Appeals and Review pertaining to the following listed property and as

rooms , because of practical difficulty and economic considerations .

PROCEEDINGS: Mr. Kremer said he had taken over �Che building September 1 ,
1�82 , when it was in very poor condition. He has been cleaning the roomsj

making wail repairs and redecorating. The tenants are mostly elderly
retired people on limited incomes . If forced to close some of the rooms
because of the insufficient number of bathrooms , it would add to the
problem of scarcity in low-cost rental housing. It would also mean a
reduction in rental income . If he used one of the rooms ta create an
additional bathroom, the cost of that plus the loss of rent from one unit
would require a raise in the other rental units to cover the expense .
As there was no representative of the Health Dept . present to advise the
board, Chairman Glassman asked the secretary, Pat bsoxness , to plaee a phone
call to that agency to see if anyone planned to appear at the meeting.
After a telenhone conversati,on with Dr. Paul Cox of the Health Dept . , -
the secretary reported that Dr. Cox said there was no objection to the
board granting a variance on the number of bathrooms in this case .
BOARD ACTION: Mr. Tilton moved that a variance on the health code pro-
vis�on requiring one bathroom facility for each five persons in a licensed
roominghouse be granted, permitting 14 persons to share use of two bath-
room facilities , effective for five years . Mr. Knutson seconded. MOTION
CARRIED AND SO ORDERED.

SUBJECT: Request variances of Section 34. 11 , pertaining to basic facilities ,
to perm t continued use of bathroom which lacks handsink (Apt. S) and to
permit continued sharing of one bathroom by occupants of Apts . 1 , 2 and 3,
an d Section 34. 13, pertaining to minimum space requirements , to permit
continued occup ancy of Apt. 2 . Request time extension until return of
good ��reather to repair defective exterior siding. Appellant also requests
definition of "privacy" requirement , as applied to b athroom facilities in
Apt. 5 , which is listed as a violation. Appeal is filed for reasons
involving financial considerations and practical difficulty. _ -
APPEARANCE: Ronald E . Kovacik
PROCEEDINGS: Mr. Kovacik said that Apt. S lacked a handsink in the bath-
room, ut t ere was no space for one , nor was there a suitable wall just
outside the room for one , because this would put a sink in the living raom.
Mr. Sawyer left the meeting at this time .
Mr. Gausman suggested that a small counter-top handsink might not detract
from the appearance of the living room. .
BOARD ACTION: Mr. Knutson moved to grant a variance of Section 34. 11 to
perm t use o bathroom lacking a handsink for the duration of the appellant 's
ownership or until the present tenant moves , whichever comes fa.rst. Mr.
Tilton seconded. MOTION CARRIED AND SO ORDERED.
THE VOTE : Ayes - 5 Nays - 0 Abstentions - 0
The c}uestion of the violation in regard to privacy of the bathroom in
Apt. #5 was brought up, and Ms . Bijjani said this meant that the bathroom
facility must have a door. Since Mr. Kovacik assured her that there was
indeed a door, she replied that the inspector had evidently missed it, so
if this was the case , there was no violation.
Mr. Kovacik asked that he be allowed to continue use of Ants . 1 , 2 and 3,
whose tenants share one b athroom. He explained that there was only one
person in each unit , and at present there was no one in Apt. 2 . Apt. 2
was also slightly smaller than required, and he wished to obtain a variance
that would permit him to rent it out in the future if he should want to.
BOARD ACTION: Mr. Tilton moved to grant a variance of Section 34. 11 , to
permit tenants of Apts . 1, 2 and 3 to share use of one ba.throom facility , �
on condition that Ant. 2 be rented only as a sleeping room and that no
more than four persons share the use of the bathroom. Mr. Gausman seconded.
MOTIOi1 CARRIED AND SO ORDERED.
THE VOTE : Ayes - S Nays - 0 Abstentions - 0
Mr. Kovacik said that he had the building resided on the side facing the
street to improve the appearance , but the cost of completing the remainder
of the building at this time , when interest rates were so high , was more
than he could af£ord. He asked for a time extension.
