Sub�ect: Petition of Farm Credit Banks, et al, of St. Paul
for the vacation of a portion of East Ninth Street
and Temperance Street that abuts Lot 5, V. D. Walsh
Rearrangement of Lots 1 and 2, Block 16, Robert and
Randall-'s Addition.
Public Hearing - April ]3, 1982
The Farm Credit Banks, et al, as petitioners and awners of the abutting
property, requested this vacation due to the discovery that part of the
foundation and overhang of the four-story building nc�r on the site encroaches
on to the public right-of way (sidewalk) . The encroachments have occupied
this part of the right-of way for a significant period of ti.me without a�qy
detriment to the safety and �eneral welf�.re of the public. The encroachment
area to be vacated is less than two feet wide across the North and East side
of the building and consists of 325•4�+ square feet.
The Department of Public Works reports that East Ninth Street and Temperance
Street are 49-1�2 foot wide street right-of ways. The sidewalks on these
streets are extreme�y naxrow. They recommend vacation on�y for the life of
the existing building with its existing encroa.chments.
There were no ob�ections or recommendations from an,y other private or public
agencies involved. -
In view of the foregoing, I recommend that the va.cation be approved, subject
to the foll�ring conditions:
l. The.t the description of the property to be va.cated read
as follcyws;
That part of East Ninth Street lying within �he
follcswing described lines: Beginning at a point
on the northwesterly line of Lot 5, V. D. Walsh's
Reaxrangement of Lots 1 & 2, Bl'k. 16, Robert &
Randall's Add. and B1'k 7, Hoyt's Add. according to
the recorded plat thereof, said line also being
tbe southeaster�y line of said East Ninth Street,
distant 79.65 southwesterl,y of the most northerJy
corner of said Lot 5; thence northeasterly along
said northwesterly line and its northeasterly ex-
tension 81.5 feet, 1.5 feet beyond the north-
easterly face of the existing four-story brick
building on said Lot 5; thence northwesterly
parallel to the northwesterly extension of the north-

easterly line of said Lot 5 a distance of 1.52
feet, 1.0 foot northwesterly oP the northerly
corner of said building; thence southwesterly
parallel to and 1.0 foot distant f�om the north-

That pa.rt of Temperance Street lying within the
foll�ring described lines: Beginni.ng at the most
norther�y corner of Lot 5, V. D. Walsh's Rearrangement
of Lots 1 & 2, B1'k. ].6, Robert & Randall's Add. and
B1'k 7, Hoyt's Add. according to the recorded plat
thereof; thence northeasterly along the north-
easterly extension of the northwesterly line of sa.id
Lot 5 a distance of 1.8� feet, 1.5 feet northeasterl,y
of the northeaster]y face of the existing four-story
brick building on said Lot 5; thence southeasterly
99•� feet parallel to and 1.5 feet dista.nt from the
f�.ce of said building and its southea.sterly extension
to a point 1.5 feet northea.sterly of the southeasterl,y
corner of the existing concrete foundation wall on
the southea.sterly side of said building; thence
southwesterly 1.85 feet along the southeasterly fhce
of said foundation wall to the southwesterly line
of Temperance Street, said line being also the north-
easterly line of said I,ot 5; thence northwester],y
along said southwesterly line of Temperance Street
99.48 feet to the point of beginning.
�.2:� That the va.cation be subject to all the terms and conditions of
Chapter 130 of the St. Paul Legislative Code, as amended, including
the retention of e11 public utilities easements.
�� Tha.t the vacated areas described herein shall automaticalJ,y revert
to the City of St. P�ul for no compensation in the event the present
building is removed for ar�y reason from these areas.
` �� That the petitioner pay to the City as market va.lue the sum of
$3,000.00 as compensation for said vaca�tion.
,�sf. Tha.t the petitioner flarnish the City, as required by Section 130.05
(2) of the St. Paul Legislative Code, with a bond in the amount of
$10,000.00, and by accepta.nce of the terms and conditions of this va-
cation, the petitioners, their successors and assigns, agree to in-
demnif�r, defend and save harmless the City of Saint Paul, its officers,
and employees from all suits, action, or claims of ar�y character, in-
cluding, but not limited to, a claim Drought because of ar�y injuries,
or dama.ges received or sustained by ar�y person, persons or property,
on account of this vacation, or because of ar�y act or omission, neglect
or misconduct of said petitioner; or because of any claim or liability
arising fY om or based on ar�y violation of ar�y law o egalation made in
accordance with the law, whether by the petition or ang�b�' its agents
