January 29, 1982; and WHEREAS, Both the City and various unions of the City of Saint Paul rec- • ognize that there will be certain detrimental effects both to the employees and to the City as a result of such layoffs; and WHEREAS, In an effort to reduce the detrimental effect to both parties, the parties have entered into negotiations whereby an incentive pay for early retirement may be implemented so as to provide for reinstatement of such laid- off employees; and WHEREAS, The cost of such incentive pay is approxima.tely equal_to the savings the City would receive by reinstating such employees; and WHEREAS, The City and the various unions have agreed to reopen the existing collective bargaining contract and implement the attached amendment to said con- tract; now, therefore, be it RESOLVID, That the attached memorandum of agreement and addition to the existing labor contract is hereby approved; and, be it FURTIiER RESOLVID, That the effects of such contract addition are e£fective as of Jarniary 29, 1982. In fu11 settle�cent, the parties � hereto have agreed as follows: 1. Except as herein modified the signed 1982-I983 Collective . Bargaining A.greement between the garties, shall be the basis of the f orthcaming labor agreement. 2. Appendix B - Appendix B shall ba added to said Agreezaent. This Appendix B is attached hereto and made a part hereof. It is understood that the above settlement shall be recommended by the City Negotiator, but is sub3ect to approval by the City Administration and adoptioa of the Civil Service Commissian and the City Council. It has been necessary, as announced by the Mayer on January 6, 1982, to make per�anent persannel. reductions affecting numerous city employees as of January 29, 1982. It is recognized by the parties to this agreement that effects detri— �ental to the city and its eraployees flow from these per�aanent personnel reductions. In order to minimize these detrimental effects, the parties have agreed to establish an incentive program to facilitate reinstateueent of employees who would have otherwise been without employmer�tt on Janc�ary 29, 1982, by encouragiag voluntary retirement of city employees who meet eligibility requirements. The parties agree to the incentive progra�a subject to the fol.lowing specific conditions: 1) The City of Saint Paul shall pay to any member of this bargaining unit, who meets the requiremeats for voluntarp retirement and who agrees to retire within tfie dates set forth below, an incentive of up to $5,000 provided that such retirement leads in an unbroken causal chain to the reinstatement of an employee who wo�Id etherwise be without employment on January 29, 1982, as a. result of � the permanent personnel reductions. - 2 - 2) The incentive shall be available to any eligible employee during the period of January 29, 1982, to April 30, 1982, inclusive. The incentive shall automatically terninate with respect to this bargaining unit prior ta April 30, 1982, if all employees within this bargaining unit who are affected by the pe�anent personnel reductions are reinstated. Such xermination shall, occur the day of the reinstatement of the last affected employee. 3) Any employee wishing to take a8vantage of this incentive must submit his or her request for retirement, along with necessary supporting documents, to his ar her appoiatment officer within the time period uien.tioned above. � 4) The date of retirement, for purposes of calculating the amount of the incentive, shall be the date the employee actually retires, not the date that intent to retire is communicated to the appointing off icer. If tbere is a delay between the employee's desired retirement date and the actual retirement date, and if such delay - is �caused by circumstances outside the employee's Control, the date of retirement, for purposes of calc�lating the amount of the incenti.ve, shall be the date the employee desired to retire. • � . - 3 - 5) The maximum incentive shall be $5,OQ0 and shall be availabe for retirement dates January 29, 1982 - February 14, 1982, inclusive. Commencing on February 15, 1982, and at the beginning of business < < each Monday thereafter and continuing throv.gh the term of this program, the amount of the incentive shall be reduced $100. April 12 April 18 $4,IOQ April 19-April 25 $4,OOQ April 26-April 30 $3,904 6) Permanent part-time employees who are e2igible to retire and meet other incentive program conditions are eligible to take advantage of this incentive in t�e same fraction the position is of a full-time position. , , : ., ' _ , - 4 - 7) The City shall pay the incentive to each retiree in a single payment within thirty (30) days after the date of retirement. 8) Employees will be able to avail themselves of this � incentive within the program dates so Iong as there - is at least one remaining former employee within this . bargaining unit who is without employment because af the permanent personnel reductions. In case more than one potential retiree wishes to avail himse}.f ar herself of any remaining available incentive, the remaining inceative or incentives shall be made available to the most seniar potential retiree according to the contract language governing seniority. The parties in this contract acknowl.edge and agree that this Appendix has been established through a re-opening o£ the contr.act and that the union obtains no other benefits under any other provisions of this contract and that the provisions contained in this Appendix apply specifically to the permanent personnel reductions which occu� on January 29, 1982. It is further agreed that if a dispute arises concerning provisions contained in tl�is Appendix and the matter is submitted to arbitration, the arbitrator may cons�der only those provisions contained in this Appendix and may not make a determination based upon other pzovisions of this cantract.
