WHEREAS, Earl A. Brown applied to the Board of Zoning Appeals
for a variance from the strict application of the provisions of
Section 61.1O1 of the Saint Paul Legislative Code pertaining to
mini.mum lot size and minimum lot frontage in an R-3 zoning district
for the purpose of being allowed to construct three single family
houses on portions af Lots 1 and 2, Block 4, Hudson Road Gardens,
located on the southwest corner of Conway and Van Dyke Streets; and
WHEREAS, Following a public hearing with notice ta affected
property owners, the Board of Zoning Appeals by its Resolution No.
9032 adopted November 10, 1981, denied the request for a variance;
and
WHEREAS, The decision of the Board of Zoning Appeals was based
upon its findings that the property in question possessed no ex-
ceptional physical characteristics upon which to base the
variance; that there was no evidence that the applicant would incur
hardship without the variance being granted; the variance would be
a substantial detriment to the community or to the intent and
purpose of the ordinance; the variance would create substandard
nonconforming lots; the variance would be a substantial detriment
to the neighbors' supply of light, air, health, safety and property
values and the request for variance was based on a desire to
increase the income potential of the parcel; and
WHEREAS, Pursuant to the provisions of Section 64 .205, Earl A.
Brown duly filed with the City Clerk his appeal from the determi-
nation made by the Board of Zoning Appeals requesting that a hearing
be held before the City Council for the purpose of considering the
actions taken by said Board; and
WHEREAS, Acting pursuant to Sections64 .205 through 64 .208 and

RESOLVE, That the Council of the City of Saint Paul does here-
by affirm the decision of the Board of Zoning Appeals in this �natter
and does hereby concur in the findings made and determined by said
Bo:ard; and, be it
FURTHER RESOLVED, That the appeal of Earl A. Brown in this
matter be and is hereby denied; and, be it
FURTHER RESOLVED, That the City Clerk shall mail a copy of
this resolution to Earl A. Brown, the Zoning Administrator, Planning
Commission and the Board of Zoning Appeals.

Dear Sir:
This letter is written in response to the appeal of Earl Brown to a decision of
the Board of Zoning Appeals denyinq lot area and frontage variances to allow
subdivision of a parcel and construction of three single family houses at the
southwest corner Conway and Van Dyke.
On October 27, 1981 , the Board of Zoning Appeals conducted a public hearinq on
the request for variance. Three letters were received in opposition to the
variance, one contained 11 signatures. The District 1 Community Council opposed
the variance. Testimony was heard from 6 neighbors in opposition to the variance.
Bill Cerney, Daisy Realty, also testified and presented a petition with 37 sig-
natures in support of the variance. The Board voted 4-0 to deny the variances
based on findings that (1 ) the property in question possesses no exceptional
physical characteristics upon which to base the variance; (2) there is no
evidence of exceptional undue hardship; (3) the variance would be a substantial
detriment to the community and to the intent and purpose of the Ordinance;
(4) the variance would create substandard nonconforming lots; (5) the variance
would be a substantial detriment to the neighbors ' supply of light and air,
health, safety and property values; (6) the request for variance is based on a
desire to increase the income potential of the parcel .
This appeal is scheduled for a public hearing before the City Council on
January 14, 1982. Please notify me by January 13 if any member of the Council
wishes to have slides of the site presented at the hearing.

