That the petitioner, its successors or assigns, by acceptance of this vacation, agrees to deed right of way for left-turn lanes to the City if the design plans of the petitioner, its successors or assigns, for the redevelopment of said Block 9 can acco- modate such left-turn lanes; provided th.at any duty to convey shall cease upon the filing for a building permit by petitioner, its successors or assigns . That the petitioner, its successors or assigns , by acceptance of this vacation, agrees to deed to the City, at no compensation, any right-of-way for left turn lanes and sidewalks in said Block 9 if the design plans of petitioner, its successors and assigns for the redevelopment of said Block 9 can accommodate left-turn lanes; provided that any duty to convey shall cease upon the filing for a building permit by petitioner, its successors and assigns. That an easement be retained to proteet the interests of Northern States Power Company. 5. That an easement be retained to protect the interests of Northwestern Bell T.elephone Company. 6. That the prime petitioner, being the Housing and Re- development Authority, shall not be required to pay compensation for the vacation. 7. That in lieu of a bond the prime petitioner, its successors and assigns covenant and agree by written . acceptance of the terms and conditions of this vacation to fully indemnify, defend and save harm- less the City of Saint Paul, its officers, agents, employees, and servants from all suits, actions or . claims which shall arise from any inj�aries or damages received or sustained by any break in any service pipe, or connection in said reserved easements, arising out of or resulting from any action or negli- gence of the petitioner, its employees, agents or business invitees. wnr�c ..
