RESOLVED� tha.t upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to Thoma.s Walters and his attorney,
Howard Kaplan the sum of $1,000.00 in full settlement of his
claim for injuries sustained August 10, 1980, while jogging
around Como Lake he cut his foot on a metal stub of an old No
Parking sign which had been sticking up a couple of inches out
of the ground.

RE: RESOLUTION authorizing payment to
Thoma.s Walters
Thoma.s Walters was jogging around Como Lake on August 10, 1980
when he cut his foot on the metal stub of an old No Parking
sign which was sticking up a couple of inches. The City was
not aware that the post stub was there but the rusty condition
of it indicated that it had been there some time. Therefore,
it is arguable that we should have known about it. The Public
Works Department �uts the si gns in and maintains them but the
Parks Department is responsible for general ma.intenance of the
area. Thus , both Public Works and Community Services are involved.
According. to city personnel, the stub of the sign post had sharp
edges on it. Mr. Walters ' foot was infected and he saw the doctor
� several times and used crutches while his foot was healing.
Suit was brought in District Court. This office recommends
payment of $1,000 to settle this suit.