This whole proolem actually starte� well after a�pl�ring for
the McKnigh�t �tortgage mone.y when °.t was brought tro my attention
that because oi the overwhelming number of cnntractors seeking
funds that now not onl.y di�i you have to meet all previous yeqrs
stt�ndar3s hut .you also Y�a�1 to own a'.l of the ^ropert.y prior to
getting approval . I have been involved in the lo���, interest city
and P�i .H .F .A . pro�-rams for the la s t 5 year� �s a builder, �iereloper
an�l ti�is is the first time you have had to oe�m all the ��opez•t�
outri�ht pr.ior to fund approval . I ha�i always worked on the
Aremise of owning ss few as possible an3 hol�-iing options on the
rest of thelQnd or lots to ourchase �ust prlor to constructton.
This hol�is true especiall� with todays economy. This also meant
I wo ald be able to build for people who alreddy owne3 their own Zo� .
As a result of the late date notice, I proceeded to purchase the
lots mcsL lasir?ble in my mind for the home o�vner �.zn3er this
program. In doing so I called the city and asked if the property
at VanDyke an d Conway could be split into 3 narcels for single family
dwellings, I was told b y pnone, yes . I proceeded to purchase
the property wi. th 3 ho�.es i�� �uirid . I submittad the hoi.as � lesign
and a?at drawings with lot frontage and area to the city for approval
for the 'Yicrir�i�ht funds and receive3 approval for the 3 lots an3
3 houses on this parcel . i�iy next step ti�as to start construction. As
I was obtaining my permits , I was infor med that the lots did not
meet the current size (area �c front f�otage ) . I pulZed two of the
three permits und began construction while filing for a variance
at tr.e same time for ti�e tiiird permit . Because of the soil condttions
I had to excavate and backfill and compact to a depth of up to
approximatel.y 6-6� at the deepest for the three lots prior to
?�ying th�s foottng� .
Z balieve my variance was not granted because of a staff
report which was usc3 as the basis of denial . Here is the attached
cor;� of six reasons that were sta�3 u:�3 my reactions to them:

WHEREAS, EARL BROWN has applied for a variance from the strict application

WHEREAS, the Saint Paul Board of Zoning Appeals conducted a public hearing
on October 27, 1981 , pursuant to said appeal in accordance with the require-
ments of Section 64.203(a) of the Legislative Code; and
WHEREAS, the Saint Paul Board of Zoning Appeals based upon evidence presented
at the public hearing, as substantially reflected in the minutes attached
hereto, made the following findings of fact:
l . The property at the southwest corner of Conway and Van Dyke possesses
no exceptional physical characteristics upon which to base the
variance.
2. There is no evidence that the applicant would incur hardship without the
variance.
3. The variance would be a substantial detriment to the community or to the
intent and purpose of the Ordinance.
4. The variance would create substandard nonconforming lots.
5. The variance would be a substantial detriment to the neighbors ' supply
of light and air, health, safety or property values.
6. The request for variance is based on a desire to increase the income
potential of the parcel .
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Board of Zoning Appeals
that the variance of the provisions of Section 61 .101 to allow subdivision
of the parcel into three substandard lots be denied for property at the
southwest corner of Conway and Van Dyke,
m oved by Mr. Woods Decisions of the Board of Zoning
seconded by _ Appea,S are final subject to appeal
Mr. Peterson to the City Council �vithin 30 days
in favor 7 by anyone affected by the decision.

Ms. Baker further pointed out tt�at the signatures on the petition in support
presented by Mr. Cerney are not adjoining the property in question. Many
of them are as far away as White Bear Avenue or do w�on Wilson Avenue which
is quite a distance.
Don Sandin, 456 Van Dyke, spoke in opposition stating that most of the lots
on Van Dayke are 60' or more on the average and they would like to keep it
that way. He also corr�nented that some of the sionatures on the petition in
support are over 1 ,000' from the property in question. Property owners
within 350' are in opposition to the 3 lots.
Pat Sofie, 441 Van Dyke, stated that the only signature on the petition in
support that is in direct contact with the construction is Shaws who live
directly across the street and are moving and don't care. She also expressed
concern with off-street parking.
Gary Sorinson, 1816 Conway, spoke in opposition expressing concern with water
problems that may be created with construction of 3 homes.
Ray l�lilcenski , 463 Van Dayke, stated it would lower the value of his property
and was concerned with water problems and congestion in the area.
Randy Bacchus , Bacchus Construction, talked about the McKniqht Financing Program
stating that he felt the neighborhood feels it is substantard housinct.
Toni Baker commented that the neighborf�ood has welcomed the McKnight Program
and their reason for opposition to the 3rd house nothing to do v�ith the
color or the income of the people.
Tom 0'Keefe, 1808 E. Third, spoke in opposition stating that if they are allowed
to construct 3 homes on that site others could also do the same.
Hearing no further testimony, Ms. Morton closed the public hearing portion of
the meeting.
Mr. Woods made a motion to deny the variance request based on findings 1
6 of the staff report. Mr. Kirk seconded the motion. The motion passed on
a roll call vote of 4 to 0. (Mr. Peterson had been excused from the meeting. �

