This propezry is legally described as follows, to wit: Lot 10, Block 5, Lorena Park. WF�REA5, based upon the records in the Ramsey CounTy Recorder s Office and information obtained by Division of Code Enforcement on or before November 29, 1999, the following are the now known interested or responsible parties for the Subject Properiy: David R. Johnson, 478 Cleveland Avenue South, St. Paul, MN 55105-1350; Gary Torgerson, 9445 31�` Street North, Lake Elmo, MN 55�42 WHEREAS, Division of Code Enforcement has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated February 14, 2000; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the shucture located on the Subject Properry by March 15, 2000; and Wf]EREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Division of Code Enforcement reqnested that the City Clerk schedule public hearings befare the Legislative Hearing Officer of the City Council and the Saint Paul CiTy Council; and WIIEREA5, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Pau1 Legislative Code, of the tnne, date, place and purpose of the public hearings; and 2 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 WF�REAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul C'ty� `� Council on Tuesday, April 18, 2000 to hear testimony and evidence, and after receiving testunony and evidence, made the recommendation to approve the request to arder the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blightmg influence on the commuuity by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a heariug was held before the Saint Paul City Council on Wednesday, April 26, 2000 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Properiy at 1356 Reaney Avenue: That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. 4. 5. 6. That the costs of demolition and removal of this building(s) is estimated to exceed three thousand dollars ($3,000.00). That there now exists and has existed multiple Housing ar Building code violations at the Subject Property. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Division of Code Enforcement has posted a placard on the 5ubject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by the Citizen Service Offices, Division of Code Enforcement, Vacant/Nuisance Buildings. 8. That the known interested parties and owners aze as previously stated in this resolution and that the notification requirements of Chapter 45 have been fu1fi11ed. ORDER The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrunental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and conecting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. Gerry Strathxnan recommended denying the appeal. fiYil NIINUTES OF THE LEGISLATIVE HEARII3G OO —�'{ l0 Tuesday, April 18, 2000 Room 330 Courthouse Gerry Strathman, Legislative Hearing Officer The meeting was called to order at 10:02 a.m. STAFF PRESENT: Steve Magner, Code Enforcement Resolution ordering the owner to remove or repair the building at 1356 Reaney Avenue. If the owner fails to comply with the resolution, Code Enfarcement is ordered to remove the building. Steve Magner reported ttus building has been vacant since 8-4-98. Seven summary abatement no6ces have been issued for securing the dwelling, removing refuse, and cutting tall grass. On 1-18-00, an inspection of the building was conducted, aud a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. The owner has posted a$2,000 bond, completed 90% of the work, and is now waiting for pon Wagner (Office of License, Inspections, Environmental Protecfion) to sign off on the building. If that is done, this issue will be moot. (Mr. Magner presented photographs to Gerry Stratbman.) Gary Torgerson, representing owner David R. Johnson, appeared. Mr. Strathman asked are Mr. Magner's comments cortect. Mr. Torgenson responded yes. The work is almost done on the properry. Gerry Strathman recommended granting six months from the posting of the bond to rehabilitate the buiiding. This recommendation is just a formality in case the owner needs the time and Mr. Wagner does not sign off on the building. Resolution ordering the owner to remove or repair the building at 987 Minnehaha Avenue East. If the owner fails to comply with the resolution, Code Enforcement is ordered to remove the building. (No one appeazed to represent the property.) Steve Magner Teported this building has been vacant since 9-18-98. The current owner is Bankers Trust Co. of California There have been eight abatement notices to secure dwelling, remove refuse, cut tall grass, remove snowlice, and remove vehicle. On 2-7-00, an inspection of the building was conducted, and a list of deficiencies which consfitute a nuisance condition was developed and photographs were taken. Vacant building fees aze due. Taxes are paid. Taxation has placed an estimated mazket value of $57,100 on tbis properry. On 6-9-94, a code compliance inspection was compieted. The estimated cost to demolish is $6,000 to $7,000. (Mr. Magner presented photographs to Gerry Strathman.) Mr. Strathman asked was the code compliance inspection done before or after the fire. Before the fire, responded Mr. Magner. Mr. Magner stated Charles S. West was the properiy owner before the mortgage company. His ex-wife called Mr. Magner yesterday because she saw the notice posted on the front door. She said that Mr. West informed her the situation is being handied and he is current on his mortgage. Gerry Strathman recommended approval of the resolution.
