278176 WMITE - CITY CLERK CANARY - DEPARTMENT COURCII ����� � BLUE - MAYOR G I T Y O F S A I N T PA U L File N O. o ncil Resolution Presented By Referred T Committee: Date Out of Committee By Date WHEREAS, As a result of unanticipated reduction in revenues of the City budget created by state and federal budget cuts, it has become necessary to reduce the City's work force through layoffs which are effective January 29, 1982; and WHEREAS, Both the City and various unions of the City of Saint Paul rec- ognize that there will be certain detrimental effects both to the employees and to the City as a result of such layoffs; and WHEREAS, In an effort to reduce the detrimental effect to both parties, the parties have entered into negotiations whereby an incentive pay for early retirement ma.y be implemented so as to provide for reinstatement of such laid- off employees; and WHEREAS, The cost of such incentive pay is approximately equal to the savings the City would receive by reinstating such employees; and WHEREAS, The City and the various unions have agreed to reopen the existing collective bargaining contract and implement the attached amendment to said con- tract; now, theref ore, be it RESOLVID, That the attached memorandum o� agreement and addition to the existing labor contract is hereby approved; and, be it � FURTHER RESOLVID, That the ef£ects of such contract addition are effective as of January 29, 1982. In full settle- ment, the parties hereto have agreed as follows: i 1. Except as herein modified the signed 1980-198I-1982 Collective Bargaining Agreement between the parties, shall be the basis of the forthcoming labor agreement. . 2. Appendix C shall be added to said Agreement. This. Appendi�c C is attached hereto and made a part.hereof. It is understood that the above settlement shall be reco�xnended b�y the City I�egotiator, but is sub�ect to approval by the City Administration and adoption of the Civil Service Co�mission and the City Council. It has been necessary, as ann.ounced f by the Mayor on January 6, 1982, to make permanent gersonneZ reductions affecting numerous city employees as of January 29, I982. It is recognized by the parties to this agreement that ef£ects detri— mental to the city and its employees flow from these germanent personnel reductions. In order to minimize these detrimental eff ects, the parties have agreed to establish an incentive program to £acilitate xeinstatement af employees who would have otherwise been without emp7.oyccent on January 29, 1982, by encouraging voluntary retirement of city emplopees who �eeC eligibility requirements. The parties agree to the incentive program subject to the following specif ic conditions: 1) The City of Saint Paul shall pay to any member of this bargaining unit, who meets the requirements for voluntarp . retirement and who agrees to retire withia the dates set forth below, an incentive of up to $S,OOQ provided that such retirement leads in an unbroken causal chain to the reinstatement of an emplayee who would other��ise be , without employment on January 29, 1982, as a result of the permanent personnel reductions. - 2 - 2) The incentive shall be available to any eligible e�ployee during the period of January 29, 1982, to April 30, 1982, inclusive. The incentive shall autom.atically ter�inate with respect to this bargaining unit prior to April 30, 1982, if all employees within this bargaining unit who are af£ected by the permanent personnel reductions are - reinstated. Such termination shall occur the day of the . reinstatement of the last zffected eeu�ployee. 3) Any employee wishing to take advantage of this incentive must submit his or her request for �etirement, along � with necessary supporting documents, to his or her appointment officer within the time pariod mentioned ` above. 4) The date of retixement, for purposes of ca.Iculating the amount of the incentive, shall. be the date the employee actually retires, not the date that intent to xetir e is com�nunicated Lo the appointing officer. If there fs a delay between the employee's desired retiremeat date and the actival retirement date, and if such delay is caused by circumstances outside the employee's control, the date of retirement, for purposes of calculatiag the amount of the incentive, shall be the date the employee desired to retire. 4 .... . • - 3 - 5) The maxi�um incentive shall be $5,000 and shall be availabe for retirement dates January 29, I9$2 - February 14, 1982, inclusive. Com�aencing on February 15, 1982, and at the beginning of business , each Monday thereafter and continuing through the term, of this program, the ,ar.iount of the incentive shall. be reduced $100. In the case more than one potential retiree wishes to avail himself or herself vf any rentaining available incentive, the rer,iaining incentive or ' incentives shall be made available t�potential retirees �,,Q- A on the basis of departmental seniority� , .J �-�' The parties in this contract acknowledge and agree that this Appendix has been established through a re-openi.^.g of the contract a�d that the union obtains no other benefits under any other provisions of this contract and that the provisions contained in this A�pendix apply specifically to the permanent personnel reductions which occi:r on January 29, 1982. It is further agreed that if a dispute arises concerning provisions ccsntained in this Appen� and the matter is submittecl to arbitratian, the arbitrator may.consider only those provisions contained in this Appendix and may not make a determination based upon other provisions of. this contract.