A. PURPOSE: Variance of the required minimum lot area and frontage to allow subdivision
of t�parcel and construction of three single-family houses.
B. FRONTAGE AND AREA: The parcel is irregularly shaped with a 141 .83 foot frontage on
Van By e an a depth ranging from 121 .76 to 101 .74 feet for a total area of 15,858
square feet.
C. SITE & AREA CONDITIONS: The site is a vacant corner lot. There is no alley access.
Surrounding land uses include single-family houses to the east, south and west, R-3;
the northeast and northwest corners of Conway and Van Dyke are vacant. Multi-family
districts, RM-1 and RM-2, are located to the west and south of the site.
D. BACKGROUND: The proposed development has received tentative approval for inclusion
in t e cKnight Family Housing Fund. The Building Department has issued permits for
the construction of two single-family houses on the site. No street addresses have
been assigned to the site.
E, ORDINANCE CITATION: Section 61 .T01 , Schedule of Regulations , requires a minimum lot
area of 6,000 sq. ft. with a minimum frontage of 50 feet in an R-3 zoning district.
The applicant proposes:
Lot 1 - 5,671 sq. ft. minimum lot area with 47.07 minimum frontage.
Lot 2 - 5,220 sq. ft. minimum lot area with 46.64 ft. minimurn frontage.
Lot 3 - 4,967 sq. ft. minimum lot area with 48.12 ft. minimum frontage.
F, FINDINGS:

1 . The property possesses no exceptional physical characteristics upon which to base
a variance. The site is a vacant parcel ; the topography of the site is not unusual .
Two single family houses could be constructed on the parcel without a variance.
2. There is no evidence that the applicant would incur hardship without the variance.
The Building Department has issued permits for the construction of the single-
family houses which meet the requirements of the Zoning Ordinance. .
3. The variances cannot be granted without substantial detriment to the community,
or to the intent and purpose of the Ordinance.
Section 61 .102 Subd, 3, states: "a lot or parcel shall not be divided or subdivided
unless and until the following conditions have been met:
(1 � A17 lots or parcels created by division, by subdivision, or by conveyance or
part of a lot or parcel , shall meet the requirement of Sections 61 .101-61 .104
Schedule of Regulations" .
Section 62.102 subd. 2, Nonconforming lots , states : "If three or more lots or
combinations of lots or portions of lots with continuous street frontage in single
ownership are of record on the effective �.iate of this code, and if all or part
of the lots do not meet the requirements of lot width and area established by the
code, the lands involved shall be considered to be an undivided parcel for the
purpose of this code, and no ortion of said arcel shall be used or occ: upied

Dear Members of the Board,
The District 1 Community Council voted unanimously last night to oppose
the variance requested by Earl Brown for the land located at the southwest
corner of Conway and Van Dyke. The present residents have a right to expect
similar sized lots and hom�s to be built on their street. Anything smalter
Urould look inappropriate and detract from the value of their homes.
The council is aware of the need for affordable housing in St. Paul but
feels strongly that those needs should not be met by greatly altering the
appearance of an established neighborhood. This residential street in par-
ticular has already experienced the influx of hundreds of apartments , the
Ra;rada Inn complex and the building of I-9��.
?his neighborhood is already providing more housing stock for the city.
Approximately 20 other Mc Knight homes will be built this year within view
ef this site. One more may not seem in itself harmful , but it is our belief
that it just might be the "straw that broke the camel 's back."

