RESOLVED� that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to James S. McCurdy and his attorney,
Carter J. Bergen, the sum of $200.00 in full settlement of their
claim for damages sustained April 10, 1980, as more particularly
set out in a communication to the City Council on September 9,
1980.

RE: Claim against the City of Saint Paul by
James S. McCurdy
This lawsuit arises out of the arrest of James McCurdy on
April 10, 1980 by St. Paul police officers. Mr. McCurdy was
arrested on an old Chisago County Warrant which was still in
the Ramsey County computer as an active warrant. However,
the warrant had actually been cancelled on Ma.y 20, 1977. If
St. Paul had checked with the state computer or with Chisago
County prior to arresting Mr. McCurdy, they would ha.ve learned
that the warrant was no longer valid. Mr. McCurdy was held
for several hours before the mistake was disco,vered and he was
released. Mr. McCurdy has agreed to accept $900 in settlement
of this case; of which Chisago County is paying $450 and Ramsey
County is paying $250.
This off ice recommends payment of $200 by the City to settle
this case.
