WHEREAS, Citizen Service Office, Division of Code Enforcement has requested the CiTy
Council to hold public hearings to consider the advisability and necessity of ordering the repair or
wrecking and removal of a two-story, wood frame dwelling and the detached, garage and shed located
on property hereinafter referred to as the "Subject Property" and commonly known as 987 Minnehaha

obtained by Division of Code Enforcement on or before December 10, 1999, the following aze the now

building(s) to constitute a nuisance condition; subject to demolition; and
WI�REAS, this nuisance condition has not been corrected and Division of Code Enforcement
requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City
Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance with
the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of

2000 and the testimony and evidence including the action taken by the Legislative Hearing Officer was
considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the 5aint Paul CiTy Council hereby adopts the followang Findings and Order
concerning the Subject Property at 987 Mimiehaha Avenue East:

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legisiative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then Irnown responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been conected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, VacantlNuisance Buildings.
That the known interested parties and owners are as previousiy stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Samt Pau1 Ciry Council hereby makes the foliowing order:
The above referenced interested or responsible parties sha11 make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this structure and conecting all deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
codes and ordinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and
removal of the structure must be completed within fifteen (15) days after the date of the Council
Hearing.

2 2. If the above conective action is not completed within this period of time the Citizen Service
3 Office, Division of Code Enforcement is hereby authorized to take whatever steps are necessary
4 to demolish and remove this shucture, fill the site and charge the costs incurred against the
5 Subject Property pursuant to the provisions of Chapter 45 of the Saint Paui Legislative Code.
7 3. In the event ffie building is to be demolished and removed by the CiTy of Saint Paul, a11 personal
8 properiy or f�tures of any kind wiuch interfere with the demolition and removal shall be
9 xemoved from the properiy by the responsible parties by the end of this tune period. If all
10 personal property is not removed, it shall be considered to be abandoned and the City of Saint
11 Paul shall remove and dispose of such properry as provided by law.

The meeting was called to order at 10:02 a.m.
STAFF PRESENT: Steve Magner, Code Enforcement
Resolution ordering the owner to remove or repair the building at 1356 Reaney Avenue. Tf
the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.
Steve Magner reported this building has been vacant since 8-4-98. Seven sutmnary abatement
notices have been issued for securing the dwelling, removing refuse, and cutting tall grass. On
1-18-00, an inspection of the building was conducted, and a list of deficiencies which constitute a
nuisance condition was developed and photographs were taken. The owner has posted a$2,000
bond, completed 90% of the work, and is now waiting for pon Wagner (Office of License,
Inspections, Environmental Protection) to sign off on the building. If that is done, this issue will
be moot.

Gary Torgerson, representing owner David R. Iohnson, appeared.
Mr. Strathman asked are Mr. Magner's comments correct. Mr. Torgenson responded yes. The
wark is almost done on the properry.
Gerry Strathman recommended granting six months from the posting of the bond to rehabilitate
the building. This recommendation is just a formality in case the owner needs the time and Mr.
Wagner does not sign off on the building.
Resolution ordering the owner to remove or repair the building at 987 Minnehaha Avenue
East. If the owner fails to comply with the resolution, Code Enforcement is ordered to
remove the bnilding.
(No one appeared to represent the property.)
Steve Magner reported this building has been vacant since 9-18-98. The current owner is
Bankers Trust Co. of California. There have been eight abatement norices to secure dwelling,
remove refuse, cut ta11 grass, remove snow/ice, and remove vehicle. On 2-7-00, an inspection of
the building was conducted, and a list of deficiencies which constitute a nuisance condition was
developed and photographs were taken. Vacant building fees are due. TaYes aze paid. T�ation
has placed an estimated market value of $57,100 on this property. This amount is very

speculative due to the current condirion of the building because it was involved in a fire. On
6-9-99, a code compliance inspecrion was completed. The estimated cost to demolish is $6,000
to $7,000.

Mr. Strathman asked was the code compliance inspection done before or after the fire. Before
the fire, responded Mr. Magner.
Mr. Magner stated Chazles S. West was the property owner before the mortgage company. His
ex-wife called Mr. Magner yesterday because she saw the nofice posted on the front door. She
said that Mr. West informed her the situation is being handled and he is current on his mortgage.
Gerry Strathman recommended approval of the resolution.

Resolution ordering the owner to remove or repair the building at 1356 Reaney Avenue. Tf
the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.
Steve Magner reported this building has been vacant since 8-4-98. Seven sutmnary abatement
notices have been issued for securing the dwelling, removing refuse, and cutting tall grass. On
1-18-00, an inspection of the building was conducted, and a list of deficiencies which constitute a
nuisance condition was developed and photographs were taken. The owner has posted a$2,000
bond, completed 90% of the work, and is now waiting for pon Wagner (Office of License,
Inspections, Environmental Protection) to sign off on the building. If that is done, this issue will
be moot.

Gary Torgerson, representing owner David R. Iohnson, appeared.
Mr. Strathman asked are Mr. Magner's comments correct. Mr. Torgenson responded yes. The
wark is almost done on the properry.
Gerry Strathman recommended granting six months from the posting of the bond to rehabilitate
the building. This recommendation is just a formality in case the owner needs the time and Mr.
Wagner does not sign off on the building.

Bankers Trust Co. of California. There have been eight abatement norices to secure dwelling,
remove refuse, cut ta11 grass, remove snow/ice, and remove vehicle. On 2-7-00, an inspection of
the building was conducted, and a list of deficiencies which constitute a nuisance condition was
developed and photographs were taken. Vacant building fees are due. TaYes aze paid. T�ation
has placed an estimated market value of $57,100 on this property. This amount is very

speculative due to the current condirion of the building because it was involved in a fire. On
6-9-99, a code compliance inspecrion was completed. The estimated cost to demolish is $6,000
to $7,000.

Mr. Strathman asked was the code compliance inspection done before or after the fire. Before
the fire, responded Mr. Magner.
Mr. Magner stated Chazles S. West was the property owner before the mortgage company. His
ex-wife called Mr. Magner yesterday because she saw the nofice posted on the front door. She
said that Mr. West informed her the situation is being handled and he is current on his mortgage.
Gerry Strathman recommended approval of the resolution.

Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then Irnown responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been conected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, VacantlNuisance Buildings.
That the known interested parties and owners are as previousiy stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.

The Samt Pau1 Ciry Council hereby makes the foliowing order:
The above referenced interested or responsible parties sha11 make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this structure and conecting all deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
codes and ordinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and
removal of the structure must be completed within fifteen (15) days after the date of the Council
Hearing.

2 2. If the above conective action is not completed within this period of time the Citizen Service
3 Office, Division of Code Enforcement is hereby authorized to take whatever steps are necessary
4 to demolish and remove this shucture, fill the site and charge the costs incurred against the
5 Subject Property pursuant to the provisions of Chapter 45 of the Saint Paui Legislative Code.
7 3. In the event ffie building is to be demolished and removed by the CiTy of Saint Paul, a11 personal
8 properiy or f�tures of any kind wiuch interfere with the demolition and removal shall be
9 xemoved from the properiy by the responsible parties by the end of this tune period. If all
10 personal property is not removed, it shall be considered to be abandoned and the City of Saint
11 Paul shall remove and dispose of such properry as provided by law.