As a result of the late date xioti�e, 1 proceeded to �urchase the
lots mo� �� a�six �.?�le in my mind for the home owner under this
pro�;ram. In doin�; so I called the cz.ty �nd asked if the property
at VanD.yke an d C�nwa9 could be split into 3 parcels for si.ngle family
dwellings , I w�� told b y pnone, yes . I proceeded to purchase
the nropert,y wi th � Y�o���s �.�� �,�i.��u . I submitted trie ho�a.s t aesign
and �lat draw�_ngs wi_th lot frontage and area tc� the cit�r for approval
for the G-ichni�ht funds and recei ved approval for• the 3 lots �n3
3 �ouses on this n�arcel . i�iy r�ex� step ���ras to start construction. As
I was obta�nir� my permits , I was informed that the lots dicl not
meet the current size (area �: front f��tage ) . I pulled two of the
three permi_ts and be�;an construction while fi_ling `'or a variance
at the sa�ne time for �i,�le tsiird permit . Because of t?�e so5_1 condi_tions
I had to excavate �n:� �ackfill an�i comt�act to a debtn of un to
ap�roximately 6-8 ' a� t'rie deenest for the three lots prior to
�ayil;b t,'ric Poot i_iiga .
I believe my var-iance wac not granted because of a staff
report which was us��_i as the basis of denial . nere is the attached
cop;� o.f six reasons that were stat�d ��z,�. mV reactioris to them:

the list lon.�er . I agree it is not the conforming current lot
eize and front footage, however isn' t this wh,y dve 23ave a variance
brocedure to handle with coinmon sense extenuat�.ng circumstances that
come ?zp from time to time?
#4 . The variance would create "subst�ndard non-confarmingt'
l�ts for R-3 zoni.rig, however there are at 7.e�st 10 lots on 3rd St .
within the 350 ft . radius which �-.�ould today be called "substandard,
non-c��nforming" but becnu�e these ho�.zses v+rere built nrior to the
r,urrent R--3 Zon-ing chan�,e they are considered fine today.
#5. Zonings are based for these reasons and even with the
vari�nce �e construction of 3 si_ngle far�.ily hom�s woul ��
meet or exceed in every fashion t:ne current R-3 zoning regul�tions
concerning light, air, health and safety. Concerning property
values , these 3 homes v�� ll be in the upper 30� based on a�,�raised
valu� of the homes within 350f .
#6. This varianc� request �s based ori m� desire to be able to
rely on answers b,y city officials aven ia. bv phone c;�n��sat'cn
��-.� m,y desire to be able to have t,he opportunity to f�<d my fam�ly
as you -.�o by �,�ing a�?le to e^rn an income . Because o° my hurriedne��,s
to purchase t'� e lots, it cost me the 11,0')0.00 for fill., excavating ,
and compaction bv not havin� proper so�l boranbs done . But, based
on City o?`'icials answers , am I also suppose to reach into my �ocket for
extra cash ju�t to b� a'ale tc �ay I hr:>lpe��. build quality housirig
stock for the Cit,y of St . '�'aul? I th'nk no . I still. have fa�th
ir� ola.r s,ystE,n an�. I ai;1 �erta,_n ,your com,*�on sense wi ll tell ,you that

bu,yers of these 3 homes because the,y w� ll l.ive with front yards

day R-3 Zonin� requi_res .
I have been a builder-developers for over 13 years �nd a
bu� ldin� inspector for the Sti.11w� ter township from 1975 through
1979 when the co znty took over, and I have rever ha� any problems or
variancE; requests that someohe ha�� to suffer because of a p��or�e
con�ersation . As �:� previous �nspector T know sometimes mistakes
with a cit,_y ��overnment can ha�pen, howeve:r I r�ave never seen or
hope I don''t ever see s�m�one suffer serious har3ships becau�e of an

PRESENT: Mne. Morton; Messrs. Grais , Kirk, Peterson and Woods of the Board
of Zoning Appeals ; Mr. Segal , Assistant City Attorney; Ms. Lane of
the Division of Housing and Building Code Enforcement; Ms. Beseman
and Ms. Von P•1osch of the Planning Division Staff.

