Prior Hearing 12/8/81 : Case continued to January to allo�a time for further city inspection. _ � �' �� v� °� ,� • ' � -2- 1/12/81 - Meeting No. 181 APPEARANCE : Steve Mark, Dan Powell PROCEEDINGS : Mr. Knutson reported that the city electrical inspector had �scusse what he found with him, stating that there was a 30-amp two-wire service coming in for the whole building. Each 30-amp wire was subject to a potential 60-amp load, a dangerous situation. The code requires 100- amp service to each apartment of 600 sc{. ft. or more . Mr. Powell said he and his partner, Mr. Mark, were opposed to completely updating the electrical service because eventually they planned ta gut the building and make maj or changes in the floor plan , and such expense __ was not feasible under the p resent setup. Because of high interest rates on loans at this time , they were postponing the maj or rehalailitation to a more favorable time . If required to install complete new service now, rents would have to be raised and tenants now Tiving there could not afford to remain. Ch�irman Glassman asked if the required higher-amp service could be brought into the building now, with an extension of time to complete the work to bring each apartment un to code . Alice Bijjani felt that this could be worked out with the electrical in- spectar. Mr. Knutson said bringing the higher-amp wiring to the building and con- necting it to the lines feeding each anartment would eliminate the greatest problem, and suggested that this part of the job be comnleted by March 16 , _ _ . 1982 . He estimated this would cost about $700 . � BOARD ACTION : Mr. Knutson moved to grant a year's extension of time to eomplete t e electrical wiring , as required by code , to each of the •four dwelling units in the building , on condition that netiv service , suitable to accommodate four units , be brought into the building and connected to lines serving each unit, by June 1 , 1982 , subject to approval of the city electrical inspector. Mr. Sawyer seconded. MOTION CARRIED AND SO ORDERED. THE VOTE: Ayes - 6 Nays - 0 Abstentions - 0 Chairman Glassman said there was also a plumbing vent violation. Mr. Powell reported that the city inspector had found one sink that was not vented. Alice Bijjani stated that the city' s policy on this type of violatian was to rec{uire the installation of a vent if the fixture was siphoning, but if it was not siphoning, a vent should be installed whenever the fixture �aas replaced. APPEARANCE: Michael �, LeaAnn Kapaun , Assistant Fire Marshal Greg Plante PROCEEDINGS : Mr. Kapaun stated that he had purchased a woodburning furnace last summer to heat his home. After bringing home a large load of wood, he consulted with several city agencies , Mr. Carl of the Forestry Dept . , -4- 1/12/82 - Meeting No. 181 Mr. Tate and Mr. Staffenson of the Housing Dept. , and Paul McCloskey of the City Attorney' s office, and was told that the only stipulation regard- ing firewood storage was that it be at least 12 inches off the ground. Late in July and on various subsequent dates into September he received further, and sometimes conflicting, directives . On December 7, 1981 , he was notified of a new city ordinance requiring wood piles to be raised to 18 inches off the ground, 10 feet from a structure , an d not to exceed b feet in height . A letter from Frank Staffenson , dated December 10 , 1.981 , confirmed that the city had inspected the Kapaun property in July, August and October, that the August inspection had found a need for a portion of the wood to be raised, and that �his order �vas complied with as of August .. 26 , 1981. The October inspection was made in response to a neighbor' s complaint, but it was found no violation existed. Mr. Kapaun asked for an extension of time to June 1, 1982 , to comply with the recently-passed ordinance , since wintry weather would make it very difficult. Mr. Gausman asked if the Fire Dept. was involved in enforcemen� of the firewood regulations , along with the Housing Code Dept . Ms . Bijjani said the Housing Code Dept. was charged with enforcement of regulations regarding fire safety, some of which were part of the Fire Prevention Code . Mr. Staffenson observed that there was no regulation about property lines in stacking wood, only that it be at least 10 feet from a structure. Mr. Michael Ingeman, the neighbor who had complained about the wood stored on the Kap aun property, said he had gone in person to tell the Kapaun' s , when they first stacked their wood last summer, that it was an eyesore and in violation of the fire code . Assistant Fire Marshal Plante stated that the wood w as too close to the Kapaun house and a definite fire hazard. BOARD ACTION: Mr. Tilton moved to grant a variance of the ordinance per- taining to irewood storage , to permit the existing piles of wood to remain stacked as at present until August 1 , 1982 , except that the row stacked closest to appellant' s house must be removed. Appellant is directed to use up wood stacked at the side of the house first. Any new wood purchased must be stored in accordance with the ordinance , as amended on December 7, 1981. Kovacik (five units) SUB_JECT= Request variances of Section 34. 11, pertaining to basic facilities , to permit continued use of bathroom which lacks handsink (Apt. 5) and to permit continued sharing of one bathroom by occupants of Apts . 1 , 2 and 3, and Section 34. 13, pertaining to minimum space requirements , to permit continued occupancy of Apt. 2 . Request time extension until return of good weather to repair defective exterior siding. Appellant also requests definition of "privacy" requirement , as applied to bathroom facilities in Apt . 5 , which is listed as a violation. Appeal is filed for reasons involving financial considerations and practical difficulty. _� - APPEARANCE : Ronald E . Kovacik PROCEEDINGS: Mr. Kovacik said that Apt. S lacked a handsink in the bath- room, but t�iere was no space for one , nor was there a suitable wall just outside the room for one, because this would put a sink in the living room. Mr. Sawyer left the meeting at this time . Mr. Gausman suggested that a small counter-top handsink might not detract from the appearance of the living room. BOARD ACTION: Mr. Knutson moved to grant a variance of Section 34. 11 to permit use o bathroom lacking a handsink for the duration of the appellant's ownership or until the present tenant moves , whichever comes first. Mr. Tilton seconded. MOTION CARRIED AND SO ORDERED. THE VOTE : Ayes - 5 Nays - 0 Abstentions - 0 The question of the violation in regard to privacy of the bathroom in Apt. #5 was brought up , and Ms . Bijjani said this meant that the bathroom £acility must have a door. Since Mr. Kovacik assuxed her that there was indeed a door, she replied that the inspector had evidently missed it, so if this was the case , there was no violation. Mr. Kovacik asked that he be allowed to continue use of Ants . 1 , 2 and 3, whose tenants share one b athroom. He explained that there was only one person in each unit , and at present there was no one in Ant . 2 . Apt. 2 was also slightly smaller than required, and he wished to obtain a variance that would permit him to rent it out in the future if he should want to. BOARD ACTTON: Mr. Tilton moved to grant a variance of Section 34. 11 , to permit tenants of Apts . 1, 2 and 3 to share use of one ba:throom facility, on condition that Ant. 2 be rented only as a sleeping room and that no more �Chan four persons share the use of the bathroom. Mr. Gausman seconded. MOTION CARRIED AND SO ORDERED. THE VOTE : Ayes - 5 Nays - 0 Abstentions - 0 Mr. Kovacik said that he had the building rESided on the side facing the street to improve the appearance , but �he cost of completing the remainder of the building at this �Cime , when interest rates were so high , was more -than he could afford.