EARL A. BROWN (�9032) : Variance request to allow subdivision of the parcel
anc+ construction of three single-family houses at the southwest corner of
Conway and Van Dyke.

The applicant was represented. There was opposition present at the hearing.`
Ms . Von Mosch showed slides of the site and reviewed the staff report with a "�°
recommendation for denial . Two letters were received in opposition and
one contained 10 signatures of property owners in the area.
Bill Cerney, Daisy Realty, 161 Endicott Buildin�, representing the applicant,
stated that prior to the applicant purchasing the building. he checked with
the city and the city had indicated that 3 single family homes could be
constructed on the site. The applicant then purchased the parcel of land
with plans for 3 single family homes. The plans and specifications were
submitted to the city for the McKnight financing. After the city had inspected
the land and the specifications , approval was given for 3 single family home
financing on the parcel . Upon actually obtaining the permits necessary to
began construction, Mr. Brown was notified that there was a problem. He stated
that the applicant would incur hardship if the variance request is not granted
because of the property's exceptional physical characteristics . Also, some
years back part of the land was taken for the street and they lost 20' of
frontage on the parcel . The applicant has $400 in survey expenses on the
parcel and the excavating and compating of fill also demonstrates hardship
on the part of the builder. He then presented a petition with 37 signatures
in support.
Toni Baker, District 1 , reported that the Gouncil voted unanimously to oppose
the variances. They feel that the present residents have a right to have
similar sized lots and homes on their street. Anything smaller will look
inappropriate and detract from the value of their homes . The Council is
aware that there is a great need for afforable housing in St. Paul but they
feel strongly that those needs should nat be met by greatly altering the
appearance of an existing neighborhood. She stated that this particular
street has experienced much; they have hundreds of apartments , the Ramada
Inn complex, and the building of I-94 since many of these people first
developed those homes there. The neighborhood is already providing housing
stock for the City; approximately 20 other McKnight homes will be built
this year within view of the site. She also commented that the contractor
should have inspected the soil before purchase, he should have known how
much land he was purchasing and how the land was zoned. The correct information
should have been given on the application for the McKnight Housing Funds .

Ms. Baker further pointed out tl�dt the signatures on the petition in support
presented by Mr. Cerney are not adjoining the property in question. Many
of them are as far away as White Bear Avenue or do wn on Wilson Avenue which
is quite a distance.
Don Sandin, 456 Van Dyke, spoke in opposition stating that most of the lots
on Van Dayke are 60' or more on the average and they would like to keep it
that way. He also corrgnented that some of the signatures on the petition in
support are over 1 ,000' from the property in question. Property owners
within 350' are in opposition to the 3 lots.
Pat Sofie, 441 Van Dyke, stated that the only signature on the petition in
support that is in direct contact with the construction is Shaws who live
directly across the street and are moving and don't care. She also expressed
concern with off-street parking.
Gary Sorinson, 1816 Conway, spoke in opposition expressing concern with water
problems that may be created with construction of 3 homes .
Ray ��ilcenski , 463 Uan Dayke, stated it would lower the value of his property
and was concerned with water problems and congestion in the area.
Randy Bacchus , Bacchus Construction, talked about the McKniqht Financing Program
stating that he felt the neighborhood feels it is substantard housin�.
Toni Baker commented that the neighborhood has welcomed the McKnight Program
and their reason for opposition to the 3rd house nothing to do with the
color or the income of the people,
Tom 0' Keefe, 1808 E. Third, spoke in opposition statinq that if they are allowed
to construct 3 homes on that site others could also do the same.
Hearing no further testimony, Ms. Morton closed the public hearing portion of
the meeting.
Mr. �c�ods ma�e a m�tion to deny the vari�nce request based on findings 1
6 of the staff report. Mr. N.irk seconded the motion. The motion passed on
